56-Be It Enacted by the Legislature of the State of Florida: 31

58- Section 1. Subsections (1) and (2) of section 177.071, 33
59-Florida Statutes, ar e renumbered as subsections (4) and (5), 34
60-respectively, and new subsections (1), (2), and (3) are added to 35
61-that section to read: 36
62- 177.071 Administrative approval of plats and replats plat 37
63-by designated administrative authority and official governing 38
64-bodies.— 39
65- (1)(a) A plat or replat submitted under this part must be 40
66-administratively approved, and further action or approval by the 41
67-governing body of a county or municipality is not required if 42
68-the plat or replat complies with the requirements of s. 177.091. 43
69-The governing body of the county or municipality shall 44
70-designate, by ordinance or resolution, an administrative 45
71-authority to receive, process, and review the plat or replat 46
72-submittal, including designating an administrative official 47
73-responsible for approvin g, approving with conditions, or denying 48
74-the proposed plat or replat. 49
75- (b) As used in this section, the term "administrative 50
51+respectively, and subsection (1) is added to that section, to 26
52+read: 27
53+ 177.071 Approval of plat by governing bodies. — 28
54+ (1) Preliminary plat or replat submittals shall be 29
55+reviewed and approved administratively by a designee or 30
56+designees of the appropriate local governing body. Within 15 31
57+days after receipt of a plat or rep lat submittal, the designee 32
58+or designees of the appropriate local governing body shall 33
59+review the plat or replat submittal for compliance with s. 34
60+177.091. If it is determined that such plat or replat submittal 35
61+fails to meet the requirements of s. 177.091, written comments 36
62+specifying the areas of noncompliance must be provided to the 37
63+applicant within the 15 -day review period. The plat or replat 38
64+submittal must be approved, approved with conditions, or denied 39
65+within 30 working days from the date that the plat or replat is 40
66+submitted, unless a written extension of this timeframe is 41
67+requested by the applicant and approved by the governing body. 42
68+An official, employee, agent, or designee of the governing body 43
69+may not request or require the applicant to file a writte n 44
70+extension of time. 45

88-authority" means a department, division, or other agency of a 51
89-county or municipality. For purposes of issuing a final 52
90-administrative approval of a plat or replat submittal, the term 53
91-also includes an administrative officer or employee designated 54
92-by the governing body of a county or municipality, including, 55
93-but not limited to, a county administrator or manager, a city 56
94-manager, a deputy county administrator or manager, a deputy city 57
95-manager, an assistant county administrator or manager, an 58
96-assistant city manager, or other high -ranking county or city 59
97-department or division director with direct or indirect 60
98-oversight responsibility for the county's or municipality's land 61
99-development, housing, utilities, or public works programs. 62
100- (2) Within 10 business days after receipt of a plat or 63
101-replat submittal, the administrative authority shall provide 64
102-written notice to the applicant acknowledging r eceipt of the 65
103-plat or replat submittal and identifying any missing documents 66
104-or information necessary to process the plat or replat submittal 67
105-for compliance with s. 177.091. The written notice must also 68
106-provide information regarding the plat or replat appr oval 69
107-process, including requirements regarding the completeness of 70
108-the process and applicable timeframes for reviewing, approving, 71
109-and otherwise processing the plat or replat submittal. 72
110- (3) Unless the applicant requests an extension of time, 73
111-the administrative authority shall approve, approve with 74
112-conditions, or deny the plat or replat submittal within the 75

125-timeframe identified in the written notice provided to the 76
126-applicant under subsection (2). If the administrative authority 77
127-does not approve the plat or replat submittal, it must provide 78
128-written notice to the applicant stating the reasons for denying 79
129-the approval of the submittal. The written notice must identify 80
130-all areas of noncompliance and include specific citations to 81
131-each requirement the plat or rep lat submittal fails to meet. The 82
132-administrative authority, or an official, an employee, an agent, 83
133-or a designee of the governing body, may not request or require 84
134-the applicant to file a written extension of time. 85
135- (4)(1) Before a plat or replat is offered for recording, 86
136-it must be administratively approved as required by this section 87
137-by the appropriate governing body , and evidence of such approval 88
138-must be placed on the plat or replat. If not approved, the 89
139-governing body must return the plat or replat to the 90
140-professional surveyor and mapper or the legal entity offering 91
141-the plat or replat for recordation. For the purposes of this 92

143- (a) When the plat or replat to be submitted for approval 94
144-is located wholly within the boundaries of a municipality, the 95
145-governing body of the municipality has exclusive jurisdiction to 96
146-approve the plat or replat. 97
147- (b) When a plat or replat lies wholly within the 98
148-unincorporated areas of a county, the governing body of the 99
149-county has exclusive jurisdiction to approve the plat or replat. 100

162- (c) When a plat or replat lies within the boundaries of 101
163-more than one county, municipality, or both governing body, two 102
164-plats or replats must be prepared and each county or 103
165-municipality governing body has exclusive jurisdiction to 104
166-approve the plat or replat within its boundaries, unless each 105
167-county or municipality with jurisdiction over the plat or replat 106
168-agrees the governing bodies having said jurisdiction agree that 107
169-one plat is mutually acceptable. 108
170- (5)(2) Any provision in a county charter, o r in an 109
171-ordinance of any charter county or consolidated government 110
172-chartered under s. 6(e), Art. VIII of the State Constitution, 111
173-which provision is inconsistent with anything contained in this 112
174-section shall prevail in such charter county or consolidated 113
175-government to the extent of any such inconsistency. 114

218- Section 4. This act shall take effect July 1, 2025. 145
