5656 Be It Enacted by the Legislature of the State of Florida: 31

5858 Section 1. Section 627.42398, Florida Statutes, is created 33
5959 to read: 34
6060 627.42398 Coverage for nonparticipating ambulance 35
6161 services.— 36
6262 (1) As used in this section, the term: 37
6363 (a) "Ambulance service provider" means a ground ambulance 38
6464 service licensed pursuant to s. 401.25. 39
6565 (b) "Nonparticipating ambulance service provider" means a 40
6666 provider that is not a preferred provider as defined in s. 41
6767 627.6471(1) or a provider that is not an exclusive provider as 42
6868 defined in s. 627.6472(1)(c). 43
6969 (2) A health insurer that offers an indiv idual or group 44
7070 health insurance policy providing major medical coverage that 45
7171 includes coverage for ground ambulance services must reimburse a 46
7272 nonparticipating ambulance service provider for providing such 47
7373 covered ambulance services at a rate that is the lo west of the 48
7474 following: 49
7575 (a) The rate set or approved, whether in contract, in 50

8989 jurisdiction in which the covered ground ambulance services 52

9191 (b) Three hundred twenty -five percent of the current 54
9292 published rate for ground ambulance services as established by 55
9393 the Centers for Medicare and Medicaid Services under Title XVIII 56
9494 of the Social Security Act for the same services provided in the 57
9595 same geographic area. 58
9696 (c) The ambulance service provider's billed charges. 59
9797 (3) Payment in full by the insured of his or her 60
9898 applicable copayment, coinsurance, or deductible constitutes an 61
9999 accord and satisfaction, and a release, of any claim for 62
100100 additional moneys owed by the insured to the health insur er or 63
101101 to any person or entity in connection with the ground ambulance 64
102102 services. 65
103103 (4) Copayment, coinsurance, deductible, and other cost -66
104104 sharing responsibilities paid for a nonparticipating ambulance 67
105105 service provider's covered services may not exceed the 68
106106 copayment, coinsurance, deductible, and other cost -sharing 69
107107 responsibilities for a preferred provider as defined in s. 70
108108 627.6471(1) or a provider that is not an exclusive provider as 71
109109 defined in s. 627.6472(1)(c) for covered services. 72
110110 (5) An ambulance servic e provider is considered a provider 73
111111 subject to s. 627.6131, and the claims of the provider are 74

135135 (1) As used in this section, the term: 86
136136 (a) "Ambulance service provider" means a ground ambulance 87
137137 service licensed pursuant to s. 401.25. 88
138138 (b) "Out-of-network ambulance service p rovider" means a 89
139139 provider that is not under contract with a health maintenance 90
140140 organization. 91
141141 (2) A health maintenance contract that offers individual 92
142142 or group major medical coverage that includes coverage for 93
143143 ground ambulance services must require a heal th maintenance 94
144144 organization to reimburse an out -of-network ambulance service 95
145145 provider for providing covered ambulance services at a rate that 96
146146 is the lowest of the following: 97
147147 (a) The rate set or approved, whether in contract, in 98
148148 ordinance, or otherwise, b y a local governmental entity in the 99
149149 jurisdiction in which the covered services originated. 100

175175 sharing responsibilities paid for an out -of-network ambulance 114
176176 service provider's covered services may not exceed the in -115
177177 network copayment, coinsurance, deductible, and other cost -116
178178 sharing responsibilities for covered ser vices received by the 117
179179 subscriber. 118
180180 (5) An ambulance service provider is considered a 119
181181 provider, and the claims of the provider are subject to s. 120

183183 Section 4. This act shall take effect January 1, 2026. 122
