21	21	Be It Enacted by the Legislature of the State of Florida: 8

23	23	Section 1. Paragraphs (b) and (d) of subsection (18) and 10
24	24	subsection (19) of section 395.1055, Florida Statutes, are 11
25	25	amended to read: 12
26	26	395.1055 Rules and enforcement. — 13
27	27	(18) In establishing rules for adult cardiovascular 14
28	28	services, the agency shall include provisions that allow for: 15
29	29	(b)1. For a hospital seeking a Level I program, the 16
30	30	hospital must have demonstration that, for the most recent 12-17
31	31	month period as reported to the agency, the hospital has 18
32	32	provided a minimum of 300 adult inpatient and outpatient 19
33	33	diagnostic cardiac catheterizations or, for the most recent 12 -20
34	34	month period, has discharged or transferred at least 300 21
35	35	patients with the principal diagnosis of ischemic heart disease 22
36	36	and that it has a formalized, written transfer agreement with a 23
37	37	hospital that has a Level II program, including written 24
38	38	transport protocols to ensure safe and efficient transfer of a 25

52	52	2.a. A hospital located more than 100 road miles from the 27
53	53	closest Level II adult cardiovascular services program is not 28
54	54	required to meet the diagnostic cardiac catheterization volume 29
55	55	and ischemic heart disease diagnosis volume requirements in 30
56	56	subparagraph 1. if the hospital demonstrates that it has, for 31
57	57	the most recent 12-month period as reported to the agency, 32
58	58	provided a minimum of 100 adult inpatient and outpatient 33
59	59	diagnostic cardiac catheterizations or that, for the most recent 34
60	60	12-month period, it has discharged or transferred at least 300 35
61	61	patients with the principal diagnosis of ischemic heart disease. 36
62	62	2.b. A hospital located more than 100 road miles from the 37
63	63	closest Level II adult cardiovascular services program does not 38
64	64	need to meet the 60-minute transfer time protocol requirement in 39
65	65	subparagraph 1. if the hospital demonstrates that it has a 40
66	66	formalized, written transfer agreement with a hospital that has 41
67	67	a Level II program. The agreement must include written transport 42
68	68	protocols to ensure the s afe and efficient transfer of a 43
69	69	patient, taking into consideration the patient's clinical and 44
70	70	physical characteristics, road and weather conditions, and 45
71	71	viability of ground and air ambulance service to transfer the 46
72	72	patient. 47
73	73	3. At a minimum, the rules for adult cardiovascular 48
74	74	services must require nursing and technical staff to have 49
75	75	demonstrated experience in handling acutely ill patients 50

88	88	requiring intervention, based on the staff member's previous 51
89	89	experience in dedicated cardiac interventional laboratorie s or 52
90	90	surgical centers. If a staff member's previous experience is in 53
91	91	a dedicated cardiac interventional laboratory at a hospital that 54
92	92	does not have an approved adult open heart surgery program, the 55
93	93	staff member's previous experience qualifies only if, at t he 56
94	94	time the staff member acquired his or her experience, the 57
95	95	dedicated cardiac interventional laboratory: 58
96	96	a. Had an annual volume of 500 or more percutaneous 59
97	97	cardiac intervention procedures. 60
98	98	b. Achieved a demonstrated success rate of 95 percent or 61
99	99	greater for percutaneous cardiac intervention procedures. 62
100	100	c. Experienced a complication rate of less than 5 percent 63
101	101	for percutaneous cardiac intervention procedures. 64
102	102	d. Performed diverse cardiac procedures, including, but 65
103	103	not limited to, balloon angioplast y and stenting, rotational 66
104	104	atherectomy, cutting balloon atheroma remodeling, and procedures 67
105	105	relating to left ventricular support capability. 68
106	106	(d) Compliance with the most recent guidelines of the 69
107	107	American College of Cardiology , and the American Heart 70
108	108	Association, the Heart Rhythm Society for hospitals providing 71
109	109	electrophysiology services, and the Society for Cardiovascular 72
110	110	Angiography and Interventions guidelines for staffing, physician 73
111	111	training and experience, operating procedures, equipment, 74
112	112	physical plant, and patient selection criteria , to ensure 75

126	126	(19) The agency may adopt rules to administer the 77
127	127	requirements of part II of chapter 408 and shall update agency 78
128	128	rules as new standards and guidelines are published . 79
