26-Be It Enacted by the Legislature of the State of Florida: 13

28- Section 1. Section 843.23, Florida Statutes, is amended to 15
29-read: 16
30- 843.23 Tampering with an electronic monitoring device. — 17
31- (1) As used in this section, the term "electronic 18
32-monitoring device" includes any device that is used to track the 19
33-location of a person. 20
34- (2) It is unlawful for a person to intentionally and 21
35-without authority: 22
36- (a) Remove, destroy, alter, tamper with, damage, or 23
37-affirmatively act to circumvent the operation of an electronic 24
38-monitoring device that must be worn or used by that person or 25

51-another person pursuant to a court order or pursuant to an order 26
52-by the Florida Commission on Offender Review; or 27
53- (b) Request, authorize, or solicit a person to remove, 28
54-destroy, alter, tamper with, damage, or affirmatively act to 29
55-circumvent the operation of an electronic monitoring device 30
56-required to be worn or used pursuant to a co urt order or 31
57-pursuant to an order by the Florida Commission on Offender 32
58-Review. 33
59- (3) Except as provided in subsection (4), a person who 34
60-violates this section commits a : 35
61- (a) Felony of the third degree, punishable as provided in 36
62-s. 775.082, s. 775.083, o r s. 775.084, if the person who must 37
63-wear or use the electronic monitoring device is charged with or 38
64-serving a sentence for a misdemeanor or a third degree felony . 39
65- (b) Felony of the second degree, punishable as provided in 40
66-s. 775.082, s. 775.083, or s. 7 75.084, if the person who must 41
67-wear or use the electronic monitoring device is charged with or 42
68-serving a sentence for a second degree felony. 43
69- (c) Felony of the first degree, punishable as provided in 44
70-s. 775.082, s. 775.083, or s. 775.084, if the person w ho must 45
71-wear or use the electronic monitoring device is charged with or 46
72-serving a sentence for a first degree felony, a first degree 47
73-felony punishable by a term of years not exceeding life, a life 48
74-felony, or a capital felony. 49
75- (4) A person under 18 years of age who violates this 50
51+destroy, alter, tamper with, damage, or circumvent the operation 26
52+of an electronic monitor ing device required to be worn or used 27
53+pursuant to a court order or pursuant to an order by the Florida 28
54+Commission on Offender Review. 29
55+ (3) A person who violates this section commits a : 30
56+ (a) Felony of the third degree, punishable as provided in 31
57+s. 775.082, s. 775.083, or s. 775.084 , if the person is charged 32
58+with or serving a sentence for a misdemeanor or a third degree 33
59+felony. 34
60+ (b) Felony of the second degree, punishable as provided in 35
61+s. 775.082, s. 775.083, or s. 775.084, if the person is charged 36
62+with or serving a sentence for a second degree felony. 37
63+ (c) Felony of the first degree, punishable as provided in 38
64+s. 775.082, s. 775.083, or s. 775.084, if the person is charged 39
65+with or serving a sentence for a first degree felony. 40
66+ (d) Felony of the first d egree, punishable by a term of 41
67+years not exceeding life or as provided in s. 775.082, s. 42
68+775.083, or s. 775.084, if the person is charged with or serving 43
69+a sentence for a first degree felony punishable by a term of 44
70+years not exceeding life. 45
71+ (e) Life felony, punishable as provided in s. 775.082, s. 46
72+775.083, or s. 775.084, if the person is charged with or serving 47
73+a sentence for a life or capital felony. 48
74+ (4) A person on pretrial release who commits a violation 49
75+of this section shall have his or her pretrial release 50

88-section commits a felony of the third degree, punishable as 51
89-provided in s. 775.082, s. 775.083, or s. 775.084. 52
90- (5) The court must revoke pretrial release for a person 53
91-who commits a violation of this section while he or she is on 54
92-pretrial release. Thereafter, the court may set a new bond with 55
93-conditions of release upon making a written finding that 56
94-sufficient conditions of release exist to reasonably protect the 57
95-community from risk of physical harm, ensure the presence of the 58
96-accused at trial or at other proceedings, and assure the 59
97-integrity of the judicial process. 60
98- Section 2. This act shall take effect October 1, 2025. 61
88+terminated and shall no longer be eligible for pretrial release 51
89+for the offenses for which he or she was on release. 52
90+ Section 2. This act shall take effect October 1, 2025. 53
