22-Be It Enacted by the Legislature of the State of Florida: 9

24- Section 1. Subsection (5) of section 782.04, Florida 11
25-Statutes, is renumbered as subsection (6), and a new subsection 12
26-(5) is added to that section to read : 13
27- 782.04 Murder.— 14
28- (5)(a) As used in this subsection, the term: 15
29- 1. "Dangerous fentanyl or fentanyl analogs" means any 16
30-controlled substance described in s. 893.135(1)(c)4.a.(I) –(VII). 17
31- 2. "Distribute" has the same meaning as in s. 893.02. 18
32- (b) The unlawful killing of a human being, when 19
33-perpetrated without any design to effect death, which resulted 20
34-from the unlawful distribution by a person less than 18 years of 21
35-age of any substance or mixture that he or she knew or 22
36-reasonably should have known contai ned dangerous fentanyl or 23
37-fentanyl analogs when such substance or mixture is proven to 24
38-have caused, or is proven to have been a substantial factor in 25

21+Be It Enacted by the Legislature of the State of Florida: 8

23+ Section 1. Subsection (4) of section 782.04, Florida 10
24+Statutes, is amended to read: 11
25+ 782.04 Murder.— 12
26+ (4) The unlawful killing of a human being, when 13
27+perpetrated without any design to effect death, by a person 14
28+engaged in the perpetration of, or in the attempt to perpetrate, 15
29+any felony other than any: 16
30+ (a) Trafficking offense prohibited by s. 893.135(1), 17
31+ (b) Arson, 18
32+ (c) Sexual battery, 19
33+ (d) Robbery, 20
34+ (e) Burglary, 21
35+ (f) Kidnapping, 22
36+ (g) Escape, 23
37+ (h) Aggravated child abuse, 24
38+ (i) Aggravated abuse of an elderly person or disabled 25
