1515 An act relating to location of equipment owned by an 2

1717 municipalities from enacting certain policies, 4
1818 ordinances, regulations, or other measures that 5
1919 require payment from an amusement business owner for 6
2020 the placement, parking, or storage of equipment for 7
2121 longer than a specified length of time on certain 8
2222 agricultural lands; providing applicability; defining 9
2323 the terms "agricultural lands" and "amusement business 10
2424 owner"; providing an effective date. 11

2626 Be It Enacted by the Legislature of the State of Florida: 13

2828 Section 1. (1) Notwithstanding any law to the contrary, a 15
2929 county or municipality may not enact a policy, ordinance, 16
3030 regulation, or other measure that addresses agricultural lands 5 17
3131 acres or larger if the policy, ordinance, regulation, or other 18
3232 measure requires a monetary exaction from an amusement business 19
3333 owner whose equipment is placed, parked, o r stored on the 20
3434 agricultural land for 6 months or longer. This prohibition 21
3535 applies only if the agricultural land is fully fenced along the 22
3636 perimeter and the equipment that is placed, parked, or stored on 23
3737 the agricultural land is at least 100 feet from the perimeter 24
3838 fencing. 25

5151 (2) For purposes of this section, the term: 26
5252 (a) "Agricultural lands" means those parcels classified by 27
5353 the property appraiser as agricultural lands under s. 193.461. 28
5454 (b) "Amusement business owner" means a provider of 29
5555 services affiliated with a circus or carnival such as rides, 30
5656 food, beverages, and games who travels around the United States 31
5757 on a seasonal or temporary basis to provide such services to 32
5858 state, district, and county fairs as defined in s. 616.001, or 33
5959 who supports events sponsored by not-for-profit organizations 34
6060 for fundraising. 35
6161 Section 2. This act shall take effect July 1, 2025. 36
