24	24	Be It Enacted by the Legislature of the State of Florida: 11

26	26	Section 1. Paragraph (b) of subsection (1) of section 13
27	27	553.9081, Florida Statutes, is amended to read: 14
28	28	553.9081 Florida Building Code; required amendments. —The 15
29	29	Florida Building Commission shall amend the Florida Building 16
30	30	Code-Energy Conservation to: 17

32	32	(b) Authorize commissioning reports to be provided by a 19
33	33	licensed design professional, an electrical engineer, a or 20
34	34	mechanical engineer, or a licensed commissioning authority. A 21
35	35	person commissioning a report under this parag raph, and the 22
36	36	authority, organization, or third -party entity such person works 23
37	37	for, must be independent from the person or entity creating the 24
38	38	building design or constructing the HVAC or electrical system, 25

51	51	and such person's qualifications and reliability m ust be 26
52	52	relevant to the building components and systems for which the 27
53	53	person is providing a commissioning report . 28
54	54	Section 2. Subsections (4) through (9) of section 553.993, 29
55	55	Florida Statutes, are renumbered as subsections (5) through 30
56	56	(10), respectively, and a new subsection (4) is added to that 31
57	57	section to read: 32
58	58	553.993 Definitions. —For purposes of this part: 33
59	59	(4) "Commissioning authority" means a qualified person, 34
60	60	typically a licensed design professional, an electrical 35
61	61	engineer, a mechanical engineer, or a qualified firm responsible 36
62	62	for reporting the building commission process, which is 37
63	63	independent from the person or entity creating the building 38
64	64	design or performing construction. 39
65	65	Section 3. Section 553.998, Florida Statutes, is amended 40
66	66	to read: 41
67	67	553.998 Compliance.—All ratings must be determined using 42
68	68	tools and procedures developed by the systems recognized under 43
69	69	this part and must be certified by the rater as accurate and 44
70	70	correct and in compliance with procedures of the system under 45
71	71	which the rater is certified. The local enforcement agency shall 46
72	72	accept duct and air infiltration tests conducted in accordance 47
73	73	with the Florida Building Code, 5th Edition (2014) Energy 48
74	74	Conservation, by individuals as defined in s. 553.993(6) or (8) 49
75	75	s. 553.993(5) or (7) or individuals licensed as set forth in s. 50
