HB 543 2025 CODING: Words stricken are deletions; words underlined are additions. hb543-00 Page 1 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to third -party reservation platforms; 2 providing a short title; creating s. 509.105, F.S.; 3 defining the term "third -party reservation platform"; 4 prohibiting a reservation at a public food service 5 establishment from being listed, advertised, promoted, 6 or sold through a third -party reservation platform; 7 authorizing the Division of Hotels and Restaurants of 8 the Department of Business and Professional Regulation 9 to impose a civil penalty not to exceed a specified 10 amount for a violation of this act or of a division 11 rule; providing that such violations to accrue on a 12 specified time and for certain establishments; 13 providing an effective date. 14 15 Be It Enacted by the Legislature of the State of Florida: 16 17 Section 1. This act may be cited to as the "Restaurant 18 Reservation Anti-Piracy Act." 19 Section 2. Section 509.105, Florida Statutes, is created 20 to read: 21 509.105 Third-party reservation platforms pr ohibited.— 22 (1) As used in this section, the term "third -party 23 reservation platform" means a website, mobile application, or 24 other Internet service that: 25 HB 543 2025 CODING: Words stricken are deletions; words underlined are additions. hb543-00 Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (a) Offers or arranges for a reservation at a public food 26 service establishment for on -premises service. 27 (b) Is owned and operated by a person other than the owner 28 of the public food service establishment. 29 (c) Does not have a contractual relationship or agreement 30 with the public food service establishment, or its contractual 31 designee, to offer or a rrange for a reservation at the public 32 food service establishment for on -premises service. 33 (2) A reservation at a public food service establishment 34 may not be listed, advertised, promoted, or sold through a 35 third-party reservation platform. 36 (3) The division may impose a civil penalty on a third -37 party reservation platform in an amount not to exceed $1,000 for 38 each violation of this section or of a division rule. Violations 39 under this subsection shall accrue on a daily basis for each day 40 and for each food service establishment in which there has been 41 a violation of this section or rules of the division. 42 Section 3. This act shall take effect July 1, 2025. 43
