3131 Section 1. This act may be cited to as the "Restaurant 18
3232 Reservation Anti-Piracy Act." 19
3333 Section 2. Section 509.105, Florida Statutes, is created 20

3636 (1) As used in this section, the term "third -party 23
3737 reservation platform" means a website, mobile application, or 24

5151 (a) Offers or arranges for a reservation at a public food 26
5252 service establishment for on -premises service. 27
5353 (b) Is owned and operated by a person other than the owner 28
5454 of the public food service establishment. 29
5555 (c) Does not have a contractual relationship or agreement 30
5656 with the public food service establishment, or its contractual 31
5757 designee, to offer or a rrange for a reservation at the public 32
5858 food service establishment for on -premises service. 33
59- (2) A third-party reservation platform does not include a 34
60-contractual designee of an individual customer which a rranges 35
61-for a personal and nontransferrable reservation at a food 36
62-service establishment at the request of the customer and at no 37
63-cost to the customer, provided that the designee shares the 38
64-individual customer's contact information with the food service 39
65-establishment, allows the food service establishment to confirm 40
66-the reservation with the individual customer, and honors 41
67-requests from the food service establishment to opt out of 42
68-future reservations created by the designee. 43
69- (3) A reservation at a public fo od service establishment 44
70-may not be listed, advertised, promoted, facilitated, sold, or 45
71-otherwise enabled through a third -party reservation platform. 46
72- (4) The division may impose a civil penalty on a third -47
73-party reservation platform in an amount not to ex ceed $1,000 for 48
74-each violation of this section or of a division rule. Violations 49
