CS/HB 543 2025 CODING: Words stricken are deletions; words underlined are additions. hb543-01-c1 Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to third -party reservation platforms; 2 providing a short title; creating s. 509.105, F.S.; 3 defining the term "third -party reservation platform"; 4 prohibiting a reservation at a public food service 5 establishment from being listed, advertised, promoted, 6 or sold through a third -party reservation platform; 7 providing an exception; authorizing the Division of 8 Hotels and Restaurants of the Department of Bu siness 9 and Professional Regulation to impose a civil penalty 10 not to exceed a specified amount for a violation of 11 this act or of a division rule; providing that such 12 violations shall accrue on a daily basis for certain 13 establishments; providing an effective date. 14 15 Be It Enacted by the Legislature of the State of Florida: 16 17 Section 1. This act may be cited to as the "Restaurant 18 Reservation Anti-Piracy Act." 19 Section 2. Section 509.105, Florida Statutes, is created 20 to read: 21 509.105 Third-party reservation platforms prohibited. — 22 (1) As used in this section, the term "third -party 23 reservation platform" means a website, mobile application, or 24 other Internet service that satisfies all of the following: 25 CS/HB 543 2025 CODING: Words stricken are deletions; words underlined are additions. hb543-01-c1 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (a) Offers or arranges for a reservation at a p ublic food 26 service establishment for on -premises service. 27 (b) Is owned and operated by a person other than the owner 28 of the public food service establishment. 29 (c) Does not have a contractual relationship or agreement 30 with the public food service establ ishment, or its contractual 31 designee, to offer or arrange for a reservation at the public 32 food service establishment for on -premises service. 33 (2) A third-party reservation platform does not include a 34 contractual designee of an individual customer which a rranges 35 for a personal and nontransferrable reservation at a food 36 service establishment at the request of the customer and at no 37 cost to the customer, provided that the designee shares the 38 individual customer's contact information with the food service 39 establishment, allows the food service establishment to confirm 40 the reservation with the individual customer, and honors 41 requests from the food service establishment to opt out of 42 future reservations created by the designee. 43 (3) A reservation at a public fo od service establishment 44 may not be listed, advertised, promoted, facilitated, sold, or 45 otherwise enabled through a third -party reservation platform. 46 (4) The division may impose a civil penalty on a third -47 party reservation platform in an amount not to ex ceed $1,000 for 48 each violation of this section or of a division rule. This act shall take effect July 1, 2025. 54
