25	25	Be It Enacted by the Legislature of the State of Florida: 12
26	26	13
27	27	Section 1. Subsection (3) of section 316.081, Florida 14
28	28	Statutes, is amended to read: 15
29	29	316.081 Driving on right side of roadway; exceptions. — 16
30	30	(3) As used in this subsect ion, the term "furthermost 17
31	31	left-hand lane" means the farthest, most left -hand lane, unless 18
32	32	such left-hand lane is a high-occupancy-vehicle lane as defined 19
33	33	in s. 316.0741, or is a designated left -turn lane, in which 20
34	34	cases the furthermost left -hand lane is the lane immediately to 21
35	35	the right of the high -occupancy-vehicle lane or the left -turn 22
36	36	lane. 23
37	37	(a) On a road, street, or highway having two or more lanes 24
38	38	allowing movement in the same direction, a driver may not 25

51	51	continue to operate a motor vehicle in the fur thermost left-hand 26
52	52	lane if the driver knows or reasonably should know that he or 27
53	53	she is being overtaken in that lane from the rear by a motor 28
54	54	vehicle traveling at a higher rate of speed. This paragraph 29
55	55	subsection does not apply to drivers operating a vehic le that is 30
56	56	overtaking another vehicle proceeding in the same direction, or 31
57	57	is preparing for a left turn at an intersection. 32
58	58	(b) On a designated road, street, or highway with two or 33
59	59	more lanes allowing movement in the same direction and with a 34
60	60	posted speed limit of at least 65 miles per hour, a driver may 35
61	61	not operate a motor vehicle in the furthermost left -hand lane 36
62	62	when other vehicular traffic is present, except when: 37
63	63	1. Overtaking and passing another vehicle; 38
64	64	2. Preparing to exit the road, street, or highway; 39
65	65	3. Required by s. 316.126; 40
66	66	4. Otherwise directed by an official traffic control 41
67	67	device; or 42
68	68	5. Environmental or traffic conditions dictate. 43

70	70	This paragraph does not apply to drivers operating authorized 45
71	71	emergency vehicles or drivers operatin g vehicles engaged in 46
72	72	highway maintenance or construction operations. 47
73	73	(c) The Department of Transportation shall designate the 48
74	74	portions of any roadway for which paragraph (b) applies and 49
75	75	install the appropriate signage advising motorists of the 50
