CS/CS/HB 561 2025 CODING: Words stricken are deletions; words underlined are additions. hb561-02-c2 Page 1 of 6 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to manufacturing; amending s. 20.60, 2 F.S.; revising the duties of the Department of 3 Commerce; creating s. 20.6051, F.S.; establishing the 4 Chief Manufacturing Officer among the senior 5 leadership of the department; providing that the Chief 6 Manufacturing Officer is appointed by and serves at 7 the pleasure of the Secretary of Commerce; providing 8 responsibilities for the Chief Manufacturing Officer; 9 directing all state and local governmental entities to 10 assist the Chief Manufacturing Officer; requ iring the 11 department to prepare a report regarding manufacturing 12 efforts in this state; requiring the department to 13 submit its report on a specified date and biennially 14 thereafter to the Governor and the Legislature; 15 requiring that the report include certa in information; 16 creating s. 288.1031, F.S.; providing legislative 17 findings; creating s. 288.1032, F.S.; providing 18 definitions; creating s. 288.1033, F.S.; creating the 19 Florida Manufacturing Promotional Campaign within the 20 department; providing the purpose of the campaign; 21 requiring the department to take certain actions in 22 promoting the campaign; creating s. 288.1034, F.S.; 23 requiring persons that participate in the campaign to 24 register annually with the department; creating s. 25 CS/CS/HB 561 2025 CODING: Words stricken are deletions; words underlined are additions. hb561-02-c2 Page 2 of 6 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S 288.1036, F.S.; authorizing th e department to adopt 26 rules; authorizing the department to establish, by 27 rule, the logos or product identifiers to be depicted 28 for use in the campaign; providing an effective date. 29 30 Be It Enacted by the Legislature of the State of Florida: 31 32 Section 1. Paragraph (m) is added to subsection (4) of 33 section 20.60, Florida Statutes, to read: 34 20.60 Department of Commerce; creation; powers and 35 duties.— 36 (4) The purpose of the department is to assist the 37 Governor in working with the Legislature, state a gencies, 38 business leaders, and economic development professionals to 39 formulate and implement coherent and consistent policies and 40 strategies designed to promote economic opportunities for all 41 Floridians. The department is the state's chief agency for 42 business recruitment and expansion and economic development. To 43 accomplish such purposes, the department shall: 44 (m) Encourage and oversee manufacturing in this state in 45 coordination with the Chief Manufacturing Officer. 46 Section 2. Section 20.6051, Florida Statutes, is created 47 to read: 48 20.6051 Chief Manufacturing Officer. — 49 (1) There shall be designated among the senior leadership 50 CS/CS/HB 561 2025 CODING: Words stricken are deletions; words underlined are additions. hb561-02-c2 Page 3 of 6 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S of the Department of Commerce a Chief Manufacturing Officer for 51 the purpose of supporting the manufacturing ecosystem statewi de. 52 The Chief Manufacturing Officer is appointed by and serves at 53 the pleasure of the Secretary of Commerce. 54 (2) The Chief Manufacturing Officer shall: 55 (a) Serve as a subject -matter expert for the state on 56 issues related to manufacturing. 57 (b) Be responsible for promoting and coordinating 58 manufacturing efforts in this state and identifying gaps across 59 state-supported activities. 60 (c) Provide strategic direction for interagency and cross -61 disciplinary initiatives to promote and support manufacturing in 62 this state. 63 (d) Work with federal, state, regional, and local 64 governmental entities and nongovernmental entities to align 65 manufacturing priorities in this state. 66 (e) Engage with state agencies and water management 67 districts to innovate processes, programs, decision frameworks, 68 and reporting mechanisms intended to support manufacturing in 69 this state. 70 (3) All state and local governmental entities shall assist 71 the Chief Manufacturing Officer to the extent such assistance is 72 consistent with law and w ith budgetary constraints. 73 (4) The department shall prepare a report, in consultation 74 with the Chief Manufacturing Officer and the state Manufacturing 75 CS/CS/HB 561 2025 CODING: Words stricken are deletions; words underlined are additions. hb561-02-c2 Page 4 of 6 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S Extension Partnership, regarding manufacturing efforts in this 76 state. The department shall submit the r eport to the Governor, 77 the President of the Senate, and the Speaker of the House of 78 Representatives by December 15, 2026, and every 2 years 79 thereafter. The report must include information regarding the 80 strength and economic importance of the manufacturing industry 81 in this state. 82 Section 3. Section 288.1031, Florida Statutes, is created 83 to read: 84 288.1031 Legislative findings. —The Legislature finds that 85 there is a need for the Florida Manufacturing Promotional 86 Campaign, established in s. 288.1033, to in crease consumer 87 awareness of manufacturing activities in this state, to expand 88 market exposure for manufactured products and goods in this 89 state, and to inspire future generations of entrepreneurs, 90 fabricators, and skilled workers to build and grow domesti c 91 businesses and manufacturing operations in this state. The 92 Legislature further finds that a campaign that creates a 93 partnership between industry and this state is necessary to 94 promote and advertise such products efficiently. 95 Section 4. Section 288.10 32, Florida Statutes, is created 96 to read: 97 288.1032 Definitions. —As used in ss. 288.1031 -288.1036, 98 the term: 99 (1) "Campaign" means the Florida Manufacturing Promotional 100 CS/CS/HB 561 2025 CODING: Words stricken are deletions; words underlined are additions. hb561-02-c2 Page 5 of 6 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S Campaign. 101 (2) "Department" means the Department of Commerce. 102 (3) "Manufactured pr oduct" means any tangible personal 103 property that has been fabricated or produced, often through 104 industrial or mechanical processes. The term includes items sold 105 or leased to consumers. 106 (4) "Person" means an individual, a firm, a partnership, a 107 corporation, an association, a business, a trust, a legal 108 representative, or any other business unit. 109 Section 5. Section 288.1033, Florida Statutes, is created 110 to read: 111 288.1033 Florida Manufacturing Promotional Campaign; 112 purpose; duties of the department. —There is created within the 113 department, under the supervision of the Chief Manufacturing 114 Officer and in coordination with the state Manufacturing 115 Extension Partnership, the Florida Manufacturing Promotional 116 Campaign. The purpose of the campaign is to serve as a voluntary 117 marketing program to promote manufacturing products and 118 businesses in this state. In promoting the campaign, the 119 department shall do all of the following: 120 (1) Develop logos for the campaign and authorize the use 121 of such logos as provided by rule. 122 (2) Register campaign participants. 123 (3) Collect rental receipts for industry promotions. 124 (4) Develop in-kind advertising programs. 125 CS/CS/HB 561 2025 CODING: Words stricken are deletions; words underlined are additions. hb561-02-c2 Page 6 of 6 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (5) Contract with media representatives for the purpose of 126 dispersing promotional materials. 127 Section 6. Section 288.1034, Florida Statutes, is created 128 to read: 129 288.1034 Registration. —A person that participates in the 130 Florida Manufacturing Promotional Campaign must register 131 annually with the department in a form and manner as prescribed 132 by the department. 133 Section 7. Section 288.1036, Florida Statutes, is created 134 to read: 135 288.1036 Rulemaking authority. —The department may adopt 136 rules to implement and administer the Florida Manufacturing 137 Promotional Campaign. By rule, the department may establish the 138 logos or product identifiers to be depicted for use in the 139 campaign for advertising, publicizing, and promoting the sale of 140 manufactured products in this state. The department may also 141 adopt any other rules deemed necessary to ensure compliance with 142 the Florida Manufacturing Promotional Campaign, including, but 143 not limited to, rules governing participant registration, 144 renewal of registration, classes of membership, application 145 forms, and other forms and enforcement measures. 146 Section 8. This act shall take effe ct July 1, 2025. 147
