3131 Section 1. Paragraph (b) of subsection (2) and subsections 18
3232 (3) and (7) of section 581.217, Florida Statutes, are amended to 19

3535 (2) LEGISLATIVE FINDINGS. —The Legislature finds that: 22
3636 (b) Hemp and hemp extract Hemp-derived cannabinoids, 23
3737 including, but not limited to, cannabidiol, are not controlled 24
3838 substances or adulterants if they are in compliance with this 25

5252 (3) DEFINITIONS.—As used in this section, the term: 27
5353 (a) "Attractive to children" means manufactured in the 28
5454 shape of or packaged in containers displaying humans, cartoons, 29
5555 or animals, toys, or other features that appeal to children ; 30
5656 manufactured in a form or packaged in a container that bears any 31
5757 reasonable resemblance to an existing candy or snack product 32
5858 that is familiar to children; manufactured in a form or packaged 33
5959 in a container that bears any reasonable resemblance to a the 34

6464 (b) "Certifying agency" has the same meaning as in s. 39
6565 578.011(8). 40
6666 (c) "Contaminants unsafe for human consumption" includes, 41
6767 but is not limited to, any microbe, fungus, yeast, mildew, 42
6868 herbicide, pesticide, fungicide, residual solvent, metal, or 43
6969 other contaminant found in any amount that exceeds any of the 44
7070 accepted limitations as determined by rules adopted by the 45
7171 Department of Health in accordance with s. 381.986, or other 46
7272 limitation pursuant to the laws of this state, whichever amount 47
7373 is less. 48
7474 (d) "Convenience business" means any place of business 49

101101 (h)(e) "Hemp" means the plant Cannabis sativa L. and any 64
102102 part of that plant, including the seeds thereof, and all 65
103103 derivatives, extracts, cannabinoids, isomers, acids, salts, and 66
104104 salts of isomers thereof, whether growing or not, that has a 67
105105 total delta-9-tetrahydrocannabinol concentration that does not 68
106106 exceed 0.3 percent on a dry -weight basis, with the exception of 69
107107 hemp extract, which may not exceed : 70
108108 1. Zero point 3 0.3 percent total delta-9-71
109109 tetrahydrocannabinol concentration on a wet-weight basis; 72
110110 2. Twenty-five milligrams per serving or 500 milligrams 73
111111 per container on a dry -weight basis for edible products; or 74

126126 (i)(f) "Hemp extract" means a s ubstance or compound 77
127127 intended for ingestion, containing more than trace amounts of a 78
128128 cannabinoid, or for inhalation which is derived from or contains 79
129129 hemp and which does not contain controlled substances. The term 80
130130 does not include synthetic cannabidiol or seeds or seed-derived 81
131131 ingredients that are generally recognized as safe by the United 82
132132 States Food and Drug Administration. 83
133133 (j)(g) "Independent testing laboratory" means a laboratory 84
134134 that: 85
135135 1. Does not have a direct or indirect interest in the 86
136136 entity whose product is being tested; 87
137137 2. Does not have a direct or indirect interest in a 88
138138 facility that cultivates, processes, distributes, dispenses, or 89
139139 sells hemp or hemp extract in the state or in another 90
140140 jurisdiction or cultivates, processes, distributes, disp enses, 91
141141 or sells marijuana, as defined in s. 381.986; and 92
142142 3. Is accredited by a third -party accrediting body as a 93
143143 competent testing laboratory pursuant to ISO/IEC 17025 of the 94
144144 International Organization for Standardization. 95
145145 (k) "Retail establishment" me ans a place of business 96
146146 licensed to sell hemp extract products which is open to the 97
147147 public for the sale of goods or services. 98
148148 (l) "Safe harbor hemp extract product" means a finished 99
149149 hemp extract product or a hemp extract product in the process of 100

166166 (7) MANUFACTURE, DELIVERY, HOLD, OFFER F OR SALE, 105
167167 DISTRIBUTION, AND RETAIL SALE OF HEMP EXTRACT PRODUCTS.— 106
168168 (a) Hemp extract products may only be sold at retail to a 107
169169 person 21 years of age or older. A person who violates this 108
170170 paragraph commits a misdemeanor of the second degree, punishable 109
171171 as provided in s. 775.082 or s. 775.083. A person who commits a 110
172172 second or subsequent violation of this paragraph within 1 year 111
173173 after an initial violation commits a misdemeanor of the first 112
174174 degree, punishable as provided in s. 775.082 or s. 775.083. 113
175175 (b)(a) Hemp extract may only be distributed , offered for 114
176176 retail sale, and sold at retail in this the state if the 115
177177 product: 116
178178 1. Has a certificate of analysis prepared by an 117
179179 independent testing laboratory which that states: 118
180180 a. The hemp extract is the product of a b atch tested by 119
181181 the independent testing laboratory; 120
182182 b. The batch contained a total delta -9-121
183183 tetrahydrocannabinol concentration that did not exceed 0.3 122
184184 percent pursuant to the testing of a random sample of the batch , 123
185185 or if the batch is sold at retail, the b atch meets the total 124

211211 health benefits of the product unless e xpressly authorized by 138
212212 the United States Food and Drug Administration and in a 139

214214 a. A scannable barcode or quick response code linked to 141
215215 the certificate of analysis of the hemp extract batch by an 142
216216 independent testing laboratory; 143

218218 c. The Internet address of a website where batch 145

221221 e. The number of milligrams of each marketed cannabinoid 148

278278 (e) A convenience business may only sell hemp extract 181

280280 (f) Hemp extract products must be placed in an exit 183
281281 package at the point of sale. 184
282282 (g)(b) Hemp extract may only be sold to a business in this 185
283283 state if that business is properly permitted as required by this 186
284284 section. 187
285285 (h)(c) Hemp extract distributed or s old in this state is 188
286286 subject to the applicable requirements of chapter 500, chapter 189
287287 502, or chapter 580. 190
288288 (i) Manufacturers, distributors, and retailers of hemp 191
289289 extract products shall maintain a readily accessible written or 192
290290 electronic record of all hemp extract products in their 193
291291 inventory for 3 years after the product is sold or otherwise 194
292292 disposed of. The record must contain the name of the product, 195
293293 the manufacturer of the product, the third -party laboratory test 196
294294 for the product, the date the product was placed in inventory, 197
295295 the date the product was removed from inventory, and the current 198
296296 disposition of the product. 199

311311 2. Safe harbor hemp extract products in c ompliance with 202
312312 this section must be physically segregated from other products, 203
313313 including hemp extract products, by a manufacturer or storage 204

315315 (d) Products that are intended for human ingestion or 206
316316 inhalation and that contain hemp extract, includi ng, but not 207
317317 limited to, snuff, chewing gum, and other smokeless products, 208
318318 may not be sold in this state to a person who is under 21 years 209
319319 of age. A person who violates this paragraph commits a 210
320320 misdemeanor of the second degree, punishable as provided in s. 211
321321 775.082 or s. 775.083. A person who commits a second or 212
322322 subsequent violation of this paragraph within 1 year after the 213
323323 initial violation commits a misdemeanor of the first degree, 214
324324 punishable as provided in s. 775.082 or s. 775.083. 215
325325 (k)(e) Hemp extract possessed, manufactured, delivered, 216
326326 held, offered for sale, distributed, or sold in violation of 217
327327 this subsection is subject to s. 500.172 and penalties as 218
328328 provided in s. 500.121. Hemp extract products found to be 219
329329 mislabeled or attractive to children are subj ect to an immediate 220
330330 stop-sale order. The department may not grant permission to 221
331331 remove or use, except for disposal, hemp extract products 222
332332 subject to a stop-sale order which are attractive to children 223
333333 until the department determines that the hemp extract pr oducts 224

347347 Section 2. (1) For the 2025-2026 fiscal year, the sum of 226
348348 $2 million in nonrecurring funds is appropriated from the 227
349349 General Revenue Fund to the Department of Law Enforcement for 228
350350 the purchase of testing equipment necessary to implement this 229

352352 (2) For the 2025-2026 fiscal year, the sum of $25 million 231
353353 in nonrecurring funds is appropriated from the General Revenue 232
354354 Fund to the Department of Legal Affairs for the investigation of 233
355355 hemp and hemp extract products manufactured i n a foreign country 234
356356 of concern as defined in s. 692.201, Florida Statutes, and 235
357357 imported into this state. 236
358358 Section 3. This act shall take effect October 1, 2025. 237
