131131 Section 4. Paragraph (g) of subsection (3) and subsection 82

134134 (3) RIGHT TO FREE-SPEECH ACTIVITIES.— 85
135135 (g) Notwithstanding s. 934.03 and subject to the 86
136136 protections provided in the Family Educational Rights and 87
137137 Privacy Act of 1974, 20 U.S.C. s. 1232g, and ss. 1002.22 and 88
138138 1002.225, a student may record video or audio of class lectures 89
139139 for his or her own personal educational use, in connection with 90
140140 a complaint to the public institution of higher education where 91
141141 the recording was made, or as evidence in, or in preparation 92
142142 for, a criminal or civil proceeding. A recorded l ecture may not 93
143143 be published without the consent of the lecturer. 94
144144 (4) CAUSE OF ACTION. —A person injured by a violation of 95
145145 this section may bring an action : 96
146146 (a) against a public institution of higher education based 97
147147 on the violation of the individual's e xpressive rights in a 98
148148 court of competent jurisdiction to obtain declaratory and 99
149149 injunctive relief and may be entitled to damages plus court 100

164164 (b) Against a person who has publi shed video or audio 103
165165 recorded in a classroom in violation of paragraph (3)(g) in a 104
166166 court of competent jurisdiction to obtain declaratory and 105
167167 injunctive relief and may be entitled to damages plus court 106
168168 costs and reasonable attorney fees, with the total recov ery not 107
169169 to exceed $200,000. 108
170170 Section 5. Section 1012.802, Florida Statutes, is created 109
171171 to read: 110
172172 1012.802 Faculty assignments at public postsecondary 111
173173 education institutions. — 112
174174 (1) Each faculty member at a state university or Florida 113
175175 College System institution shall, at his or her discretion, 114
176176 negotiate his or her annual assignments with his or her 115
177177 department chair and academic officers. To maintain the 116
178178 professional autonomy of faculty members, the negotiation 117
179179 process must be free from interference by th e state university's 118
180180 or Florida College System institution's board of trustees or any 119
181181 other governing body. 120
182182 (2) The Board of Governors and the State Board of 121
183183 Education may adopt regulations and rules, respectively, to 122
184184 administer this section. 123
185185 Section 6. This act shall take effect July 1, 2025. 124
