HB 611 2025 CODING: Words stricken are deletions; words underlined are additions. hb611-00 Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to artificial food dyes in K-12 2 schools; providing legislative findings; creating s. 3 595.411, F.S.; prohibiting the use of specified dyes 4 in foods for certain K-12 food programs; amending s. 5 1001.42, F.S.; requiring district school boards to 6 adopt a policy prohibiting the use of specified food 7 dyes in foods for certain food programs and vending 8 machines; providing exemptions from such prohibiti on; 9 providing an effective date. 10 11 WHEREAS, the Legislature finds that synthetic food dyes 12 have been linked to behavioral problems in children, potentially 13 leading to diminished learning environments in schools, and 14 WHEREAS, the Legislature further fi nds that parents lose 15 control over their children's nutrition once their children 16 enter school, having access to food dyes that may not be 17 available at home, NOW, THEREFORE, 18 Be It Enacted by the Legislature of the State of Florida: 19 20 Section 1. Section 595.411, Florida Statutes, is created 21 to read: 22 595.411 Artificial dye prohibited. —Notwithstanding any 23 other law to the contrary, any foods served in a program or the 24 school breakfast program may not contain the following: 25 HB 611 2025 CODING: Words stricken are deletions; words underlined are additions. hb611-00 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (1) Allura Red AC, also know n as red 40. 26 (2) Tartrazine, also known as yellow 5. 27 (3) Sunset yellow FCF, also known as yellow 6. 28 (4) Brilliant blue FCF, also known as blue 1. 29 (5) Indigo carmine, also known as blue 2. 30 (6) Fast Green FCF, also known as green 3. 31 Section 2. Subsection (30) is added to section 1001.42, 32 Florida Statutes, to read: 33 1001.42 Powers and duties of district school board. —The 34 district school board, acting as a board, shall exercise all 35 powers and perform all duties listed below: 36 (30) PROHIBIT FOOD DYES ON SCHOOL CAMPUSES. — 37 (a) Adopt a policy prohibiting the use of the food dyes 38 listed in paragraph (b) in: 39 1. Vending machines located on school campuses within the 40 district if such vending machines are available to students 1 41 hour before the start of the school day through the school day. 42 2. Pursuant to s. 595.411, the National School Lunch 43 Program, the Special Milk Program, the School Breakfast Program, 44 the Summer Food Service Program, and any other school food and 45 nutrition service programs unde r the authority of the Department 46 of Agriculture and Consumer Services. 47 (b) The use of the following dyes are prohibited in the 48 programs and vending machines listed in paragraph (a): 49 1. Fast Green FCF, also known as green 3. 55 (c) The policy adopted pursuant to paragraph (a) does not 56 apply to food that is: 57 1. Available for sale or offered on a school campus 58 outside of school hours, including at interscholastic and 59 intrascholastic extracurricular student activities. 60 2. At classroom parties or events. 61 3. For sale through another orga nization, including 62 parent-teacher associations and organizations. 63 Section 3. This act shall take effect July 1, 2025. 64
