17	17	595.411, F.S.; prohibiting the use of specified dyes 4
18	18	in foods for certain K-12 food programs; amending s. 5
19	19	1001.42, F.S.; requiring district school boards to 6
20	20	adopt a policy prohibiting the use of specified food 7
21	21	dyes in foods for certain food programs and vending 8
22	22	machines; providing exemptions from such prohibiti on; 9
23	23	providing an effective date. 10

25	25	WHEREAS, the Legislature finds that synthetic food dyes 12
26	26	have been linked to behavioral problems in children, potentially 13
27	27	leading to diminished learning environments in schools, and 14
28	28	WHEREAS, the Legislature further fi nds that parents lose 15
29	29	control over their children's nutrition once their children 16
30	30	enter school, having access to food dyes that may not be 17
31	31	available at home, NOW, THEREFORE, 18
32	32	Be It Enacted by the Legislature of the State of Florida: 19

34	34	Section 1. Section 595.411, Florida Statutes, is created 21
35	35	to read: 22
36	36	595.411 Artificial dye prohibited. —Notwithstanding any 23
37	37	other law to the contrary, any foods served in a program or the 24
38	38	school breakfast program may not contain the following: 25

57	57	Section 2. Subsection (30) is added to section 1001.42, 32

59	59	1001.42 Powers and duties of district school board. —The 34
60	60	district school board, acting as a board, shall exercise all 35
61	61	powers and perform all duties listed below: 36
62	62	(30) PROHIBIT FOOD DYES ON SCHOOL CAMPUSES. — 37
63	63	(a) Adopt a policy prohibiting the use of the food dyes 38
64	64	listed in paragraph (b) in: 39
65	65	1. Vending machines located on school campuses within the 40
66	66	district if such vending machines are available to students 1 41
67	67	hour before the start of the school day through the school day. 42
68	68	2. Pursuant to s. 595.411, the National School Lunch 43
69	69	Program, the Special Milk Program, the School Breakfast Program, 44
70	70	the Summer Food Service Program, and any other school food and 45
71	71	nutrition service programs unde r the authority of the Department 46
72	72	of Agriculture and Consumer Services. 47
73	73	(b) The use of the following dyes are prohibited in the 48
74	74	programs and vending machines listed in paragraph (a): 49

97	97	intrascholastic extracurricular student activities. 60
98	98	2. At classroom parties or events. 61
99	99	3. For sale through another orga nization, including 62
100	100	parent-teacher associations and organizations. 63
101	101	Section 3. This act shall take effect July 1, 2025. 64
