2424 Be It Enacted by the Legislature of the St ate of Florida: 11

2626 Section 1. Subsection (7) of section 379.354, Florida 13
2727 Statutes, is amended to read: 14
2828 379.354 Recreational licenses, permits, and authorization 15
2929 numbers; fees established. — 16
3030 (7) VESSEL LICENSES. — 17
3131 (a) Except as provided in paragraph ( f), a person may not 18
3232 operate any vessel wherein a fee is paid, either directly or 19
3333 indirectly, for the purpose of taking, attempting to take, or 20
3434 possessing any saltwater or freshwater fish for noncommercial 21
3535 purposes unless she or he has obtained a license f or each vessel 22
3636 for that purpose, and has paid the license fee pursuant to 23
3737 paragraphs (b) and (c) for such vessel. 24

5151 licensed to carry more than 10 customers, wherein a fee is paid, 26
5252 either directly or ind irectly, for the purpose of taking or 27
5353 attempting to take saltwater or freshwater fish, is $800 per 28
5454 year. The license must be kept aboard the vessel at all times. 29
5555 (c)1. A license for any person who operates any vessel 30
5656 licensed to carry no more than 10 cus tomers, or for any person 31
5757 licensed to operate any vessel carrying 6 or fewer customers, 32
5858 wherein a fee is paid, either directly or indirectly, for the 33
5959 purpose of taking or attempting to take saltwater or freshwater 34
6060 fish, is $400 per year. 35
6161 2. A license for any person licensed to operate any vessel 36
6262 carrying 6 or fewer customers but who operates a vessel carrying 37
6363 4 or fewer customers, wherein a fee is paid, either directly or 38
6464 indirectly, for the purpose of taking or attempting to take 39
6565 saltwater or freshwater fish, is $200 per year. The license must 40
6666 be kept aboard the vessel at all times. 41
6767 3. A person who operates a vessel required to be licensed 42
6868 pursuant to paragraph (b) or this paragraph may obtain a license 43
6969 in her or his own name, and such license shall be transferable 44
7070 and apply to any vessel operated by the purchaser, provided that 45
7171 the purchaser has paid the appropriate license fee. 46
7272 (d) A license for a recreational vessel not for hire and 47
7373 for which no fee is paid, either directly or indirectly, by 48
7474 guests for the purpose of taking or attempting to take saltwater 49
7575 or freshwater fish noncommercially is $2,000 per year. The 50

8888 license may be purchased at the option of the vessel owner and 51
8989 must be kept aboard the vessel at all times. A log of species 52
9090 taken and the date the species were taken shall be maintained 53
9191 and a copy of the log filed with the commission at the time of 54
9292 renewal of the license. 55
9393 (e) The owner, operator, or custodian of a vessel the 56
9494 operator of which has been licensed pursuant to paragraph (a) 57
9595 must maintain and report such statistical data as required by, 58
9696 and in a manner set forth in, the rules of the commission. 59
9797 (f) If the operator of a vessel that carries scuba divers 60
9898 for a fee, either directly or indirectly, maintains the 61
9999 appropriate vessel li cense under this subsection based upon the 62
100100 number of persons the vessel is licensed to carry and the 63
101101 applicable permits, the individual scuba divers engaging in 64
102102 taking or attempting to take saltwater or freshwater products 65
103103 are not required to obtain indivi dual fishing licenses or any 66
104104 applicable permits. However, if the operator of such a vessel 67
105105 does not have the appropriate license and applicable permits, 68
106106 the individual scuba divers engaging in taking or attempting to 69
107107 take saltwater or freshwater products must have individual 70
108108 fishing licenses and any applicable permits. 71
109109 Section 2. Paragraph (b) of subsection (8) of section 72
110110 212.06, Florida Statutes, is amended to read: 73

127127 (b) The presumption that tangible personal property used 78
128128 in another state, territory of the Unit ed States, or the 79
129129 District of Columbia for 6 months or longer before being 80
130130 imported into this state was not purchased for use in this state 81

132132 fishing license fee is required to be paid pursuant t o s. 83

136136 and be due on such a boat as provided in this paragraph, and 87
137137 proof of payment of such tax must be presented before prior to 88
138138 the first such licensure of the boat, registration of the boat 89
139139 pursuant to chapter 328, and titling of the boat pursuant to 90
140140 chapter 328. A boat that is first licensed within 1 year after 91
141141 purchase shall be subject to use tax on the full amount of the 92
142142 purchase price; a boat that is first licensed in the second year 93
143143 after purchase shall be subject to use tax on 90 percent of the 94
144144 purchase price; a boat that is first licensed in the third year 95
145145 after purchase shall be subject to use tax on 80 percent of the 96
146146 purchase price; a boat that is first licensed in the fourth year 97
147147 after purchase shall be subject to use tax on 70 percent of the 98
148148 purchase price; a boat that is first licensed in the fifth year 99

163163 year after purchase, or later, shall be subject to use tax on 50 102
164164 percent of the purchase price. If the purchaser fails to provide 103
165165 the purchase invoice on such boat, the fair market value of the 104
166166 boat at the time of importation into this state shall be used to 105

168168 Section 3. Paragraphs (i) and (j) of subsection (2) of 107
169169 section 379.353, Florida Statutes, are amended to read: 108

172172 (2) A hunting, freshwater fishing, or saltwater fishing 111
173173 license or permit is not required for: 112
174174 (i) Any person saltwater or freshwater fishing from a 113
175175 vessel licensed pursua nt to s. 379.354(7). 114
176176 (j) Any person saltwater or freshwater fishing from a 115
177177 vessel the operator of which is licensed pursuant to s. 116

179179 Section 4. This act shall take effect July 1, 2025. 118
