24	24	Be It Enacted by the Legislature of the St ate of Florida: 11

26	26	Section 1. Subsection (7) of section 379.354, Florida 13
27	27	Statutes, is amended to read: 14
28	28	379.354 Recreational licenses, permits, and authorization 15
29	29	numbers; fees established. — 16
30	30	(7) VESSEL LICENSES. — 17
31	31	(a) Except as provided in paragraph ( f), a person may not 18
32	32	operate any vessel wherein a fee is paid, either directly or 19
33	33	indirectly, for the purpose of taking, attempting to take, or 20
34	34	possessing any saltwater or freshwater fish for noncommercial 21
35	35	purposes unless she or he has obtained a license f or each vessel 22
36	36	for that purpose, and has paid the license fee pursuant to 23
37	37	paragraphs (b) and (c) for such vessel. 24

51	51	licensed to carry more than 10 customers, wherein a fee is paid, 26
52	52	either directly or ind irectly, for the purpose of taking or 27
53	53	attempting to take saltwater or freshwater fish, is $800 per 28
54	54	year. The license must be kept aboard the vessel at all times. 29
55	55	(c)1. A license for any person who operates any vessel 30
56	56	licensed to carry no more than 10 cus tomers, or for any person 31
57	57	licensed to operate any vessel carrying 6 or fewer customers, 32
58	58	wherein a fee is paid, either directly or indirectly, for the 33
59	59	purpose of taking or attempting to take saltwater or freshwater 34
60	60	fish, is $400 per year. 35
61	61	2. A license for any person licensed to operate any vessel 36
62	62	carrying 6 or fewer customers but who operates a vessel carrying 37
63	63	4 or fewer customers, wherein a fee is paid, either directly or 38
64	64	indirectly, for the purpose of taking or attempting to take 39
65	65	saltwater or freshwater fish, is $200 per year. The license must 40
66	66	be kept aboard the vessel at all times. 41
67	67	3. A person who operates a vessel required to be licensed 42
68	68	pursuant to paragraph (b) or this paragraph may obtain a license 43
69	69	in her or his own name, and such license shall be transferable 44
70	70	and apply to any vessel operated by the purchaser, provided that 45
71	71	the purchaser has paid the appropriate license fee. 46
72	72	(d) A license for a recreational vessel not for hire and 47
73	73	for which no fee is paid, either directly or indirectly, by 48
74	74	guests for the purpose of taking or attempting to take saltwater 49
75	75	or freshwater fish noncommercially is $2,000 per year. The 50

88	88	license may be purchased at the option of the vessel owner and 51
89	89	must be kept aboard the vessel at all times. A log of species 52
90	90	taken and the date the species were taken shall be maintained 53
91	91	and a copy of the log filed with the commission at the time of 54
92	92	renewal of the license. 55
93	93	(e) The owner, operator, or custodian of a vessel the 56
94	94	operator of which has been licensed pursuant to paragraph (a) 57
95	95	must maintain and report such statistical data as required by, 58
96	96	and in a manner set forth in, the rules of the commission. 59
97	97	(f) If the operator of a vessel that carries scuba divers 60
98	98	for a fee, either directly or indirectly, maintains the 61
99	99	appropriate vessel li cense under this subsection based upon the 62
100	100	number of persons the vessel is licensed to carry and the 63
101	101	applicable permits, the individual scuba divers engaging in 64
102	102	taking or attempting to take saltwater or freshwater products 65
103	103	are not required to obtain indivi dual fishing licenses or any 66
104	104	applicable permits. However, if the operator of such a vessel 67
105	105	does not have the appropriate license and applicable permits, 68
106	106	the individual scuba divers engaging in taking or attempting to 69
107	107	take saltwater or freshwater products must have individual 70
108	108	fishing licenses and any applicable permits. 71
109	109	Section 2. Paragraph (b) of subsection (8) of section 72
110	110	212.06, Florida Statutes, is amended to read: 73
111	111	212.06 Sales, storage, use tax; collectible from dealers; 74

127	127	(b) The presumption that tangible personal property used 78
128	128	in another state, territory of the Unit ed States, or the 79
129	129	District of Columbia for 6 months or longer before being 80
130	130	imported into this state was not purchased for use in this state 81
131	131	does not apply to any boat for which a saltwater or freshwater 82
132	132	fishing license fee is required to be paid pursuant t o s. 83
133	133	379.354(7), either directly or indirectly, for the purpose of 84
134	134	taking, attempting to take, or possessing any saltwater or 85
135	135	freshwater fish for noncommercial purposes. Use tax shall apply 86
136	136	and be due on such a boat as provided in this paragraph, and 87
137	137	proof of payment of such tax must be presented before prior to 88
138	138	the first such licensure of the boat, registration of the boat 89
139	139	pursuant to chapter 328, and titling of the boat pursuant to 90
140	140	chapter 328. A boat that is first licensed within 1 year after 91
141	141	purchase shall be subject to use tax on the full amount of the 92
142	142	purchase price; a boat that is first licensed in the second year 93
143	143	after purchase shall be subject to use tax on 90 percent of the 94
144	144	purchase price; a boat that is first licensed in the third year 95
145	145	after purchase shall be subject to use tax on 80 percent of the 96
146	146	purchase price; a boat that is first licensed in the fourth year 97
147	147	after purchase shall be subject to use tax on 70 percent of the 98
148	148	purchase price; a boat that is first licensed in the fifth year 99
149	149	after purchase shall be subject to use tax on 60 percent of the 100

162	162	purchase price; and a boat that is first licensed in the sixth 101
163	163	year after purchase, or later, shall be subject to use tax on 50 102
164	164	percent of the purchase price. If the purchaser fails to provide 103
165	165	the purchase invoice on such boat, the fair market value of the 104
166	166	boat at the time of importation into this state shall be used to 105
167	167	compute the tax. 106
168	168	Section 3. Paragraphs (i) and (j) of subsection (2) of 107
169	169	section 379.353, Florida Statutes, are amended to read: 108
170	170	379.353 Recreational licenses and permits; exemptions from 109
171	171	fees and requirements. — 110
172	172	(2) A hunting, freshwater fishing, or saltwater fishing 111
173	173	license or permit is not required for: 112
174	174	(i) Any person saltwater or freshwater fishing from a 113
175	175	vessel licensed pursua nt to s. 379.354(7). 114
176	176	(j) Any person saltwater or freshwater fishing from a 115
177	177	vessel the operator of which is licensed pursuant to s. 116
178	178	379.354(7). 117
179	179	Section 4. This act shall take effect July 1, 2025. 118
