32- Section 1. Subsection (7) is added to section 110.12303, 19
33-Florida Statutes to read: 20
34- 110.12303 State group insurance program; additional 21
35-benefits; price transparency progra m; reporting.— 22
36- (7)(a) For state group health insurance plan policies 23
37-issued on or after January 1, 2026, the department shall provide 24
38-coverage of medically necessary expenses relating to standard 25
18+of Management Services under the state group insurance 5
19+program to provide coverage of medically necessary 6
20+expenses relating to standard fertility preservation 7
21+services for specified policies under certain 8
22+circumstances; prohibiting state -contracted health 9
23+maintenance organizations and state group health 10
24+insurance plans from requiring preauthorization for 11
25+such services; authorizing maximum benefit provisions 12
26+under specified circumstances; providing definitions; 13

35+ (7)(a) For a state-contracted HMO or state group health 22
36+insurance plan policy issued or renewed on or after January 1, 23
37+2026, the department shall provide coverage of medically 24
38+necessary expenses relating to standard fertility preservation 25

51-fertility retrieval and preservation services when cancer 26
52-treatments may directly or indirectly cause iatrogenic 27
53-infertility. 28
54- (b) Coverage of standard fertility retrieval and 29
55-preservation services under this subsection includes the costs 30
56-associated with retrieving and preserving sperm and oocyte 31
57-materials which are consistent with nationally recognized 32
58-clinical practice guidelines and definitions. Coverage of 33
59-retrieval and storage expires after a period of 3 years after 34
60-the date of the procedures presenting a risk of iatrogenic 35
61-infertility or when the individual is no longer covered under 36
62-the state group health insurance plan, whichever occurs first. 37
63- (c) A state group health insurance plan may not require 38
64-preauthorization for coverage of standard fertility retrieval 39
65-and preservation services; however, a state g roup health 40
66-insurance plan policy may contain provisions for maximum 41
67-benefits and may subject the covered service to the same 42
68-deductible, copayment, and coinsurance. 43

52+ 1. Has been diagnosed with cancer and the necessary cancer 27
53+treatment may directly or indirectly cause iatrogenic 28
54+infertility; and 29
55+ 2. Is within reproductive age. 30
56+ (b) Coverage of standard fertility preservation services 31
57+under paragraph (a) includes t he costs associated with the 32
58+storage of eggs and sperm for a period not to exceed 3 years. 33
59+ (c) A state-contracted HMO or state group health insurance 34
60+plan may not require preauthorization for coverage of standard 35
61+fertility preservation services. However, a state-contracted HMO 36
62+or state group health insurance plan policy may contain maximum 37
63+benefit provisions which may subject a covered standard 38
64+fertility preservation service to a deductible, copayment, 39
65+coinsurance, or reasonable limitations and exclusions , to the 40
66+extent the deductible, copayment, coinsurance, limitations, or 41
67+exclusions are not inconsistent with the maximum benefit 42
68+provisions. 43
6969 (d) As used in this subsection, the term: 44
7070 1. "Iatrogenic infertility" means an impairment of 45
7171 fertility caused directly or indirectly by surgery, 46
72-chemotherapy, radiation, or other associated medically necessary 47
73-treatment with a potential side effect of impaired fertility as 48
74-established by the American Society for Clinical Oncology. 49
75- 2. "Nationally recognized clinical practice guidelines and 50
72+chemotherapy, radiation, or other medical treatment that has a 47
73+potential side effect of impaired fertility as established by 48
74+the American Society of Clinical Oncology or the American 49
75+Society for Reproductive Medicine. 50

88-definitions" mean evidence -based clinical practice guidelines 51
89-developed by independent organizations or medical professional 52
90-societies using a transparent methodology and reporting 53
91-structure and with a co nflict-of-interest policy, and 54
92-definitions used or established in such guidelines. Guidelines 55
93-developed by such organizations or societies must establish 56
94-standards of care informed by a systematic review of evidence 57
95-and an assessment of the benefits and co sts of alternative care 58
96-options and include recommendations intended to optimize patient 59
97-care. 60
98- 3. "Standard fertility retrieval and preservation 61
99-services" means oocyte and sperm retrieval and preservation 62
100-procedures and storage, including ovarian tissue, sperm, and 63
101-oocyte retrieval and cryopreservation, which are consistent with 64
102-nationally recognized clinical practice guidelines and 65
103-definitions. 66
104- Section 2. This act shall take effect July 1, 2025. 67
88+ 2. "Reproductive age" means the age range in which an 51
89+individual is deemed fertile as established by the American 52
90+Society of Clinical Oncology or the American Society for 53
91+Reproductive Medicine. 54
92+ 3.a. "Standard fertility preservation services" means 55
93+procedures that are: 56
94+ (I) Consistent with established medical practices or 57
95+professional guidelines published by the American Society of 58
96+Clinical Oncology or the American Society for Reproductive 59
97+Medicine; and 60
98+ (II) Used to preserve a person's fertility and ability to 61
99+have children. 62
100+ b. The term includes, but is not limited to, procedures 63
101+for the preservation of eggs, sperm, and ovarian tissues. 64
102+ Section 2. This act shall take effect July 1, 2025. 65
