The act may be cited as "Trenton's Law." 21 Section 2. Damage to the property or person of another commits a 28 misdemeanor of the first degree, punishable as provided in s. 29 775.082 or s. 775.083. 30 2. Serious bodily injury to another, as defined in s. 31 316.1933, commits a felony of the third degree, punishable as 32 provided in s. 775.082 , s. 775.083, or s. 775.084. 33 3. The death of any human being or unborn child commits 34 DUI manslaughter, and commits: 35 a. A felony of the second degree, punishable as provided 36 in s. 775.082, s. 775.083, or s. 775.084. 37 b. A felony of the first degree, pu nishable as provided in 38 s. 775.082, s. 775.083, or s. 775.084, if: 39 (I) At the time of the crash, the person knew, or should 40 have known, that the crash occurred; and 41 (II) The person failed to give information and render aid 42 as required by s. 316.062. 43 c. A felony of the first degree, punishable as provided in 44 s. 775.082, s. 775.083, or s. 775.084, if the person has a prior 45 conviction under this subparagraph, s. 327.35(3)(c)3., s. 46 782.071, or s. 782.072. 47 48 For purposes of this subsection, the term "unbor n child" has the 49 same meaning as provided in s. 775.021(5). Paragraph (c) of subsection (3) of section 53 327.35, Florida Statutes, is amended to read: 54 327.35 Boating under the influence; penalties; "designated 55 drivers."— 56 (3) Any person: 57 (c) Who, by reason of such operation, causes or 58 contributes to causing: 59 1. Damage to the property or person of another commits a 60 misdemeanor of the first degree, punishable as provided in s. 61 775.082 or s. 775.083. 62 2. Serious bodily injury to another, as defined in s. 63 327.353, commits a felony of the third degree, punishable as 64 provided in s. 775.082, s. 775.083, or s. 775.084. 65 3. The death of any human being commits BUI manslaughter, 66 and commits: 67 a. A felony of the second degree, punishable as provided 68 in s. 775.082, s. 775.083, or s. 775.084. 69 b. Subsection (1) of section 782.071, Florida 83 Statutes, is amended to read: 84 782.071 Vehicular homicide. —"Vehicular homicide" is the 85 killing of a human being, or the killing of an unborn child by 86 any injury to the mother, caused by the operation of a motor 87 vehicle by another in a reckless manner likely to cause the 88 death of, or great bodily harm to, another. 89 (1) Vehicular homicide is: 90 (a) A felony of the second degree, punishable as provided 91 in s. 775.082, s. 775.083, or s. 775. 084. 92 (b) A felony of the first degree, punishable as provided 93 in s. 775.082, s. 775.083, or s. 775.084, if: 94 1. At the time of the accident, the person knew, or should 95 have known, that the accident occurred; and 96 2. Section 782.072, Florida Statutes, is amended 106 to read: 107 782.072 Vessel homicide. —"Vessel homicide" is the killing 108 of a human being by the o peration of a vessel as defined in s. 109 327.02 by another in a reckless manner likely to cause the death 110 of, or great bodily harm to, another.
