17	17	treatment facilities to request the incorporation of 4
18	18	reclaimed water projects identified in Outstanding 5
19	19	Florida Springs recovery or prevention strategies; 6
20	20	requiring the Department of Environmental Protection 7
21	21	to approve such requests within a certain period of 8
22	22	time if certain conditions are met; providing an 9
23	23	effective date. 10

25	25	Be It Enacted by the Legislature of the State of Florida: 12

27	27	Section 1. Paragraphs (f) through (i) of subsection (16) 14
28	28	of section 403.064, Florida Statutes, are redesignated as 15
29	29	paragraphs (g) through (j), respectively, and a new parag raph 16
30	30	(f) is added to that subsection, to read: 17
31	31	403.064 Reuse of reclaimed water. — 18
32	32	(16) By November 1, 2021, domestic wastewater utilities 19
33	33	that dispose of effluent, reclaimed water, or reuse water by 20
34	34	surface water discharge shall submit to the departmen t for 21
35	35	review and approval a plan for eliminating nonbeneficial surface 22
36	36	water discharge by January 1, 2032, subject to the requirements 23
37	37	of this section. The plan must include the average gallons per 24
38	38	day of effluent, reclaimed water, or reuse water that will no 25

51	51	longer be discharged into surface waters and the date of such 26
52	52	elimination, the average gallons per day of surface water 27
53	53	discharge which will continue in accordance with the 28
54	54	alternatives provided for in subparagraphs (a)2. and 3., and the 29
55	55	level of treatment that the effluent, reclaimed water, or reuse 30
56	56	water will receive before being discharged into a surface water 31
57	57	by each alternative. 32
58	58	(f) A domestic wastewater treatment facility with an 33
59	59	approved plan may submit a request to the department to amend 34
60	60	the plan to incorporate a reclaimed water project identified in 35
61	61	an Outstanding Florida Springs recovery or prevention strategy 36
62	62	adopted pursuant to s. 373.805. The department shall approve the 37
63	63	request within 60 days after receipt of the request if all of 38
64	64	the following conditions are met: 39
65	65	1. The identified use of reclaimed water will benefit a 40
66	66	rural area of opportunity as defined in s. 288.0656(2). 41
67	67	2. The project will provide at least 35 million gallons 42
68	68	per day of reclaimed water to benefit an Outstanding Flo rida 43
69	69	Spring. 44
70	70	3. The project involves more than one domestic wastewater 45
71	71	treatment facility. 46
72	72	4. The project implementation and surface water discharge 47
73	73	elimination schedule meets the requirements of s. 373.805. 48
74	74	Section 2. This act shall take effect July 1, 2025. 49
