2525 Be It Enacted by the Legislature of the State of Florida: 12

2727 Section 1. Paragraphs (f) through (i) of subsection (16) 14
2828 of section 403.064, Florida Statutes, are redesignated as 15
2929 paragraphs (g) through (j), respectively, and a new parag raph 16
3030 (f) is added to that subsection, to read: 17
3131 403.064 Reuse of reclaimed water. — 18
3232 (16) By November 1, 2021, domestic wastewater utilities 19
3333 that dispose of effluent, reclaimed water, or reuse water by 20
3434 surface water discharge shall submit to the departmen t for 21
3535 review and approval a plan for eliminating nonbeneficial surface 22
3636 water discharge by January 1, 2032, subject to the requirements 23
3737 of this section. The plan must include the average gallons per 24
3838 day of effluent, reclaimed water, or reuse water that will no 25

5151 longer be discharged into surface waters and the date of such 26
5252 elimination, the average gallons per day of surface water 27
5353 discharge which will continue in accordance with the 28
5454 alternatives provided for in subparagraphs (a)2. and 3., and the 29
5555 level of treatment that the effluent, reclaimed water, or reuse 30
5656 water will receive before being discharged into a surface water 31
5757 by each alternative. 32
5858 (f) A domestic wastewater treatment facility with an 33
5959 approved plan may submit a request to the department to amend 34
6060 the plan to incorporate a reclaimed water project identified in 35
6161 an Outstanding Florida Springs recovery or prevention strategy 36
6262 adopted pursuant to s. 373.805. The department shall approve the 37
6363 request within 60 days after receipt of the request if all of 38
6464 the following conditions are met: 39
6565 1. The identified use of reclaimed water will benefit a 40
6666 rural area of opportunity as defined in s. 288.0656(2). 41
6767 2. The project will provide at least 35 million gallons 42
6868 per day of reclaimed water to benefit an Outstanding Flo rida 43
6969 Spring. 44
7070 3. The project involves more than one domestic wastewater 45
7171 treatment facility. 46
7272 4. The project implementation and surface water discharge 47
7373 elimination schedule meets the requirements of s. 373.805. 48
7474 Section 2. This act shall take effect July 1, 2025. 49
