2323 Be It Enacted by the Legislature of the State of Florida: 10

2525 Section 1. Subsection (5) of section 318.14, Florida 12
2626 Statutes, is amended to read: 13
2727 318.14 Noncriminal traffic infractions; exception; 14
2828 procedures.— 15
2929 (5)(a) Any person electing to appear before the designated 16
3030 official or who is required to appear shall be deemed to have 17
3131 waived his or her right to the civil penalty provisions of s. 18
3232 318.18. The official, after a hearing, shall make a 19
3333 determination as to whether an infraction has been committed. If 20
3434 the commission of an infraction has been proven, the official 21
3535 may impose a civil penalty not to exceed $500, except that in 22
3636 cases involving unlawful speed in a school zone or involving 23
3737 unlawful speed in a construction zone, the civil penalty may not 24
3838 exceed $1,000; or require attendance at a driver improvement 25

5252 (b)1. If the person is required to appear before the 27
5353 designated official pursuant to s. 318.19(1) and is found to 28
5454 have committed the infraction, the designated official shall 29
5555 impose a civil penalty of $1,000 in addition to any other 30
5656 penalties and the person's driver license shall be suspended for 31

5959 designated official pursuant to s. 318.19(1) and is found to 34
6060 have committed the infraction against a vulnerable road user as 35
6161 defined in s. 316.027(1), the designated official shall impose a 36
6262 civil penalty of not less than $5,000 in addition to any other 37
6363 penalties, the person's driver license shall be suspended for 1 38
6464 year, and the person shall be required to attend a department -39
6565 approved driver improvement course relating to the rights of 40
6666 vulnerable road users relative to vehicles on the roadway as 41
6767 provided in s. 322.0261(2). 42
6868 (c)1. If the person is required to appear before the 43
6969 designated official pursuant to s. 318.19(2) and is found to 44

100100 1. Except as provided in subparagraphs 2. and 3., the 63

103103 2. A second time, the designated official shall impose a 66

110110 (e) If the official determines that no infraction has been 73
111111 committed, no costs or penalties shall be imposed and any costs 74

125125 (f) Moneys received from the mandatory civil penalties 76
126126 imposed pursuant to this subsection upon persons required to 77
127127 appear before a designated official pursuant to s. 318.19(1) , or 78
128128 (2), or (6) shall be remitted to the Department of Revenue and 79
129129 deposited into the Department of Health Emergency Medical 80
130130 Services Trust Fund to provide financial support to certified 81
131131 trauma centers to assure the availability and accessibility of 82
132132 trauma services throughout the state. Funds deposited into the 83
133133 Emergency Medical Servic es Trust Fund under this section shall 84
134134 be allocated as follows: 85
135135 1.(a) Fifty percent shall be allocated equally among all 86
136136 Level I, Level II, and pediatric trauma centers in recognition 87
137137 of readiness costs for maintaining trauma services. 88
138138 2.(b) Fifty percent shall be allocated among Level I, 89
139139 Level II, and pediatric trauma centers based on each center's 90
140140 relative volume of trauma cases as calculated using the hospital 91
141141 discharge data collected pursuant to s. 408.061. 92
142142 Section 2. Subsections (4) and (5) of section 318.19, 93
143143 Florida Statutes, are amended, and subsection (6) is added to 94
144144 that section, to read: 95
145145 318.19 Infractions requiring a mandatory hearing. —Any 96
146146 person cited for the infractions listed in this section shall 97
147147 not have the provisions of s. 318.14( 2), (4), and (9) available 98
148148 to him or her but must appear before the designated official at 99
