24-purposes; authorizing certain funds to be provided to 11
25-mobile home owners for rehabilitation and emergency 12
26-repairs; removing a prohibition that only a certain 13
27-percentage of funds may be used for manufactured 14
28-housing; amending s. 420.9071, F.S.; conforming a 15

31-Be It Enacted by the Legislature of the State of Florida: 18

33- Section 1. Paragraph (b) of subsection (7) of section 20
34-420.9072, Florida Statutes, is amende d to read: 21
35- 420.9072 State Housing Initiatives Partnership Program. —22
36-The State Housing Initiatives Partnership Program is created for 23
37-the purpose of providing funds to counties and eligible 24
38-municipalities as an incentive for the creation of local housing 25
16+amending s. 420.9075, F.S.; revising the list of 3
17+persons with special housing needs for purposes of a 4
18+certain program to include persons who own mobile 5
19+homes placed in mobile home parks; including lot 6
20+rental assistance in the strategies for the provision 7
21+of affordable housing for which a local housing 8
22+assistance plan may allocate funds; requiring each 9
23+county and eligible municipality to include in its 10
24+local housing assistance plan the provision of funds 11
25+to certain persons for a specified purpose; requiring 12
26+that certain funds reserved for home ownership be used 13
27+to provide lot rental assistance to certain eligible 14
28+persons; authorizing counties and eligible 15
29+municipalities to use certain funds for the 16
30+construction, rehabilitation, or emergency repair of 17
31+certain mobile homes; prohibiting a county or an 18
32+eligible municipality from distinguishing or 19
33+discriminating between t ypes of housing when awarding 20
34+certain funds; providing an effective date. 21

51-partnerships, to expand production of and preserve affordable 26
52-housing, to further the housing element of the local government 27
53-comprehensive plan specific to affordable housing, and to 28
54-increase housing-related employment. 29

56- (b) A county or an eligible m unicipality may not expend 31
57-its portion of the local housing distribution to provide ongoing 32
58-rent subsidies, except for: 33
59- 1. Security and utility deposit assistance. 34
60- 2. Eviction prevention not to exceed 6 months' rent. 35
61- 3. Lot rental assistance for mobi le home owners as defined 36
62-in s. 723.003, not to exceed 6 months' rent. 37
63- 4.3. A rent subsidy program for very -low-income households 38
64-with at least one adult who is a person with special needs as 39
65-defined in s. 420.0004 or homeless as defined in s. 420.621. T he 40
66-period of rental assistance may not exceed 12 months for any 41
67-eligible household. 42
68- Section 2. Paragraphs (d) through (g) of subsection (3) of 43
69-section 420.9075, Florida Statutes, are redesignated as 44
70-paragraphs (e) through (h), respectively, paragraphs (f) through 45
71-(n) of subsection (5) are redesignated as paragraphs (e) through 46
72-(m), respectively, paragraph (c) of subsection (3) and 47
73-paragraphs (a), (c), and (e) and present paragraph (n) of 48
74-subsection (5) are amended, and new paragraphs (d) and (i) are 49
75-added to subsection (3) of that section, to read: 50
51+of subsection (5) of section 420.9075, Florida Statut es, are 26
52+amended, and paragraph (h) is added to subsection (3) of that 27
53+section, to read: 28
54+ 420.9075 Local housing assistance plans; partnerships. — 29
55+ (1)(a) Each county or eligible municipality participating 30
56+in the State Housing Initiatives Partnership Progr am shall 31
57+develop and implement a local housing assistance plan created to 32
58+make affordable residential units available to persons of very 33
59+low income, low income, or moderate income and to persons who 34
60+have special housing needs, including, but not limited to , 35
61+homeless people, the elderly, migrant farmworkers, and persons 36
62+with disabilities, and persons who own mobile homes placed in 37
63+mobile home parks as defined in s. 723.003 . Counties or eligible 38
64+municipalities may include strategies to assist persons and 39
65+households having annual incomes of not more than 140 percent of 40
66+area median income. The plans are intended to increase the 41
67+availability of affordable residential units by combining local 42
68+resources and cost-saving measures into a local housing 43
69+partnership and using private and public funds to reduce the 44
70+cost of housing. 45
71+ (b) Local housing assistance plans may allocate funds to: 46
72+ 1. Implement local housing assistance strategies for the 47
73+provision of affordable housing , including lot rental assistance 48
74+for persons who own mobile homes placed in mobile home parks as 49
75+defined in s. 723.003 . 50

90- (c) Each county and each eligible municipality is 53
91-encouraged to develop a strategy within its local housing 54
92-assistance plan that addresses the n eeds of persons who are 55
93-deprived of affordable housing due to the closure of a mobile 56
94-home park or the conversion of affordable rental units to 57
95-condominiums. 58
96- (d) Each county and each eligible municipality shall 59
97-include in its local housing assistance plan a strategy that 60
98-addresses the needs of persons who are deprived of affordable 61
99-housing due to the closure of a mobile home park. 62
100- (i) Each county and each eligible municipality shall 63
101-include in its local housing assistance plan a strategy for 64
102-providing program funds to mobile home owners, as defined in s. 65
103-723.003, which must include lot rental assistance. 66
88+ 2. Supplement funds available to the corporation to 51
89+provide enhanced funding of state housing programs within the 52
90+county or the eligible municipality. 53
91+ 3. Provide the local mat ching share of federal affordable 54
92+housing grants or programs. 55
93+ 4. Fund emergency repairs, including, but not limited to, 56
94+repairs performed by existing service providers under 57
95+weatherization assistance programs under ss. 409.509 -409.5093. 58
96+ 5. Further the housing element of the local government 59
97+comprehensive plan adopted pursuant to s. 163.3184, specific to 60
98+affordable housing. 61

100+ (h) Each county and each eligible municipality shall 63
101+include in its local housing assistance plan the provision of 64
102+funds for lot rental assistance to persons who own mobile homes 65
103+placed in mobile home parks as defined in s. 723.003. 66
104104 (5) The following criteria apply to awards made to 67
105105 eligible sponsors or eligible persons for the purpose of 68
106106 providing eligible housing: 69
107107 (a) At least 65 percent of the funds made available in 70
108108 each county and eligible municipality from the local housing 71
109109 distribution must be reserved for home ownership for eligible 72
110-persons. For purposes of this paragraph, lot rental assistance 73
111-for eligible mobile home owners as defined in s. 723.003 is an 74
112-approved home ownership activity. 75
110+persons. For eligible persons who own mobile homes placed in 73
111+mobile home parks as defined in s. 723.003, such funds must be 74

128-or emergency repair of affordable, eligible housing. Funds may 79
129-be provided to mobile home owners as defined in s. 723.003 for 80
130-rehabilitation and emergency repairs under this paragraph. 81
131- (e) Not more than 20 percent of the funds made available 82
132-in each county and eligible municipality from the local housing 83
133-distribution may be used for manufactured housing. 84
134- (m)(n) Funds from the local housing distribution not used 85
135-to meet the criteria established in paragraph (a) or paragraph 86
136-(c) or not used for the adminis tration of a local housing 87
137-assistance plan must be used for housing production and finance 88
138-activities, including, but not limited to, financing 89
139-preconstruction activities or the purchase of existing units, 90
140-providing rental housing, and providing home owner ship training 91
141-to prospective home buyers and owners of homes assisted through 92
142-the local housing assistance plan. 93
143- 1. Notwithstanding the provisions of paragraphs (a) and 94
144-(c), program income as defined in s. 420.9071(26) may also be 95
145-used to fund activities described in this paragraph. 96
146- 2. When preconstruction due -diligence activities conducted 97
147-as part of a preservation strategy show that preservation of the 98
148-units is not feasible and will not result in the production of 99
149-an eligible unit, such costs shall be deemed a program expense 100

162-rather than an administrative expense if such program expenses 101
163-do not exceed 3 percent of the annual local housing 102

165- 3. If both an award under the local housing assistance 104
166-plan and federal low -income housing tax cred its are used to 105
167-assist a project and there is a conflict between the criteria 106
168-prescribed in this subsection and the requirements of s. 42 of 107
169-the Internal Revenue Code of 1986, as amended, the county or 108
170-eligible municipality may resolve the conflict by givi ng 109
171-precedence to the requirements of s. 42 of the Internal Revenue 110
172-Code of 1986, as amended, in lieu of following the criteria 111
173-prescribed in this subsection with the exception of paragraphs 112
174-(a) and (f) (g) of this subsection. 113
175- 4. Each county and each elig ible municipality may award 114
176-funds as a grant for construction, rehabilitation, or repair as 115
177-part of disaster recovery or emergency repairs or to remedy 116
178-accessibility or health and safety deficiencies. Any other 117
179-grants must be approved as part of the local housing assistance 118

181- Section 3. Subsection (27) of section 420.9071, Florida 120
