20	20	contracts, respectively, from refusing to contract 7
21	21	with in-network health care facilities for the 8
22	22	provision of CAR T-cell therapies under certain 9
23	23	circumstances; prohibiting such policies and contracts 10
24	24	from denying coverage for the therapies under certain 11
25	25	circumstances; providing an effective date. 12

27	27	Be It Enacted by the Legislature of the State of Florida: 14

29	29	Section 1. Section 627.64198, Florida Sta tutes, is created 16
30	30	to read: 17
31	31	627.64198 Coverage for CAR T -cell therapies.— 18
32	32	(1) As used in this section, the term: 19
33	33	(a) "CAR T cell" or "chimeric antigen receptor T -cell" 20
34	34	means a patient's own T cell that has been altered in a 21
35	35	laboratory, to be used late r for the patient's CAR T -cell 22
36	36	therapy, also known as chimeric antigen receptor T -cell therapy. 23
37	37	(b) "CAR T-cell therapy" or "chimeric antigen receptor T -24
38	38	cell therapy" means a cancer treatment in which a patient 25

51	51	receives his or her CAR T cells, or chimeri c antigen receptor T 26
52	52	cells, via infusion so that the T cells can find and attack the 27
53	53	patient's cancerous cells. The infusion may be preceded by 28
54	54	chemotherapy or radiation therapy. 29
55	55	(c) "Health care facility" has the same meaning as the 30
56	56	term "licensed facil ity" in s. 395.002. 31
57	57	(2)(a) A health insurance policy issued, delivered, or 32
58	58	renewed on or after January 1, 2026, in this state which 33
59	59	provides coverage for chimeric antigen receptor T -cell therapy 34
60	60	may not refuse to contract with a health care facility for the 35
61	61	administration of CAR T cells and any medication necessary for 36
62	62	the CAR T-cell therapy, and the performance of any procedure 37
63	63	necessary for such therapy, in accordance with the guidelines 38
64	64	and procedures under a CAR T -cell therapy approved by the United 39
65	65	States Food and Drug Administration if the health care facility 40
66	66	is included in the health insurance policy's provider network 41
67	67	with respect to any other service. 42
68	68	(b) A health insurance policy issued, delivered, or 43
69	69	renewed on or after January 1, 2026, in th is state which 44
70	70	provides coverage for chimeric antigen receptor T -cell therapy 45
71	71	may not deny coverage for the administration of CAR T cells and 46
72	72	any medication necessary for the CAR T -cell therapy, and the 47
73	73	performance of any procedure necessary for such thera py, by a 48
74	74	health care facility in accordance with the guidelines and 49
75	75	procedures under a CAR T -cell therapy approved by the United 50
