2727 Be It Enacted by the Legislature of the State of Florida: 14

2929 Section 1. Section 627.64198, Florida Sta tutes, is created 16

3131 627.64198 Coverage for CAR T -cell therapies.— 18
3232 (1) As used in this section, the term: 19
3333 (a) "CAR T cell" or "chimeric antigen receptor T -cell" 20
3434 means a patient's own T cell that has been altered in a 21
3535 laboratory, to be used late r for the patient's CAR T -cell 22
3636 therapy, also known as chimeric antigen receptor T -cell therapy. 23
3737 (b) "CAR T-cell therapy" or "chimeric antigen receptor T -24
3838 cell therapy" means a cancer treatment in which a patient 25

5151 receives his or her CAR T cells, or chimeri c antigen receptor T 26

5555 (c) "Health care facility" has the same meaning as the 30
5656 term "licensed facil ity" in s. 395.002. 31
5757 (2)(a) A health insurance policy issued, delivered, or 32
5858 renewed on or after January 1, 2026, in this state which 33
5959 provides coverage for chimeric antigen receptor T -cell therapy 34
6060 may not refuse to contract with a health care facility for the 35
6161 administration of CAR T cells and any medication necessary for 36
6262 the CAR T-cell therapy, and the performance of any procedure 37
6363 necessary for such therapy, in accordance with the guidelines 38
6464 and procedures under a CAR T -cell therapy approved by the United 39
6565 States Food and Drug Administration if the health care facility 40
6666 is included in the health insurance policy's provider network 41
6767 with respect to any other service. 42
6868 (b) A health insurance policy issued, delivered, or 43
6969 renewed on or after January 1, 2026, in th is state which 44

7171 may not deny coverage for the administration of CAR T cells and 46
