Paragraph (b) of subsection (2), paragraph (b) 12 of subsection (3), and paragraph (b) of subsection (4) of 13 section 501.1736, Florida Statutes, are amended to read: 14 501.1736 Social media use for minors. — 15 (2) 16 (b) A social media platform shall: 17 1. Terminate any accou nt held by an account holder younger 18 than 14 years of age, including accounts that the social media 19 platform treats or categorizes as belonging to an account holder 20 who is likely younger than 14 years of age for purposes of 21 targeting content or advertising , and provide 90 days for an 22 account holder to dispute such termination. Allow an account holder younger than 14 years of age to 26 request to terminate the account. Termination must be effective 27 within 5 business days after such request. 28 3. Allow the confirmed parent or guardian of an account 29 holder younger than 14 years of age to request that the minor's 30 account be terminated. Termination must be effective within 10 31 business days after such request. 32 4. Permanently delete all personal information held by the 33 social media platform relating to the terminated account, unless 34 there are legal requirements to maintain such inf ormation. 35 5. Allow the confirmed parent or legal guardian of an 36 account holder younger than 14 years of age to view all 37 messages. 38 6. Allow law enforcement officers to view messages of a 39 minor that are relevant to any investigation upon receiving 40 consent from the confirmed parent or guardian or pursuant to a 41 warrant. 42 7. Prohibit an account holder who is younger than 14 years 43 of age from using or accessing messages that are designed to 44 disappear or self-destruct after a certain period of time or 45 upon viewing, or messages that are ephemeral in nature. 46 (3) 47 (b) A social media platform shall: 48 1. The social media platf orm shall provide 90 55 days for an account holder to dispute such termination. 56 Termination must be effective upon the expiration of the 90 days 57 if the account holder fails to effectively dispute the 58 termination. 59 2. Allow an account holder who is 14 or 15 y ears of age to 60 request to terminate the account. Termination must be effective 61 within 5 business days after such request. 62 3. Allow the confirmed parent or guardian of an account 63 holder who is 14 or 15 years of age to request that the minor's 64 account be terminated. Termination must be effective within 10 65 business days after such request. 66 4. Permanently delete all personal information held by the 67 social media platform relating to the terminated account, unless 68 there are legal requirements to maintain such information. 69 5. Allow the confirmed parent or guardian of an account 70 holder who is 14 or 15 years of age to view all messages. 71 6. Prohibit an account holder who is 14 or 15 years of age 76 from using or accessing messages that are designed to disappear 77 or self-destruct after a certain period of time or upon viewing, 78 or messages that are ephemeral in nature. 79 (4) If a court enjoins the enforcement of subsection (3) 80 or would otherwise enjoin enforcement of any other provision of 81 this section due to subsection (3), then subsec tion (3) shall be 82 severed, and the following shall come into effect: 83 (b) A social media platform shall: 84 1. Terminate any account held by an account holder who is 85 14 or 15 years of age, including accounts that the social media 86 platform treats or categor izes as belonging to an account holder 87 who is likely 14 or 15 years of age for purposes of targeting 88 content or advertising, and provide 90 days for an account 89 holder to dispute such termination. This act shall take effect July 1, 2025. 113
