An act relating to insurance overpayment claims 2 
submitted to psychologists; amending ss. 627.6131 and 3 
641.3155, F.S.; requiring insurance overpayment claims 4 
submitted to psychologists to be submitted within a 5 
specified timeframe; providing applicability; 6 
providing an effective date. 7

Be It Enacted by the Legislature of the State of Florida: 9 
 10 
 Section 1.  Subsection (18) of section 627.6131, Florida 11 
Statutes, is amended to read: 12 
 627.6131  Payment of claims. — 13 
 (18)  Notwithstanding the 30 -month period provided in 14 
subsection (6), all claims for overpayment submitted to a 15 
provider licensed under chapter 458, chapter 459, chapter 460, 16 
chapter 461, or chapter 466, or chapter 490 must be submitted to 17 
the provider within 12 months after the health insurer's payment 18 
of the claim. A claim for overpayment may not be permitted 19 
beyond 12 months after the health insurer's payment of a claim, 20 
except that claims for over payment may be sought beyond that 21 
time from providers convicted of fraud pursuant to s. 817.234. 22 
 Section 2.  Subsection (16) of section 641.3155, Florida 23 
Statutes, is amended to read: 24 
 641.3155  Prompt payment of claims. — 25

 (16)  Notwithstanding the 30 -month period provided in 26 
subsection (5), all claims for overpayment submitted to a 27 
provider licensed under chapter 458, chapter 459, chapter 460, 28 
chapter 461, or chapter 466, or chapter 490 must be submitted to 29 
the provider within 12 months after the health maintenance 30 
organization's payment of the claim. A claim for overpayment may 31 
not be permitted beyond 12 months after the health maintenance 32 
organization's payment of a claim, except that claims for 33 
overpayment may be sought beyond that time from providers 34 
convicted of fraud pursuant to s. 817.234. 35 
 Section 3. The amendments made by this act to ss. 36 
627.6131(18) and 641.3155(16), Florida Statutes, apply to claims 37 
for services provided on or after January 1, 2026. 38 
 Section 4. This act shall take effect July 1, 2025. 39
