Subsections (1) and (4) of section 100.041, 14 Florida Statutes, are amended, and subsections (5) and (6) are 15 added to that section to read: 16 100.041 Officers cho sen at general election ; officer-elect 17 access to facilities .— 18 (1) State senators shall be elected for terms of 4 years, 19 those from odd-numbered districts in each year the number of 20 which is a multiple of 4 and those from even -numbered districts 21 in each even-numbered year the number of which is not a multiple 22 of 4. Members of the House of Representatives shall be elected 23 for terms of 2 years in each even -numbered year. The Governor and the 28 administrative officers of the executive branch of the state 29 shall be elected for te rms of 4 years in each even -numbered year 30 the number of which is not a multiple of 4. Except as provided 31 in subsection (5), the terms of state offices other than the 32 terms of members of the Legislature shall begin on the first 33 Tuesday after the first Monda y in January after said election. 34 The term of office of each member of the Legislature shall begin 35 upon election. 36 (4) The term of office of each county and each district 37 officer not otherwise provided by law shall commence on the 38 second first Tuesday after the first Monday in January following 39 his or her election. 40 (5) The term of office for a clerk of the circuit court, 41 sheriff, superintendent of schools, property appraiser, and tax 42 collector shall commence on the first Tuesday in December. 43 (6) A county constitutional officer -elect shall be granted 44 full access to all facilities owned by the constitutional office 45 to on the next business day after the officer -elect receives his 46 or her certificate of election from the supervisor of elections. 47 For the purposes of this section, the term "access to all 48 facilities" includes copies of keys or access cards necessary 49 for the officer-elect to begin the transition process. 50 HB 967 2025 CODING: Words stricken are deletions; words underlined are additions. hb967-00 Page 3 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S Section 2. Subsection (5) of section 129.06, Florida 51 Statutes, is amended to read: 52 129.06 Execution and amendment of budget. — 53 (5)(a) Any county constitutional officer whose budget is 54 approved by the board of county commissioners , who has not been 55 reelected to office or is not seeking reelection, shall be 56 prohibited from making any budget a mendments, transferring funds 57 between itemized appropriations, or expending in a single month 58 more than one-twelfth of any itemized approved appropriation, 59 following the date he or she is eliminated as a candidate or 60 October 1, whichever comes later, without approval of the board 61 of county commissioners. 62 (b) Any county constitutional officer whose budget is 63 approved by the board of county commissioners and who is not 64 seeking reelection shall be prohibited from making any budget 65 amendments, transferring fu nds between itemized appropriations, 66 or expending in a single month more than one -twelfth of any 67 itemized approved appropriation on or after October 1 of the 68 year in which the election is held without approval of the board 69 of county commissioners. 70 Section 3. Subsection (5) of section 195.087, Florida 71 Statutes, is amended to read: 72 195.087 Property appraisers and tax collectors to submit 73 budgets to Department of Revenue. — 74 (5)(a) Any property appraiser or tax collector whose 75 HB 967 2025 CODING: Words stricken are deletions; words underlined are additions. hb967-00 Page 4 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S budget is approved by the D epartment of Revenue who has not been 76 reelected to office or is not seeking reelection shall be 77 prohibited from making any budget amendments, transferring funds 78 between itemized appropriations, or expending in a single month 79 more than one-twelfth of any itemized approved appropriation 80 following the date he or she is eliminated as a candidate or 81 October 1, whichever comes later, without the approval of the 82 Department of Revenue. 83 (b) Any property appraiser or tax collector whose budget 84 is approved by the Department of Revenue and who is not seeking 85 reelection shall be prohibited from making any budget 86 amendments, transferring funds between itemized appropriations, 87 or expending in a single month more than one -twelfth of any 88 itemized approved appropriation o n or after October 1 of the 89 year in which the election is held without the approval of the 90 Department of Revenue. 91 Section 4. This act shall take effect July 1, 2025. 92
