21	21	revising when specified officers must abide by certain 8
22	22	limitations related to approved budgets; providing an 9

25	25	Be It Enacted by the Legislature of the State of Florida: 12

27	27	Section 1. Subsections (1) and (4) of section 100.041, 14
28	28	Florida Statutes, are amended, and subsections (5) and (6) are 15
29	29	added to that section to read: 16
30	30	100.041 Officers cho sen at general election ; officer-elect 17
31	31	access to facilities .— 18
32	32	(1) State senators shall be elected for terms of 4 years, 19
33	33	those from odd-numbered districts in each year the number of 20
34	34	which is a multiple of 4 and those from even -numbered districts 21
35	35	in each even-numbered year the number of which is not a multiple 22
36	36	of 4. Members of the House of Representatives shall be elected 23
37	37	for terms of 2 years in each even -numbered year. In each county, 24
38	38	a clerk of the circuit court, sheriff, superintendent of 25

51	51	schools, property appraiser, and tax collector shall be chosen 26
52	52	by the qualified electors at the general election in each year 27
53	53	the number of which is a multiple of 4. The Governor and the 28
54	54	administrative officers of the executive branch of the state 29
55	55	shall be elected for te rms of 4 years in each even -numbered year 30
56	56	the number of which is not a multiple of 4. Except as provided 31
57	57	in subsection (5), the terms of state offices other than the 32
58	58	terms of members of the Legislature shall begin on the first 33
59	59	Tuesday after the first Monda y in January after said election. 34
60	60	The term of office of each member of the Legislature shall begin 35
61	61	upon election. 36
62	62	(4) The term of office of each county and each district 37
63	63	officer not otherwise provided by law shall commence on the 38
64	64	second first Tuesday after the first Monday in January following 39
65	65	his or her election. 40
66	66	(5) The term of office for a clerk of the circuit court, 41
67	67	sheriff, superintendent of schools, property appraiser, and tax 42
68	68	collector shall commence on the first Tuesday in December. 43
69	69	(6) A county constitutional officer -elect shall be granted 44
70	70	full access to all facilities owned by the constitutional office 45
71	71	to on the next business day after the officer -elect receives his 46
72	72	or her certificate of election from the supervisor of elections. 47
73	73	For the purposes of this section, the term "access to all 48
74	74	facilities" includes copies of keys or access cards necessary 49
75	75	for the officer-elect to begin the transition process. 50

88	88	Section 2. Subsection (5) of section 129.06, Florida 51
89	89	Statutes, is amended to read: 52
90	90	129.06 Execution and amendment of budget. — 53
91	91	(5)(a) Any county constitutional officer whose budget is 54
92	92	approved by the board of county commissioners , who has not been 55
93	93	reelected to office or is not seeking reelection, shall be 56
94	94	prohibited from making any budget a mendments, transferring funds 57
95	95	between itemized appropriations, or expending in a single month 58
96	96	more than one-twelfth of any itemized approved appropriation, 59
97	97	following the date he or she is eliminated as a candidate or 60
98	98	October 1, whichever comes later, without approval of the board 61
99	99	of county commissioners. 62
100	100	(b) Any county constitutional officer whose budget is 63
101	101	approved by the board of county commissioners and who is not 64
102	102	seeking reelection shall be prohibited from making any budget 65
103	103	amendments, transferring fu nds between itemized appropriations, 66
104	104	or expending in a single month more than one -twelfth of any 67
105	105	itemized approved appropriation on or after October 1 of the 68
106	106	year in which the election is held without approval of the board 69
107	107	of county commissioners. 70
108	108	Section 3. Subsection (5) of section 195.087, Florida 71
109	109	Statutes, is amended to read: 72
110	110	195.087 Property appraisers and tax collectors to submit 73
111	111	budgets to Department of Revenue. — 74
