30- Section 1. Section 394. 6581, Florida Statutes, is created 17

32- 394.6581 Crisis Care Coordination Pilot Programs. 19
33- (1) Subject to a specific appropriation, the department 20
34-shall establish and implement Crisis Care Coordination Pilot 21
35-Programs in Polk and Volusia Counties. T he purpose of the pilot 22
36-programs is to reduce repeat involuntary examinations initiated 23
37-by law enforcement, provide persons who are experiencing an 24
38-acute mental health crisis an option for crisis intervention 25

25+Be It Enacted by the Legislature of the State of Florida: 12
26+ 13
27+ Section 1. Subsection (4) is added to section 394.4573, 14
28+Florida Statutes, to read: 15
29+ 394.4573 Coordinated system of care; annual assessment; 16
30+essential elements; measures of performance; system improvement 17
31+grants; reports.—On or before December 1 of each year, the 18
32+department shall submit to the Governor, the President of the 19
33+Senate, and the Speaker of the House of Representatives an 20
34+assessment of the behavioral health servi ces in this state. The 21
35+assessment shall consider, at a minimum, the extent to which 22
36+designated receiving systems function as no -wrong-door models, 23
37+the availability of treatment and recovery services that use 24
38+recovery-oriented and peer-involved approaches, the availability 25

51-other than the use of law enforcement, reduce t heir level of 26
52-followup interaction with law enforcement officers post crisis, 27
53-and assist them with engagement in behavioral health care. 28
54- (a) The pilot programs shall facilitate partnerships 29
55-between law enforcement agencies in Polk and Volusia Counties 30
56-and organizations in the coordinated system of care under s. 31
57-394.4573 that are operating in those counties by placing crisis 32
58-counselors within law enforcement agencies to intervene with and 33
59-provide followup care for persons who are experiencing or have 34
60-experienced an acute mental health crisis and their families and 35
61-support networks. 36
62- (b) The pilot programs shall be implemented by nationally 37
63-accredited community mental health centers in partnership with 38
64-local law enforcement. 39
65- (2) Crisis counselors placed i n law enforcement agencies 40
66-shall provide support and assistance to persons who are 41
67-experiencing or have experienced an acute mental health crisis, 42
68-connecting them to the coordinated system of care. Duties of 43
69-crisis counselors shall include: 44
70- (a) Intervening when law enforcement is contacted relating 45
71-to a person experiencing an acute mental health crisis to make 46
72-observations and provide information to responding officers, 47
73-conduct assessments, de -escalate the crisis situation, or 48
74-provide referrals, as appro priate. 49
75- (b) Follow up with such persons following an acute mental 50
51+of less-restrictive services, and the use of evidence -informed 26
52+practices. The assessment shall also consider the availability 27
53+of and access to coordinated specialty care programs and 28
54+identify any gaps in the availability of and access to s uch 29
55+programs in the state. The department's assessment shall 30
56+consider, at a minimum, the needs assessments conducted by the 31
57+managing entities pursuant to s. 394.9082(5). The department 32
58+shall compile and include in the report all plans submitted by 33
59+managing entities pursuant to s. 394.9082(8) and the 34
60+department's evaluation of each plan. 35
61+ (4) As part of a coordinated system of care and subject to 36
62+a specific appropriation by the Legislature, the department, 37
63+through the managing entities, shall implement a Cr isis Care 38
64+Coordination Pilot Program with an emphasis on a coordinated 39
65+system of care in Polk and Volusia Counties to be implemented by 40
66+nationally accredited community mental health centers in 41
67+partnership with local law enforcement. 42
68+ (a) The pilot program must provide community -based care 43
69+coordination and support for children, adolescents, and adults 44
70+after contact with law enforcement during a mental health crisis 45
71+event, including involuntary examinations initiated by a law 46
72+enforcement officer. 47
73+ (b) Services provided by the pilot program shall include 48
74+assessment, safety planning, assistance in accessing recommended 49
75+services, supportive counseling, and other supports needed 50

88-health crisis involving law enforcement, such as an involuntary 51
89-examination as defined in s. 394.455 initiated by law 52
90-enforcement. A person's involvement with followup care shall be 53
91-voluntary. Such followup care by crisis counselors may include, 54
92-but need not be limited to: 55
93- 1. Conducting assessments. 56
94- 2. Providing individualized safety planning tailored to 57
95-the person's needs and risks. 58
96- 3. Providing supportive counseling. 59
97- 4. Assisting persons in accessing recommended mental 60
98-health services and substance abuse services. 61
99- 5. Assisting persons in adhering to discharge plans. 62
100- 6. Providing care coordination as defined in s. 63
101-394.4573(1), unless a person is already receiving that service 64
102-from another organization. 65
103- (3) The pilot programs shall establish formal partnerships 66
104-through written referral agreements and information exchange 67
105-procedures with, at a minimum, providers of mental health 68
106-services and substance abuse services, local hosp itals licensed 69
107-under chapter 395, and not -for-profit agencies and other 70
108-organizations which can be of assistance to persons who are 71
109-experiencing or have experienced an acute mental health crisis 72
110-and their families and support networks. Such agreements shal l, 73
111-at a minimum, facilitate timely access to community -based 74
112-behavioral health services and other local systems and entities 75

126- (4) The department shall contract for an independent 77
127-evaluation of the pilot programs regarding, at a minimum, their 78
128-effectiveness and return on investment. By January 15, 2029, the 79
129-department shall submit a report of the findings of the 80
130-evaluation of the pilot programs to the Governor, the President 81
131-of the Senate, and the Speaker of the H ouse of Representatives, 82
132-which shall include, at a minimum: 83
133- (a) The amount of time that law enforcement officers were 84
134-engaged in responses to persons who were experiencing or had 85
135-experienced an acute mental health crisis. 86
136- (b) Repeat involuntary examina tions initiated by law 87
137-enforcement. 88
138- (c) Engagement in post -crisis mental health and substance 89
139-abuse services among persons served by the programs. 90
140- (d) The effectiveness of the pilot program services. 91
141- (e) Recommendations regarding enhancements to, and 92
142-continuation and expansion of, the pilot programs. 93
143- (5) The department may adopt rules to implement this 94
144-section. 95
145- (6) This section expires June 30, 2029. 96
146- Section 2. This act shall take effect July 1, 2025. 97

91+information exchange procedures. Referral agreements must be 54
92+developed with behavioral health service providers in the pilot 55
93+program's service area to facilitate timely access to communi ty-56

95+entities as outlined in the individual's discharge plan. 58
96+ (d) The goal of the pilot program is to reduce repeat 59
97+involuntary examinations initiated by law enforcement, reduce 60
98+the time burden of law enforcement working with individuals 61
99+after an involuntary examination, provide post -crisis 62
100+intervention services, assist individuals with engagement in 63
101+mental health care, and provide individuals an option for crisis 64
102+intervention other than the use o f law enforcement. 65
103+ (e) The pilot program must engage a third -party evaluator 66
104+to assess the pilot program's efficacy and return on investment 67
105+and provide a written report of the findings within 2 years 68
106+after implementation of the pilot program. 69
107+ Section 2. This act shall take effect July 1, 2025. 70
