9494 (b) "Family member" means a spouse, whether by 57

102102 (c) "Firearm" has the same meaning as in s. 790.001 and 65

105105 (d) "Licensed dealer" means a person who holds a federal 68
106106 firearms license issued pursuant to 18 U.S.C. s. 923(a). 69
107107 (e) "Person" means any individual, corporation, trust, 70
108108 company, firm, partnership, association, club, organization, 71
109109 society, joint stock company, or other legal entity. 72
110110 (f) "Purchaser or other transferee" means an unlicensed 73
111111 person who wishes or intends to receive a firearm from another 74

125125 (g) "Sale" means the sale, delivery, or passing of 76
126126 ownership or control of a firearm for a fee or other 77

128128 (h) "Seller or other transferor" means an unlicensed 79
129129 person who wishes or intends to transfer a firearm to another 80

131131 (i) "Transfer" means to furnish, give, lend, deliver, or 82

133133 (j) "Unfinished frame or receiver" means a forging, 84
134134 casting, printing, extrusion, machined body, or similar item 85

136136 1. Designed to or may readily be completed, assembled, or 87
137137 otherwise converted to function as a frame or receiver; or 88
138138 2. Marketed or sold to t he public to become or be used as 89
139139 the frame or receiver of a functional firearm, rifle, or shotgun 90
140140 once completed, assembled, or otherwise converted. 91

142142 However, the term does not include a component designed and 93
143143 intended for use in an antique weapon. 94
144144 (k) "Unlicensed person" means a person who is not a 95
145145 licensed dealer. 96
146146 (2) All persons involved in firearm sales or other 97
147147 transfers, in whole or in part, are subject to background checks 98
148148 unless specifically exempted by state or federal law. If the 99

162162 or in part, is a corporation or any entity other than an 101
163163 individual person, the principal individual or individuals 102
164164 involved in such sale or other transfer on behalf of the 103
165165 corporation or other entity is subject to background checks 104
166166 unless specifically exempted by federal law. A person may not 105
167167 sell or otherwise transfer a firearm unless: 106
168168 (a) The person is a licensed dealer; 107
169169 (b) The purchaser or other transferee is a licensed 108
170170 dealer; or 109
171171 (c) The requirements of subsection (3) are met. 110
172172 (3) If neither party to a prospective firearm sale or 111
173173 other transfer is a licensed dealer, the parties to the 112
174174 transaction shall complete the sale or other transfer through a 113
175175 licensed dealer as follows: 114
176176 (a) The seller or other transferor and the purchaser or 115
177177 other transferee shall appear jointly with the firearm at a 116
178178 licensed dealer and request that the licensed dealer conduct a 117
179179 background check on the purchaser or other transferee. 118
180180 (b) A licensed dealer who agrees to facilitate a 119
181181 background check under this section shall process the sale or 120
182182 other transfer as if he or she were transferring the firearm 121
183183 from the licensed dealer's own inventory to the purchaser or 122
184184 other transferee, complying with all requirements of federa l and 123
185185 state law that would apply if he or she were the seller or other 124

200200 (c) The seller or other transferor and the purchaser or 127
201201 other transferee shall each complete , sign, and submit all state 128
202202 and federal forms necessary to process the background check and 129
203203 otherwise complete the sale or other transfer pursuant to this 130
204204 section, and the licensed dealer shall indicate on the forms 131
205205 that the sale or other transfer is betw een unlicensed persons. 132
206206 (d) This section does not prevent the seller or other 133
207207 transferor from removing the firearm from the premises of the 134
208208 licensed dealer while the background check is being conducted or 135
209209 during the applicable waiting period, provided th at the seller 136
210210 or other transferor returns to the business premises of the 137
211211 licensed dealer and delivers the firearm to the licensed dealer 138
212212 before completion of the sale or other transfer. 139
213213 (e) A licensed dealer or a seller or other transferor may 140
214214 not sell or otherwise transfer a firearm to a purchaser or other 141
215215 transferee if the results of the background check indicate that 142
216216 the purchaser or other transferee is prohibited from possessing 143
217217 or receiving a firearm under federal or state law. 144
218218 (f) A licensed deal er who agrees to conduct a background 145
219219 check may charge a reasonable fee not to exceed the 146
220220 administrative costs incurred by the licensed dealer for 147
221221 facilitating the sale or other transfer of the firearm, plus 148
222222 applicable fees pursuant to federal and state la w. 149
223223 (4) Subsections (2) and (3) do not apply to the following: 150

248248 purposes of service or repair who returns the firearm to its 163

250250 (d) A common carrier, warehouseman, or other person 165
251251 engaged in the business of transportation or storage, to the 166
252252 extent that the receipt of any firearm is in the ordinary course 167
253253 of business and not for the personal use of any such person. 168
254254 (e) A person who is not prohibited fr om possessing or 169
255255 receiving a firearm under state or federal law who has 170
256256 temporarily transferred a firearm: 171
257257 1. Solely for the purpose of shooting at targets, if the 172
258258 transfer occurs on the premises of a sport shooting range 173
259259 authorized by the governing body of the jurisdiction in which 174
260260 the range is located, or, if no such authorization is required, 175

274274 the firearm is at all times kept within the premises of the 177

276276 2. While the person is accompanying the lawful owner of 179
277277 the firearm and using the firearm for lawful hunting purposes, 180
278278 if hunting is legal in all places where the person possesses the 181
279279 firearm and the person holds all licenses and permits required 182
280280 for such hunting; 183
281281 3. While participating in a lawfully organized competition 184
282282 involving the use of a firearm; or 185
283283 4. While in the presence of the seller or other 186
284284 transferor. 187
285285 (f) A family member of the seller or other transferor. 188
286286 This paragraph does not apply if the lawful owner or family 189
287287 member knows or has reasonable cause to believe that federal or 190
288288 state law prohibits the family member from purchasing or 191
289289 possessing a firearm, or the seller or other transferor knows or 192
290290 has reasonable cause to believe that the family member is likely 193
291291 to use the firearm for unlawful purposes. 194
292292 (g) An executor, administrator, trustee, or personal 195
293293 representative of an estate or trust that occurs by operation of 196
294294 law upon the death of the former lawful owner of the firearm. 197
295295 (h) The temporary transfer of a firearm if such transfer 198
296296 is to prevent immediate or imminent death or great bodily harm 199
297297 to one's self or others, provided that the person to whom the 200

311311 firearm under state or federal law and the temporary transfer 202
312312 lasts no longer than necessary to prevent such immediate or 203
313313 imminent death or great bodily harm. 204
314314 (i) The sale or other transfer of an antique firearm. 205
315315 (5) A person who violates this section commits a felony of 206
316316 the third degree, punishable as provided in s. 775.082, s. 207
317317 775.083, or s. 775.084. 208
318318 (6) In addition to any other penalty or remedy, the 209
319319 investigating law enforcement agency shall report any violation 210
320320 of this section committed by a licensed dealer to the Attorney 211
321321 General. 212
322322 (7) This section does not apply to any firearm modified to 213
323323 render it permanently inoperable. 214
324324 Section 3. Section 790.174, Florida Statutes, is amended 215
325325 to read: 216
326326 790.174 Safe storage of firearms required. — 217
327327 (1)(a) A person who stores or leaves, on a premise under 218
328328 his or her control, a loaded firearm, as defined in s. 790.001, 219
329329 and who knows or reasonably sh ould know that a minor is likely 220
330330 to gain access to the firearm without the lawful permission of 221
331331 the minor's parent or the person having charge of the minor, or 222
332332 without the supervision required by law, shall keep the firearm 223
333333 in a securely locked box or cont ainer or in a location which a 224

350350 quickly as if he or she carried it on his or her body. 229
351351 (b) A person who stores or leaves, on a premise under his 230
352352 or her control, a firearm, as defined in s. 790.001, and who 231
353353 knows or reasonably should know that a prohibited user is like ly 232
354354 to gain access to the firearm, shall keep the firearm in a 233
355355 securely locked box or container or shall secure it with a 234
356356 trigger lock, except when the person is carrying the firearm on 235
357357 his or her body or within such close proximity thereto that he 236
358358 or she can retrieve and use the firearm as easily and quickly as 237
359359 if he or she carried it on his or her body. For the purposes of 238
360360 this section, the term "prohibited user" means any person who is 239
361361 prohibited by state or federal law from possessing the firearm. 240
362362 (2) Except as provided in paragraphs (b) and (c), It is a 241
363363 misdemeanor of the second degree, punishable as provided in s. 242
364364 775.082 or s. 775.083, if a person violates subsection (1) : 243

472472 post at each purchas e counter the following warning in block 315

495495 (b) The sale of a firearm to a person who presents to the 326
496496 licensed dealer one of the following: 327
497497 1. A trigger lock or other device designed to disable the 328
498498 firearm and prevent the discharge of the firearm together with a 329
499499 copy of the purchase rec eipt for the licensed dealer to keep. A 330
500500 separate trigger lock or device and a separate purchase receipt 331
501501 are required for each firearm purchased. 332
502502 2. A gun case or storage container that can be secured to 333
503503 prevent unauthorized access to the firearm together with a copy 334
504504 of the purchase receipt for the licensed dealer to keep. A 335
505505 separate gun case or storage container and a separate purchase 336
506506 receipt are required for each firearm purchased. 337
507507 (c) The sale of an antique firearm. 338
508508 (5) Upon the sale of a firearm, a licensed dealer shall 339
509509 sign a statement and require the purchaser to sign a statement 340
510510 stating that the sale is in compliance with subsections (1), 341
511511 (3), and (4). The dealer shall retain a copy of the signed 342
512512 statements and, if applicable, a copy of the rece ipt prescribed 343
513513 in paragraph (4)(b), for at least 6 years. 344
514514 (6)(a) This section does not create a civil action or 345
515515 liability for damages arising from the use or misuse of a 346
516516 firearm or ammunition for a person, other than a licensed 347
517517 dealer, who produces a fir earm or ammunition. 348
518518 (b) A licensed dealer is not liable for damages arising 349
519519 from the use or misuse of a firearm if the sale complies with 350

549549 (1) As used in this section, the term: 368
550550 (a) "Federal licensee authorized to serialize firearms" 369
551551 means a person, firm, corporation, or other entity that holds 370
552552 any valid federal license that authorizes the person, firm, 371
553553 corporation, or other entity to imprint serial numbers onto 372
554554 firearms and completed or unfi nished frames or receivers 373

771771 voluntary buyback program in which the governmental entity is 518
772772 buying or receiving such weapons from pr ivate individuals. 519
773773 (i) The possession and disposition of a firearm or any 520
774774 completed or unfinished frame or receiver by a person who meets 521
775775 all of the following: 522
776776 1. The person is not prohibited by Florida or federal law 523

831831 licensed dealer before January 1, 2026. As used in this section, 554
832832 the term "licensed dealer" means a person licensed as a dealer 555
833833 in firearms issued pursuant to 18 U.S.C. s. 923(a). 556
834834 Section 7. Veteran's Firearm Suicide Reduction Task 557
835835 Force.— 558
836836 (1) The Veteran's Firearm Suicide Reduction Task Force, a 559
837837 task force as defined in s. 20.03, is created within the 560
838838 Department of Veterans' Affairs. Except as otherwise provided in 561
839839 this section, the task force shall comply with the requirements 562
840840 of s. 20.052. 563
841841 (2)(a) The 10-member task force shall convene no later 564
842842 than September 1, 2025, and must be composed of two members 565
843843 appointed by each of the following: the Governor, the President 566
844844 of the Senate, the Minority Leader of the Senate, the Speaker of 567
845845 the House of Representatives, and the Minority Leader of the 568
846846 House of Representatives. Appointments must be made by August 1, 569
847847 2025. The Governor shall appoint a chair from among the members. 570
848848 Members serve at the pleasure of the appointing officer. A 571
849849 vacancy on the task forc e must be filled in the same manner as 572
850850 the original appointment. 573
851851 (b) The general counsel of the Department of Veterans' 574
852852 Affairs shall serve as the general counsel for the task force. 575

868868 (d) The task force shall meet at the call of the chair, as 579
869869 necessary to conduct its work, at a time and location in this 580
870870 state designated by the chair. The task force may conduct its 581
871871 meetings through teleconferences or other similar means. 582
872872 (3) The task force shall investigate the causes of suicide 583
873873 by veterans, focusing on suicides involving firearms. In 584
874874 addition, the task force shall report on strategies and 585
875875 initiatives to reduce the rate of sui cide among veterans with a 586
876876 focus on firearm suicides. 587
877877 (4) The task force may call upon appropriate state 588
878878 agencies for such professional assistance as may be needed in 589
879879 the discharge of its duties, and such agencies shall provide 590
880880 such assistance in a timel y manner. 591
881881 (5) The task force shall submit a report on its findings 592
882882 and recommendations to the Governor, the President of the 593
883883 Senate, and the Speaker of the House of Representatives by 594
884884 January 1, 2026. 595
885885 (7) This section is repealed upon submission of the task 596
886886 force report. 597
887887 Section 8. This act shall take effect October 1, 2025. 598
