A bill to be entitled 1 
An act relating to coverage of prescription drugs for 2 
pain; creating ss. 409.9064 and 409.9746, F.S.; 3 
defining the term "nonopioid pain drug"; requiring the 4 
Medicaid program and Medicaid managed care plans, 5 
respectively, to provide coverage such that nonopioid 6 
pain drugs are not disadvantaged or otherwise 7 
discouraged relative to any opioid or narcotic drug 8 
for pain management or treatment; specifying 9 
prohibited practices in relation to such coverage; 10 
providing an effective date. 11

Be It Enacted by the Legislature of the State of Florida: 13 
 14 
 Section 1.  Section 409.9064, Florida Statutes, is created 15 
to read: 16 
 409.9064  Coverage of prescription drugs for pa in.— 17 
 (1)  As used in this section, the term "nonopioid pain 18 
drug" means a nonopioid drug approved by the United States Food 19 
and Drug Administration for the treatment or management of pain. 20 
 (2)  The agency shall provide coverage that does not 21 
disadvantage or otherwise discourage a nonopioid pain drug 22 
relative to any opioid or narcotic drug for the treatment or 23 
management of pain. Prohibited practices or policies for such 24 
coverage include, but are not limited to, the following: 25

 (a)  Designating a nonopioid pain drug as a nonpreferred 26 
drug if any opioid or narcotic drug is designated as a preferred 27 
drug on the mandatory preferred drug list. 28 
 (b)  Establishing utilization controls for a nonopioid pain 29 
drug which are more restrictive or more extensive than the least 30 
restrictive or extensive utilization controls applicable to any 31 
opioid or narcotic drug used for treatment of the same 32 
condition, including, but not limited to, imposing more 33 
restrictive or more extensive prior authorization or step -34 
therapy requirements for the nonopioid pain drug. 35 
 Section 2.  Section 409.9746, Florida Statutes, is created 36 
to read: 37 
 409.9746  Managed care plan coverage of prescription drugs 38 
for pain.— 39 
 (1)  As used in this section, the term "nonopioid pain 40 
drug" means a nonopioid drug approved by the United States Food 41 
and Drug Administration for the treatment or management of pain. 42 
 (2)  A managed care plan must provide coverage that does 43 
not disadvantage or otherwise discourage a nonopioid pain drug 44 
relative to any opioid or narc otic drug for the treatment or 45 
management of pain. Prohibited practices or policies for such 46 
coverage include, but are not limited to, the following: 47 
 (a)  Designating a nonopioid pain drug as a nonpreferred 48 
drug if any opioid or narcotic drug is designate d as a preferred 49

 (b)  Establishing utilization controls for a nonopioid pain 51 
drug which are more restrictive or more extensive than the least 52 
restrictive or extensive utilization controls applicable to any 53 
opioid or narcotic drug used for treatment of the same 54 
condition, including, but not limited to, imposing more 55 
restrictive or more extensive prior authorization or step -56 
therapy requirements for the nonopioid pain drug. 57 
 Section 3. This act shall take effect July 1, 2025. 58
