26+Be It Enacted by the Legislature of the State of Florida: 13

28+ Section 1. Paragraph (b) of subsection (17) of section 15
29+1002.20, Florida Statutes, is amended to read: 16
30+ 1002.20 K-12 student and parent rights.—Parents of public 17
31+school students must receive accurate and timely information 18
32+regarding their child's academic progress and must be informed 19
33+of ways they can help their child to succeed in school. K -12 20
34+students and their parents are affor ded numerous statutory 21
35+rights including, but not limited to, the following: 22
36+ (17) ATHLETICS; PUBLIC HIGH SCHOOL. — 23
37+ (b) Medical evaluation and electrocardiogram .—Students 24
38+must satisfactorily pass a medical evaluation each year and, if 25

53-Be It Enacted by the Legislature of the State of Florida: 28

55- Section 1. Paragraph (b) of subsection (17) of section 30
56-1002.20, Florida Statutes, is amended to read: 31
57- 1002.20 K-12 student and parent rights. Parents of public 32
58-school students must receive accurate and timely information 33
59-regarding their child's academic progress and must be informed 34
60-of ways they can help their child to succeed in school. K -12 35
61-students and their parents are afforded numerous statutory 36
62-rights including, but not limited to, the following: 37
63- (17) ATHLETICS; PUBLIC HIGH SCHOOL. — 38
64- (b) Medical evaluation and electrocardiogram .—Students 39
65-must satisfactorily pass a medical evaluation each year and, as 40
66-applicable under s. 1006.20, receive an electrocardiogram from 41
67-an appropriate health care practitioner or the school district 42
68-before participating i n athletics, unless the parent objects in 43
69-writing based on religious tenets or practices, in accordance 44
70-with the provisions of s. 1006.20(2)(d), or the school district 45
71-is unable to obtain a public or private partnership for the 46
72-provision of an electrocardi ogram pursuant to s. 1006.165 . 47
73- Section 2. Paragraphs (c) and (d) of subsection (2) of 48
74-section 1006.20, Florida Statutes, are amended, and paragraph 49
75-(n) is added to that subsection, to read: 50
51+applicable, an elect rocardiogram before participating in 26
52+athletics, unless the parent objects in writing based on 27
53+religious tenets or practices, in accordance with the provisions 28
54+of s. 1006.20(2)(d). 29
55+ Section 2. Paragraphs (c) and (d) of subsection (2) of 30
56+section 1006.20, Florida Statutes, are amended to read: 31
57+ 1006.20 Athletics in public K -12 schools.— 32
58+ (2) ADOPTION OF BYLAWS, POLICIES, OR GUIDELINES. — 33
59+ (c)1. The FHSAA shall adopt bylaws that require all 34
60+students participating in interscholastic athletic competition 35
61+or who are candidates for an interscholastic athletic team to 36
62+satisfactorily pass a medical evaluation each year before 37
63+participating in interscholastic athletic competition or 38
64+engaging in any practice, tryout, workout, conditioning, or 39
65+other physical activit y associated with the student's candidacy 40
66+for an interscholastic athletic team, including activities that 41
67+occur outside of the school year. Such medical evaluation may be 42
68+administered only by a practitioner licensed under chapter 458, 43
69+chapter 459, chapter 460, or s. 464.012 or registered under s. 44
70+464.0123, or a practitioner who holds an equivalent licensure 45
71+issued by another state, and in good standing with the 46
72+practitioner's regulatory board. The bylaws shall establish 47
73+requirements for eliciting a student' s medical history and 48
74+performing the medical evaluation required under this paragraph, 49
75+which shall include a physical assessment of the student's 50

89- (2) ADOPTION OF BYLAWS, POLICIES, OR GUIDELINES. — 52
90- (c)1. The FHSAA shall adopt bylaws that require all 53
91-students participating in interscholastic athletic competition 54
92-or who are candidates for an interscholastic athletic team to 55
93-satisfactorily pass a medical evaluation e ach year before 56
94-participating in interscholastic athletic competition or 57
95-engaging in any practice, tryout, workout, conditioning, or 58
96-other physical activity associated with the student's candidacy 59
97-for an interscholastic athletic team, including activities that 60
98-occur outside of the school year. Such medical evaluation and an 61
99-electrocardiogram required under subparagraph 2. may be 62
100-administered only by a practitioner licensed under chapter 458, 63
101-chapter 459, chapter 460, or s. 464.012 or registered under s. 64
102-464.0123, or a practitioner who holds an active equivalent 65
103-licensure issued by the state in which the medical evaluation 66
104-and electrocardiogram are performed, and in good standing with 67
105-the practitioner's regulatory board. The bylaws shall establish 68
106-requirements for eliciting a student's medical history and 69
107-performing the medical evaluation required under this paragraph, 70
108-which shall include a physical assessment of the student's 71
109-physical capabilities to participate in interscholastic athletic 72
110-competition as contained in a uniform preparticipation physical 73
111-evaluation and history form. The evaluation form shall 74
112-incorporate the recommendations of the American Heart 75
88+physical capabilities to participate in interscholastic athletic 51
89+competition as contained in a uniform prepart icipation physical 52
90+evaluation and history form. The evaluation form shall 53
91+incorporate the recommendations of the American Heart 54
92+Association for participation cardiovascular screening and shall 55
93+provide a place for the signature of the practitioner performin g 56
94+the evaluation with an attestation that each examination 57
95+procedure listed on the form was performed by the practitioner 58
96+or by someone under the direct supervision of the practitioner. 59
97+The form shall also contain a place for the practitioner to 60
98+indicate if a referral to another practitioner was made in lieu 61
99+of completion of a certain examination procedure. The form shall 62
100+provide a place for the practitioner to whom the student was 63
101+referred to complete the remaining sections and attest to that 64
102+portion of the examination. The preparticipation physical 65
103+evaluation form shall advise students to complete a 66
104+cardiovascular assessment and shall include information 67
105+concerning alternative cardiovascular evaluation and diagnostic 68
106+tests. Results of such medical evaluati on must be provided to 69
107+the school. A student is not eligible to participate, as 70
108+provided in s. 1006.15(3), in any interscholastic athletic 71
109+competition or engage in any practice, tryout, workout, or other 72
110+physical activity associated with the student's cand idacy for an 73
111+interscholastic athletic team until the results of the medical 74
112+evaluation have been received and approved by the school. 75

162-complete at least one electrocardiogram screening that meets the 101
163-requirements of s. 1006.165. 102
164- (d) Notwithstanding the provisions of paragraph (c), a 103
165-student may participate in interscholastic athletic competition 104
166-or be a candidate for an interscholastic athletic team if the 105
167-parent of the student objects in writing to the student 106
168-undergoing a medical evalua tion or receiving an 107
169-electrocardiogram because such evaluation or electrocardiogram 108
170-is contrary to his or her religious tenets or practices. 109
171-However, in such case, there shall be no liability on the part 110
172-of any person or entity in a position to otherwise r ely on the 111
173-results of such medical evaluation or electrocardiogram for any 112
174-damages resulting from the student's injury or death arising 113
175-directly from the student's participation in interscholastic 114
176-athletics where an undisclosed medical condition that would have 115
177-been revealed in the medical evaluation or electrocardiogram is 116
178-a proximate cause of the injury or death. 117
179- (n) The FHSAA shall adopt bylaws or policies that prohibit 118
180-a student athlete who receives an abnormal electrocardiogram 119
181-result from participati ng in tryouts, practice, or competition 120
182-until the student submits to the school a written medical 121
183-clearance to participate. Medical clearance must be authorized 122
184-by an appropriate health care practitioner listed in 123
185-subparagraph (c)1. who is trained in the d iagnosis, evaluation, 124
186-and management of electrocardiograms. There shall be no 125

199-liability on the part of a school district in a position to 126
200-otherwise rely on the results of the electrocardiogram and 127
201-medical clearance for any damages resulting from the studen t's 128
202-injury or death arising from a cardiac event due to the 129
203-student's participation in interscholastic athletics. 130
204- Section 3. Subsection (3) is added to section 1006.165, 131
205-Florida Statutes, to read: 132
206- 1006.165 Well-being of students participating in 133
207-extracurricular activities; training. — 134
208- (3) Each school district must pursue public and private 135
209-partnerships to provide low-cost electrocardiograms to the 136
210-student. A student athlete is exempt from the requirement i n s. 137
211-1006.20(2)(c)2. if he or she resides in a school district that 138
212-is unable to obtain a public or private partnership to provide 139
213-an electrocardiogram at a rate of less than $20 per student. 140
214- Section 4. This act shall take effect July 1, 2025. 141
125+ 2. In addition to the requirements of subparagraph 1., 76
126+each student who is in grades 9 through 12 and is participating 77
127+in interscholastic athletic competition or who is a candidate 78
128+for an interscholastic athletic team must also receive an 79
129+electrocardiogram. 80
130+ (d) Notwithstanding the provisions of paragraph (c), a 81
131+student may participate in interscholastic athletic competiti on 82
132+or be a candidate for an interscholastic athletic team if the 83
133+parent of the student objects in writing to the student 84
134+undergoing a medical evaluation or receiving an 85
135+electrocardiogram because such evaluation or electrocardiogram 86
136+is contrary to his or he r religious tenets or practices. 87
137+However, in such case, there shall be no liability on the part 88
138+of any person or entity in a position to otherwise rely on the 89
139+results of such medical evaluation or electrocardiogram for any 90
140+damages resulting from the studen t's injury or death arising 91
141+directly from the student's participation in interscholastic 92
142+athletics where an undisclosed medical condition that would have 93
143+been revealed in the medical evaluation or electrocardiogram is 94
144+a proximate cause of the injury or dea th. 95
145+ Section 3. This act shall take effect July 1, 2025. 96
