An act relating to solid waste facilities; prohibiting 2
state or local governmental entities from applying for 3
or approving permits for specified solid waste 4
facilities; providing an effective date. 5

Be It Enacted by the Legislature of the State of Florida: 7

Section 1. Notwithstanding any law to the contrary, a 9
state or local governmental entity may not apply for or approve 10
any permit under chapter 373, chapter 376, chapter 377, chapter 11
379, chapter 380, or chapter 403 , Florida Statutes, for any of 12
the following facilities that are proposed to be located within 13
2 miles of the Everglades Protection Area as defined in s. 14
373.4592(2), Florida Statutes, the Everglades Construction 15
Project as defined in s. 373.4592(4)(a), Florida Statutes, or 16
any water storage or conveyance structure constructed pursuant 17
to the Comprehensive Environmental Restoration Project funded 18
under s. 373.470, Florida Statutes, or funded pursuant to the 19
America's Water Infrastructure Act of 2018, the Water Resources 20
Development Act of 2000, the Water Infrastructure Improvements 21
for the Nation Act, or the Surface Water Improvement Management 22
Act: 23
(1) A solid waste facility as defined in s. 377.709(2), 24
Florida Statutes. 25

(2) A municipal solid waste -to-energy facility as defined 26
in s. 377.814(2), Florida Statutes. 27
(3) A pyrolysis facility as defined in s. 403.703, Florida 28
Statutes. 29
(4) To the extent that it includes incineration of any 30
type, a solid waste disposal facility as defined in s. 403.703, 31
Florida Statutes. 32
(5) A solid waste management facility as defined in s. 33
403.703, Florida Statutes. 34
Section 2. This act shall take effect July 1, 2025. 35
