5757 (2)(a) Except as otherwise provided in subsection (3), a 32
5858 political subdivision may not establish, mandate, maintain, or 33
5959 otherwise require an employer to pay a minimum wage, other than 34
6060 a state or federal minimum wage, to apply a state or federal 35
6161 minimum wage to wages exempt from a state or federal minimum 36
6262 wage, or to provide employment benefits not otherwise required 37
6363 by state or federal law. 38
6464 (b) A political subdivision may not through its purchasing 39
6565 or contracting procedures seek to control or affect the wages or 40
6666 employment benefits provided by its vendors, contractors, 41
6767 service providers, or other parties doing business with the 42
6868 political subdivision. 43
6969 (c) A political subdivision may not through the use of 44
7070 evaluation factors, qualification of bidders, or otherwise, 45
7171 award preferences on the basis of wages or employment benefits 46
7272 provided by vendors, contractors, service providers, or other 47
7373 parties doing business with the political subdivision. 48
7474 (3) This section does not: 49

141141 limitation imposed in this subparagraph on a form prescribed by 92

143143 (b) On any school day, minors 16 and 17 years of age who 94
144144 are not enrolled in a career education program m ay not be 95
145145 gainfully employed during school hours. 96
146146 (3) Minors 15 years of age or younger may not be employed, 97
147147 permitted, or suffered to work in any gainful occupation for 98
148148 more than 6 consecutive days in any one week. 99

168168 day as authorized by this section may not be employed, 107
169169 permitted, or suffered to work for more than 4 hours 108
170170 continuously without an interval of at least 30 minutes for a 109

172172 (5) Subsections (1) -(4), except in accordance with federal 111
173173 law, do not apply to: 112
174174 (a) Minors 14, 15, 16, and 17 years of age who have 113
175175 graduated from high school or received a high school equ ivalency 114
176176 diploma. 115
177177 (b) Minors who are within the compulsory school attendance 116
178178 age limit and who hold a valid certificate of exemption issued 117
179179 by the school superintendent or his or her designee pursuant to 118
180180 s. 1003.21(3). 119
181181 (c) Minors enrolled in a public an educational institution 120
182182 who qualify on a hardship basis, such as economic necessity or 121
183183 family emergency. The school superintendent or his or her 122
184184 designee shall make such determination and issue a waiver of 123
185185 hours to the minor and the employer. The form a nd contents 124

205205 (6) The department may grant a waiver of the restrictions 132
206206 imposed by this section pursuant to s. 450.095. 133
207207 (6)(7) The presence of a minor in any place of employment 134
208208 during working hours is prima facie evidence of his or her 135

210210 (7)(8) A violation of this section is An employer who 137
211211 requires, schedules, or otherwise causes a minor to be employed, 138
212212 permitted, or suffered to work in violation of this section 139
213213 commits a violation of the law, punishable as provided in s. 140

215215 Section 5. Except as otherwise expressly provided in this 142
216216 act, this act shall take effect July 1, 2025. 143
