25	25	Be It Enacted by the Legislature of the State of Florida: 12

27	27	Section 1. Subsection (1) of section 765.514, Florida 14
28	28	Statutes, is amended to read: 15
29	29	765.514 Manner of making anatomical gifts .— 16
30	30	(1) A person, or a minor under 18 years of age with 17
31	31	informed parental consent, may make an anatomical gift of all or 18
32	32	part of his or her body under s. 765.512(1) by: 19
33	33	(a) Signing an organ and tissue donor card. The department 20
34	34	shall, at the time of sig nature: 21
35	35	1. Provide education regarding organ and tissue donation 22
36	36	options and methods of making changes to the election. 23
37	37	2. Collect informed consent from the donor. 24
38	38	3. Provide organ and tissue donation options. 25

56	56	Revocation, suspension, expiration, or cancellation of the 31
57	57	driver license or identification card does not invalidate the 32

59	59	(d) Expressing a wish to donate in a living will or other 34
60	60	advance directive. 35
61	61	(e) Executing a will that includes a provision indicating 36
62	62	that the testator wishes to make an anatomical g ift. The gift 37
63	63	becomes effective upon the death of the testator without waiting 38
64	64	for probate. If the will is not probated or if it is declared 39
65	65	invalid for testamentary purposes, the gift is nevertheless 40
66	66	valid to the extent that it has been acted upon in good faith. 41
67	67	(f) Expressing a wish to donate in a document other than a 42
68	68	will. The document must be signed by the donor in the presence 43
69	69	of two witnesses who shall sign the document in the donor's 44
70	70	presence. If the donor cannot sign, the document may be signed 45
71	71	for him or her at the donor's direction and in his or her 46
72	72	presence and the presence of two witnesses who must sign the 47
73	73	document in the donor's presence. Delivery of the document of 48
74	74	gift during the donor's lifetime is not necessary to make the 49

126	126	(a) The development, implementation, and maintenance of an 77
127	127	interactive web-based donor registry that, through electronic 78
128	128	means, allows for user-friendly online organ donor registration 79
129	129	and the recording, selection, and editing of organ and tissue 80
130	130	donation records submitted through the driver license 81
131	131	identification program or through other sources. 82
132	132	1. The registry must be mainta ined in a manner that 83
133	133	allows, through electronic and telephonic methods, immediate 84
134	134	access to organ and tissue donation records 24 hours a day, 7 85
135	135	days a week. 86
136	136	2. Access to the registry must be through coded and secure 87
137	137	means to protect the integrity of the data in the registry. 88
138	138	(b) A continuing program to educate and inform medical 89
139	139	professionals, law enforcement agencies and officers, other 90
140	140	state and local government employees, high school students, 91
141	141	minorities, and the public about the laws of this state relating 92
142	142	to anatomical gifts and the need for anatomical gifts. 93
143	143	1. Existing community resources, when available, must be 94
144	144	used to support the program and volunteers may assist the 95
145	145	program to the maximum extent possible. 96
146	146	2. The contractor shall coordinat e with the head of a 97
147	147	state agency or other political subdivision of the state, or his 98
148	148	or her designee, to establish convenient times, dates, and 99
149	149	locations for educating that entity's employees. 100
