29- Section 1. Section 23.46, Florida Statutes, is created t o 16

32- (1) In order to protect the privacy and rights of 19
33-individuals participating in Hope Florida, the personal 20
34-identifying information provided to the Hope Florida Office by 21
35-an individual, as well as the personal identifyi ng information 22
36-provided by an individual to a Hope Navigator, is confidential 23
37-and exempt from s. 119.07(1) and s. 24(a), Art. I of the State 24
38-Constitution. 25

26+Be It Enacted by the Legislature of the State of Florida: 13

28+ Section 1. Section 23.46, Florida Statutes, is created to 15

32+individuals participating in Hope Florida, the personal 19
33+identifying information provided to the Hope Florida Office by 20
34+an individual, as well as the personal identifying information 21

51- (2) The Hope Florida Office shall allow access to 26
52-confidential and exempt information in the Hope F lorida case 27
53-management system: 28
54- (a) To an employee of a participating state agency for 29
55-purposes of periodic reporting or disclosure of information that 30
56-has been redacted to exclude personal identifying information. 31
57- (b) At the direction of the Governor o r the Hope Florida 32
58-partner network. 33
59- (c) An employee of the Hope Florida Office for purposes of 34
60-approving or disapproving a request for additional assistance 35
61-within the purview of Hope Florida. 36
62- (3) All information released by the office under 37
63-subsection (2) remains confidential and exempt, and a person who 38
64-receives access to such information must maintain the 39
65-confidential and exempt status of the information received. 40
66- (4) A person who willfully and knowingly violates this 41
67-section commits a felony of t he third degree, punishable as 42
68-provided in s. 775.082 or s. 775.083. 43
69- (5) This section is subject to the Open Government Sunset 44
70-Review Act in accordance with s. 119.15 and shall stand repealed 45
71-on October 2, 2030, unless reviewed and saved from repeal 46
72-through reenactment by the Legislature. 47
73- Section 2. The Legislature finds that it is a public 48
74-necessity to make the personal identifying information of Hope 49
75-Florida participants contained in records held by the Office of 50

88-Hope Florida and any other state age ncy participating in the 51
89-Hope Florida program confidential and exempt from public records 52
90-requirements. In fulfilling the program's mission, the Hope 53
91-Florida program collects personal identifying information 54
92-regarding program participants in order to assis t and serve 55
93-residents of this state who are often in vulnerable situations 56
94-and subject to abuse or exploitation. Allowing the public 57
95-unfettered access to participant data could impair the effective 58
96-and efficient administration of the program and otherwise 59
97-discourage individuals and families from seeking support through 60
98-Hope Florida's resources. 61
99- Section 3. This act shall take effect on the same date 62
100-that HB 1327 or similar legislation takes effect , if such 63
101-legislation is adopted in the same legislative session or an 64
102-extension thereof and becomes a law. 65
