28-Be It Enacted by the Legislature of the State of Florida: 15

30- Section 1. Paragraph (i) of subsection (1) of section 17
31-255.065, Florida Statutes, is amended to read: 18
32- 255.065 Public-private partnerships. — 19
33- (1) DEFINITIONS.—As used in this section, the term: 20
34- (i) "Qualifying project" means: 21
35- 1. A facility or project that serves a public purpose , 22
36-including, but not limited to, any ferry or mass transit 23
37-facility, vehicle parking facility, airport or seaport facility, 24
38-rail facility or project, fuel supply facility, oil or gas 25
16+creating s. 14.2032, F.S.; establishing the Public -3
17+private Partnership Oversight Authority within the 4
18+Executive Office of the Governor for a specified 5
19+purpose; providing the membership of the authority; 6
20+requiring the authority to choose certain projects to 7
21+manage; requiring certain reporting and updates in a 8
22+specified manner; creating s. 380.0931, F.S.; creating 9
23+the Public-private Partnership Infrastructure Program 10
24+within the Executive Office of the Governor; providing 11
25+the purpose of the program; requiring the program to 12
26+create a fund from specified sources for a specified 13
27+purpose; requiring the program to create a portfolio 14
28+of certain projects; exempting projects that are part 15
29+of the program from certain laws; authorizing the 16
30+program to work with certain entities for a specified 17
31+purpose; requiring the Public -private Partnership 18
32+Oversight Authority to adopt rules; pr oviding an 19

51-pipeline, medical or nursing care facility, recreational 26
52-facility, sporting or cultural facility, or educational facility 27
53-or other building or facility that is used or will be used by a 28
54-public educational institution, or any other public facility or 29
55-infrastructure that is used or will be used by the public at 30
56-large or in support of an accepted public purpose or activity; 31
57- 2. An improvement, including equipment, of a building that 32
58-will be principally used by a public entity or the public at 33
59-large or that supports a service delivery system in the public 34
60-sector; 35
61- 3. A water, wastewater, or surface water management 36
62-facility or other related infrastructure; 37
63- 4. A coastal resiliency project as defined in s. 380.0934; 38
64-or 39
65- 5.4. Notwithstanding any provision of this section, for 40
66-projects that involve a facility owned or operated by th e 41
67-governing board of a county, district, or municipal hospital or 42
68-health care system, or projects that involve a facility owned or 43
69-operated by a municipal electric utility, only those projects 44
70-that the governing board designates as qualifying projects 45
71-pursuant to this section. 46
72- Section 2. Section 380.0934, Florida Statutes, is created 47
73-to read: 48
74- 380.0934 Public-private partnerships for coastal 49
75-resiliency projects. — 50
51+ 14.2032 Public-private Partnership Oversight Authority. — 26
52+ (1) The Public-private Partnership Oversight Authority is 27
53+established within the Executive Office of the Governor to 28
54+manage the Public-private Partnership Infrastructure Program. 29
55+ (2) The Public-private Partnership Oversight Authority is 30
56+made up of the following members: 31
57+ (a) The Secretary of Transportation or his or her 32
58+designee. 33
59+ (b) The Secretary of Environmental Protection or his or 34
60+her designee. 35
61+ (c) The director of the Division of Emergency Management 36
62+or his or her designee. 37
63+ (d) Two private-sector experts on public -private 38
64+partnerships, infrastructure, or resiliency. 39
65+ (3) The Public-private Partnership Oversight Authority 40
66+shall choose projects from the portfolio created under s. 41
67+380.0931(4). The Public -private Partnership Oversight Authority 42
68+shall serve as project managers on su ch projects. 43
69+ (4) The Public-private Partnership Oversight Authority 44
70+shall report annually on the projects developed under the 45
71+Public-private Partnership Infrastructure Program. The status of 46
72+individual projects must be updated in real time on a publicly 47
73+available website. 48

88- (1) DEFINITIONS.—As used in this section, the term: 51
89- (a) "Coastal resiliency project" means: 52
90- 1. The planning, contracting, and execution of a project 53
91-to address flooding and sea level rise in a coastal or inland 54
92-community in this state pursuant to s. 380.093(5); 55
93- 2. Public infrastructure repair and upgrades to seawalls 56
94-and stormwater drainage; and 57
95- 3. Resiliency measures designed to withstand extreme 58
96-weather, mitigate flooding, and prevent coastal erosion, 59
97-including: 60
98- a. Acquisition of at -risk coastal and flood -prone 61
99-properties; 62
100- b. Acquisition of properties in areas at high risk of 63
101-flooding; 64
102- c. Infrastructure hardening and development of natural 65
103-barriers; 66
104- d. Construction of large -scale seawalls, levees, and 67
105-elevated flood barriers; or 68
106- e. Expansion and restoration of natural protective 69
107-systems. 70
108- (b) "Department" means the Departm ent of Environmental 71
109-Protection. 72
110- (c) "Public-private partnership" means a coastal 73
111-resiliency project entered into by the department under s. 74
112-255.065. 75

89+Program.— 52
90+ (1) The Public-private Partnership Infrastructure Program 53
91+is created within the Executive Office of t he Governor under the 54
92+authority of the Public -private Partnership Oversight Authority 55
93+established in s. 14.2032. 56
94+ (2) The purpose of the program is to foster private 57
95+investment in infrastructure and resiliency projects by having a 58
96+single point of contact for project management. 59
97+ (3) The Public-private Partnership Infrastructure Program 60
98+shall create a fund that collects allocated funds, bond 61
99+issuance, disaster mitigation reserves, grants, and 62
100+contributions from the public. Such fund shall be used for 63
101+projects selected by the Public -private Partnership Oversight 64
102+Authority. 65
103+ (4) The Public-private Partnership Infrastructure Program 66
104+shall create a portfolio of potential projects for: 67
105+ (a) Critical public infrastructure repair and upgrades to 68
106+seawalls, stormwater drainage, and other resilience -related 69
107+projects. 70
108+ (b) Resiliency measures designed to withstand extreme 71
109+weather, mitigate flooding, and combat coastal erosion. Such 72
110+measures include: 73
111+ 1. Bulk acquisition of at -risk coastal and flood -prone 74
112+properties for resiliency infrastructure development. 75

125- (2) The department shall have the exclusive authority to 76
126-execute coastal resiliency projects through p ublic-private 77
127-partnerships under s. 255.065. 78
128- (3) To encourage investment from the private sector in 79
129-coastal resiliency projects, the department may: 80
130- (a) Enter into long -term revenue-sharing agreements. 81
131- (b) Provide expedited permitting for constructio n. 82
132- (c) Seek comments from local governments and the public 83
133-during project planning and execution and incorporate actions 84
134-responsive to such comments into the project. 85
135- (d) Engage in-state vocational schools and apprenticeship 86
136-programs to train workers i n specialized resiliency 87
137-construction. 88
138- (4) The department shall publish biennial progress reports 89
139-for each coastal resiliency project funded through a public -90
140-private partnership, including project milestones, expenditures, 91
141-and public benefits, on the dep artment's website. The department 92
142-shall also create and maintain on its website an online 93
143-dashboard for real-time updates on project execution. 94
144- Section 3. This act shall take effect upon becoming a law. 95

132+ (5) Notwithstanding any other law, a Public -private 83
133+Partnership Infrastructure Program project is exempt from all 84
134+permitting, zoning, procurement, or other laws that would delay 85
135+the completion of the project. 86
136+ (6) The Public-private Partnership Infrastructure Program 87
137+may work with vocational schools and apprenticeship programs to 88
138+train workers in resiliency construction. 89
139+ (7) The Public-private Partnership Oversight Authority 90
140+shall adopt rules to implement this section. 91
141+ Section 3. This act shall take effect upon becoming a law. 92
