3131 Section 1. Section 411.2035, Florida Statutes, is amended 18

3636 (1) Every hospital, birthing facility, and provider of 23
3737 home birth which has maternity and newborn services shall 24

5454 (1)(2) The Department of Health shall adopt evidence-based 29

5858 education materials may be provided using written, visual, or 33
5959 electronic applications. The materials description must include, 34
6060 but need not be limited to, information concerning all of the 35

6262 (a) The grave effects of shaking infants and young 37
6363 children., information concerning 38
6464 (b) Appropriate ways to manage the causes that can lead a 39
6565 person to shake or harm infants and young children, including 40
6666 normal infant crying, fussing, and other causes. 41
6767 (c) a discussion of Ways to reduce the risks that can lead 42
6868 a person to shake or harm infants and young children. 43
6969 (d) Evidence-based practices for safe infant sleep and the 44
7070 dangers associated with unsafe sleep environments for infants. 45
7171 (e) Information on the importance of carefully selecting a 46
7272 trusted and responsible caregiver, including warning signs of 47
7373 potential risk factors. 48
7474 (2)(a) The evidence -based parent education materials 49
7575 adopted by the Department of Health under subsection (1) must be 50

8989 1. Each hospital, birth center, and home birth provider 52
9090 providing maternity, prenatal, and newborn services shall 53
9191 provide the parent education materials to the parents or 54
9292 caregivers of a newborn within the first 2 week s after the birth 55
9393 of the infant. 56
9494 2. Childbirth educators, pediatric physician practices, 57
9595 home visiting programs, and obstetrician practices shall provide 58
9696 the parent education materials to the expectant parents or 59
9797 caregivers receiving education or health care services from them 60
9898 or, if parents or caregivers have already received the parent 61
9999 education materials, reiterate or reinforce the information 62
100100 covered by such materials. 63
101101 3. The department shall adopt a statewide multimedia 64
102102 public education campaign to prevent instances of abusive head 65
103103 trauma, including shaken baby syndrome, using the parent 66
104104 education materials adopted under subsection (1) or the 67
105105 information covered by the materials. 68
106106 (b) The department shall implement a mul ti-year phase-in 69
107107 plan for the distribution of the parent education materials, 70
108108 beginning with the counties with the six highest birth rates. 71
109109 (3) This section does not preclude a hospital, a birth 72
110110 center birthing facility, or a home birth provider , a childbirth 73
111111 educator, a pediatric physician practice, a home visiting 74
112112 program, or an obstetrician practice from providing the parent 75

126126 addendum to, or in connection with, any other required 77

128128 (4) A cause of action does not accrue against the state or 79
129129 any subdivision or agency thereof or any hospital , birth center, 80
130130 home birth birthing facility or home -birth provider, childbirth 81
131131 educator, pediatric physician practice, home visiting pro gram, 82
132132 or an obstetrician practice for failure to give or receive the 83
133133 information required under this section. 84
134134 Section 2. This act shall take effect July 1, 2025. 85
