Paragraphs (k), (n), and (o) of subsection (2), 15 paragraphs (a), (f), and (g) of subsection (6), subse ction (8), 16 and paragraph (a) of subsection (10) of section 775.21, Florida 17 Statutes, are amended to read: 18 775.21 The Florida Sexual Predators Act. — 19 (2) DEFINITIONS.—As used in this section, the term: 20 (k) "Permanent residence" means a place where the person 21 abides, lodges, or resides for 3 or more consecutive days that 22 is the person's home or other place where the person primarily 23 lives. A day includes any part of a calendar day. 27 (n)1. "Temporary residence" means a place where the person 28 abides, lodges, or resides, including, but not limited to, 29 vacation, business, or personal travel destinations in or out of 30 this state, for a period of 3 or more days in the aggregate 31 during any calendar year that and which is not the person's 32 permanent or transient residence. address or, For a person whose 33 permanent residence is not in this state, the term also includes 34 a place where the person is employed, practices a vocation, or 35 is enrolled as a student for any period of time in this state. 36 2. The term includes an "in -state travel residence," which 37 means a temporary residence in this state established by a 38 person who already has an existing permanent, temporary, or 39 transient residence in this state. 40 41 For the purpose of calculating a temporary residence under this 42 paragraph, the first day that a person abides, lodges, or 43 resides at a place is excluded and each subsequent day is 44 counted. A day includes any part of a calendar day. 45 (o) "Transient residence" means a county where the person 46 lives, remains, or is located for the purpose of abiding, 47 lodging, or residing for a period of 3 or more days in the 48 aggregate during a calendar year that and which is not the 49 person's permanent or temporary residence address. For the purpose of calculating a transient residence 53 under this paragraph, the first day that a person lives, 54 remains, or is located in a county for the purpose of abiding, 55 lodging, or residing is excluded and each subsequent day is 56 counted. A day includes any part of a calendar day. 57 (6) REGISTRATION.— 58 (a) A sexual predator shall register with the department 59 through the sheriff's office by providing the following 60 information to the department: 61 1. Name; social security number; age; r ace; sex; date of 62 birth; height; weight; tattoos or other identifying marks; hair 63 and eye color; photograph; address of permanent or legal 64 residence and address of any current temporary residence, within 65 this state or out of state, including a rural route address and 66 a post office box; if he or she has no permanent or temporary 67 address, any transient residence within this state; address, 68 location or description, and dates of any current or known 69 future temporary residence within this state or out of state; 70 electronic mail addresses; Internet identifiers and each 71 Internet identifier's corresponding website homepage or 72 application software name; home telephone numbers and cellular 73 telephone numbers; employment information , including occupation, 74 business name, employment address, and telephone number ; the 75 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 4 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S make, model, color, vehicle identification number (VIN), and 76 license tag number of all vehicles owned; date and place of each 77 conviction; fingerprints; palm prints; and a brief description 78 of the crime or crime s committed by the sexual predator 79 offender. A post office box may not be provided in lieu of a 80 physical residential address. The sexual predator shall also 81 produce his or her passport, if he or she has a passport, and, 82 if he or she is an alien, shall prod uce or provide information 83 about documents establishing his or her immigration status. The 84 sexual predator shall also provide information about any 85 professional licenses he or she has. 86 a. Any change that occurs after the sexual predator 87 registers in person at the sheriff's office as provided in this 88 subparagraph in any of the following information related to the 89 sexual predator must be reported as provided in paragraphs (g), 90 (i), and (j): permanent, temporary, or transient residence; 91 name; electronic mail addresses; Internet identifiers and each 92 Internet identifier's corresponding website homepage or 93 application software name; home and cellular telephone numbers; 94 employment information; and status at an institution of higher 95 education. 96 b. If the sexual predator's place of residence is a motor 97 vehicle, trailer, mobile home, or manufactured home, as those 98 terms are defined in chapter 320, the sexual predator shall also 99 provide to the department written notice of the vehicle 100 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 5 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S identification number (VIN); the license tag number; the 101 registration number; and a description, including color scheme, 102 of the motor vehicle, trailer, mobile home, or manufactured 103 home. If a sexual predator's place of residence is a vessel, 104 live-aboard vessel, or houseboat, as those terms are defined in 105 chapter 327, the sexual predator shall also provide to the 106 department written notice of the hull identification number; the 107 manufacturer's serial number; the name of the vessel, live -108 aboard vessel, or houseboat; the registration number of the 109 vessel, live-aboard vessel, or houseboat; and a description, 110 including color scheme, of the vessel, live -aboard vessel, or 111 houseboat. 112 c. If the sexual predator is enrolled or employed, whether 113 for compensation or as a volunteer, at an institution of higher 114 education in this state, the sexual predator shall also provide 115 to the department the name, address, and county of each 116 institution, including each campus attended, and the sexual 117 predator's enrollment, volunteer, or employment status. The 118 sheriff, the Department of Corrections, or the Department of 119 Juvenile Justice shall promptly notify each institution of 120 higher education of the sexual predator's presence and any 121 change in the sexual predator's enrollment, volunteer, or 122 employment status. 123 d. A sexual predator shall report to the department 124 through the department's online system or in person to the 125 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 6 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S sheriff's office within 48 hours after any change in vehicles 126 owned to report those vehicle information changes. A sexual 127 predator who is under the supervision of the Department of 128 Corrections, or under the supervision of the Department of 129 Juvenile Justice shall report in person to the sheriff's office 130 within 48 hours after any change in vehicles owned to report 131 those vehicle information changes. 132 2. Any other information determined necessary by the 133 department, including criminal and corrections records; 134 nonprivileged personnel and treatment records; and evidentiary 135 genetic markers when available. 136 (f) Within 48 hours after the registration required under 137 paragraph (a) or paragraph (e), a sexual predator who is not 138 incarcerated and who resides in the community, including a 139 sexual predator under the supervision of the Department of 140 Corrections, shall report register in person at a driver license 141 office of the Department of Highway Safety and Motor Vehicles 142 and shall present proof of registration unless a driver license 143 or an identification card that complies with the requirements of 144 s. 322.141(3) was previously secured or updated under s. 145 944.607. At the driver license office the sexual predator shall: 146 1. If otherwise qualified, secure a Florida driver 147 license, renew a Florida driver license, or secure an 148 identification card. The sexual predator shall identify himself 149 or herself as a sexual predator wh o is required to comply with 150 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 7 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S this section, provide his or her place of permanent, temporary, 151 or transient residence, including a rural route address and a 152 post office box, and submit to the taking of a photograph for 153 use in issuing a driver license, a rene wed license, or an 154 identification card, and for use by the department in 155 maintaining current records of sexual predators. A post office 156 box may not be provided in lieu of a physical residential 157 address. If the sexual predator's place of residence is a moto r 158 vehicle, trailer, mobile home, or manufactured home, as those 159 terms are defined in chapter 320, the sexual predator shall also 160 provide to the Department of Highway Safety and Motor Vehicles 161 the vehicle identification number (VIN); the license tag number; 162 the registration number; and a description, including color 163 scheme, of the motor vehicle, trailer, mobile home, or 164 manufactured home. If a sexual predator's place of residence is 165 a vessel, live-aboard vessel, or houseboat, as those terms are 166 defined in chapter 327, the sexual predator shall also provide 167 to the Department of Highway Safety and Motor Vehicles the hull 168 identification number; the manufacturer's serial number; the 169 name of the vessel, live -aboard vessel, or houseboat; the 170 registration number of the vessel, live-aboard vessel, or 171 houseboat; and a description, including color scheme, of the 172 vessel, live-aboard vessel, or houseboat. 173 2. Pay the costs assessed by the Department of Highway 174 Safety and Motor Vehicles for issuing or renewing a driver 175 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 8 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S license or an identification card as required by this section. 176 The driver license or identification card issued to the sexual 177 predator must comply with s. 322.141(3). 178 3. Provide, upon request, any additional information 179 necessary to confirm the identity of the sexual predator, 180 including a set of fingerprints. 181 (g)1.a. Each time a sexual predator's driver license or 182 identification card is subject to renewal, and, without regard 183 to the status of the sexual predator's driver license or 184 identification card, wi thin 48 hours after any change of the 185 sexual predator's residence or change in the sexual predator's 186 name by reason of marriage or other legal process, the sexual 187 predator shall report in person to a driver license office and 188 is subject to the requirements specified in paragraph (f). The 189 Department of Highway Safety and Motor Vehicles shall forward to 190 the department and to the Department of Corrections all 191 photographs and information provided by sexual predators. 192 Notwithstanding the restrictions set forth i n s. 322.142, the 193 Department of Highway Safety and Motor Vehicles may release a 194 reproduction of a color -photograph or digital -image license to 195 the Department of Law Enforcement for purposes of public 196 notification of sexual predators as provided in this sec tion. A 197 sexual predator who is unable to secure or update a driver 198 license or an identification card with the Department of Highway 199 Safety and Motor Vehicles as provided in paragraph (f) and this 200 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 9 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S paragraph shall also report any change in the sexual predato r's 201 permanent, temporary, or transient residence or change in the 202 sexual predator's name by reason of marriage or other legal 203 process within 48 hours after the change in person to the 204 sheriff's office in the county where the sexual predator resides 205 or is located and provide confirmation that he or she reported 206 such information to the Department of Highway Safety and Motor 207 Vehicles. The reporting requirements under this sub-subparagraph 208 subparagraph do not negate the requirement for a sexual predator 209 to obtain a Florida driver license or identification card as 210 required by this section. This sub-subparagraph does not apply 211 to an in-state travel residence. 212 b. A sexual predator shall report an in -state travel 213 residence within 48 hours after establishing the re sidence. The 214 report shall be made through the department's online system; in 215 person at the sheriff's office in the county in which the sexual 216 predator is located; in person at the Department of Corrections 217 if the sexual predator is in the custody or contro l of, or under 218 the supervision of the Department of Corrections; or in person 219 at the Department of Juvenile Justice if the sexual predator is 220 in the custody or control of, or under the supervision of the 221 Department of Juvenile Justice. 222 2.a. A sexual predator who vacates a permanent, temporary, 223 or transient residence and fails to establish or maintain 224 another permanent, temporary, or transient residence shall, 225 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 10 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S within 48 hours after vacating the permanent, temporary, or 226 transient residence, report in person to the sheriff's office of 227 the county in which he or she is located. The sexual predator 228 shall specify the date upon which he or she intends to or did 229 vacate such residence. The sexual predator shall provide or 230 update all of the registration information r equired under 231 paragraph (a). The sexual predator shall provide an address for 232 the residence or other place where he or she is or will be 233 located during the time in which he or she fails to establish or 234 maintain a permanent or temporary residence. 235 b. A sexual predator shall report in person at the 236 sheriff's office in the county in which he or she is located 237 within 48 hours after establishing a transient residence and 238 thereafter must report in person every 30 days to the sheriff's 239 office in the county in wh ich he or she is located while 240 maintaining a transient residence. The sexual predator must 241 provide the addresses and locations where he or she maintains a 242 transient residence. Each sheriff's office shall report 243 transient residence information in a manner p rescribed by the 244 department and provide notice to transient registrants to report 245 transient residence information as required in this sub -246 subparagraph. Reporting to the sheriff's office as required by 247 this sub-subparagraph does not exempt registrants from any 248 reregistration requirement. The sheriff may coordinate and enter 249 into agreements with police departments and other governmental 250 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 11 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S entities to facilitate additional reporting sites for transient 251 residence registration required in this sub -subparagraph. The 252 sheriff's office shall electronically submit to and update with 253 the department all such information within 2 business days after 254 the sexual predator provides it to the sheriff's office. 255 3. A sexual predator who remains at a permanent, 256 temporary, or transient residence after reporting his or her 257 intent to vacate such residence shall, within 48 hours after the 258 date upon which the sexual predator indicated he or she would or 259 did vacate such residence, report in person to the sheriff's 260 office to which he or she reported pursuant to subparagraph 2. 261 for the purpose of reporting his or her address at such 262 residence. When the sheriff receives the report, the sheriff 263 shall promptly convey the information to the department. A 264 sexual predator who makes a report as required under 265 subparagraph 2. but fails to make a report as required under 266 this subparagraph commits a felony of the second degree, 267 punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 268 4. The failure of a sexual predator who maintains a 269 transient residence to report in person to the sheriff's office 270 every 30 days as required by sub -subparagraph 2.b. is punishable 271 as provided in subsection (10). 272 5.a. A sexual predator shall register all electronic mail 273 addresses and Internet identifiers, and each Internet 274 identifier's corresponding website homepage or application 275 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 12 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S software name, with the department through the department's 276 online system or in person at the sheriff's office within 48 277 hours after using such electronic mail addresses or Internet 278 identifiers. If the sexual predator is in the custody or 279 control, or under the supervision, of the Department of 280 Corrections, he or she must report all electronic mail addresses 281 and Internet identifiers, and each Internet identifier's 282 corresponding website homepage or application software name, to 283 the Department of Corrections before using such electronic mail 284 addresses or Internet identifiers. If the sexual predator is in 285 the custody or control, or under the supervision, of the 286 Department of Juvenile Justi ce, he or she must report all 287 electronic mail addresses and Internet identifiers, and each 288 Internet identifier's corresponding website homepage or 289 application software name, to the Department of Juvenile Justice 290 before using such electronic mail addresses or Internet 291 identifiers. 292 b. A sexual predator shall register all changes to 293 vehicles owned, all changes to home telephone numbers and 294 cellular telephone numbers, including added and deleted numbers, 295 all changes to employment information, including the creation of 296 a new business if self -employed, and all changes in status 297 related to enrollment, volunteering, or employment at 298 institutions of higher education, through the department's 299 online system; in person at the sheriff's office; in person at 300 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 13 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S the Department of Corrections if the sexual predator is in the 301 custody or control, or under the supervision, of the Department 302 of Corrections; or in person at the Department of Juvenile 303 Justice if the sexual predator is in the custody or control, or 304 under the supervision, of the Department of Juvenile Justice. 305 All changes required to be reported in this sub -subparagraph 306 shall be reported within 48 hours after the change. 307 c. The department shall establish an online system through 308 which sexual predators may securely a ccess, submit, and update 309 all changes in status to in -state travel residences; all 310 vehicles owned; electronic mail addresses; Internet identifiers 311 and each Internet identifier's corresponding website homepage or 312 application software name; home telephone nu mbers and cellular 313 telephone numbers; employment information; and institution of 314 higher education information. 315 (8) VERIFICATION.—The department and the Department of 316 Corrections shall implement a system for verifying the addresses 317 of sexual predators. Th e system must be consistent with the 318 federal Adam Walsh Child Protection and Safety Act of 2006 and 319 any other federal standards applicable to such verification or 320 required to be met as a condition for the receipt of federal 321 funds by the state. The Departme nt of Corrections shall verify 322 the addresses of sexual predators who are not incarcerated but 323 who reside in the community under the supervision of the 324 Department of Corrections and shall report to the department any 325 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 14 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S failure by a sexual predator to comply w ith registration 326 requirements. County and local law enforcement agencies, in 327 conjunction with the department, shall verify the addresses of 328 sexual predators who are not under the care, custody, control, 329 or supervision of the Department of Corrections at least four 330 times per calendar year , and may verify the addresses of sexual 331 predators who are under the care, custody, control, or 332 supervision of the Department of Corrections. Local law 333 enforcement agencies shall report to the department any failure 334 by a sexual predator to comply with registration requirements. 335 (a) A sexual predator shall report in person each year 336 during the month of the sexual predator's birthday and during 337 every third month thereafter to the sheriff's office in the 338 county in which he or she resides or is otherwise located to 339 reregister. The sheriff's office may determine the appropriate 340 times and days for reporting by the sexual predator, which must 341 be consistent with the reporting requirements of this paragraph. 342 Reregistration must inclu de any changes to the following 343 information: 344 1. Name; social security number; age; race; sex; date of 345 birth; height; weight; tattoos or other identifying marks; hair 346 and eye color; address of any permanent residence and address of 347 any current temporary r esidence, within this state or out of 348 state, including a rural route address and a post office box; if 349 he or she has no permanent or temporary address, any transient 350 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 15 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S residence within this state including the address, location or 351 description of the transien t residences, and dates of any 352 current or known future temporary residence within this state or 353 out of state; all electronic mail addresses; all Internet 354 identifiers and each Internet identifier's corresponding website 355 homepage or application software name ; all home telephone 356 numbers and cellular telephone numbers; date and place of any 357 employment information, including occupation, business name, 358 employment address, and telephone number ; the make, model, 359 color, vehicle identification number (VIN), and license tag 360 number of all vehicles owned; fingerprints; palm prints; and 361 photograph. A post office box may not be provided in lieu of a 362 physical residential address. The sexual predator shall also 363 produce his or her passport, if he or she has a passport, a nd, 364 if he or she is an alien, shall produce or provide information 365 about documents establishing his or her immigration status. The 366 sexual predator shall also provide information about any 367 professional licenses he or she has. 368 2. If the sexual predator's place of residence 381 is a vessel, live-aboard vessel, or houseboat, as those terms 382 are defined in chapter 327, the sexual predator shall also 383 provide the hull identification number; the manufacturer's 384 serial number; the name of the vessel, live -aboard vessel, or 385 houseboat; the registration number of the vessel, live -aboard 386 vessel, or houseboat; and a description, including color scheme, 387 of the vessel, live-aboard vessel, or houseboat. 388 (b) The sheriff's office shall electronically submit to 389 and update with the department, in a manner prescribed by the 390 department, all such information within 2 business days after 391 the sexual predator provides it to the sheriff's office. 392 (10) PENALTIES.— 393 (a) Except as otherwise specifically provided, a sexual 394 predator who fails to register; wh o fails, after registration, 395 to maintain, acquire, or renew a driver license or an 396 identification card; who fails to provide required location 397 information or change -of-name information; who fails to provide 398 electronic mail addresses, Internet identifiers, and each 399 Internet identifier's corresponding website homepage or 400 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 17 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S application software name; who fails to provide all home 401 telephone numbers and cellular telephone numbers; who fails to 402 report any changes to employment information , including the 403 addition of new employment, termination of existing employment, 404 and changes to the occupation, business name, employment 405 address, and telephone number of previously reported employment; 406 or who fails to report any changes in status at an institution 407 of higher education; who fails to report any changes to vehicles 408 owned, including the addition of new vehicles and changes to the 409 make, model, color, vehicle identification number (VIN), and 410 license tag numbers of previously reported vehicles; who fails 411 to make a required r eport in connection with vacating a 412 permanent residence; who fails to reregister as required; who 413 fails to respond to any address verification correspondence from 414 the department or from county or local law enforcement agencies 415 within 3 weeks after the date of the correspondence; who 416 knowingly provides false registration information by act or 417 omission; or who otherwise fails, by act or omission, to comply 418 with the requirements of this section commits a felony of the 419 third degree, punishable as provided in s. 775.082, s. 775.083, 420 or s. 775.084. Each instance of a failure to register or report 421 changes to the required information specified in this paragraph 422 constitutes a separate offense. 423 Section 2. Paragraph (b) of subsection (2), paragraph (b) 424 of subsection (3), paragraphs (a) and (e) of subsection (4), 425 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 18 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S subsection (6), paragraph (a) of subsection (9), and paragraph 426 (c) of subsection (14) of section 943.0435, Florida Statutes, 427 are amended to read: 428 943.0435 Sexual offenders required to register with the 429 department; penalty.— 430 (2) Upon initial registration, a sexual offender shall: 431 (b) Provide his or her name; date of birth; social 432 security number; race; sex; height; weight; tattoos or other 433 identifying marks; hair and eye color; fingerprints; palm 434 prints; photograph; employment information , including 435 occupation, business name, employment address, and telephone 436 number; address of permanent or legal residence and or address 437 of any current temporary residence, within this state or out of 438 state, including a ru ral route address and a post office box; if 439 he or she has no permanent or temporary address, any transient 440 residence within this state; address, location or description, 441 and dates of any current or known future temporary residence 442 within this state or out of state; the make, model, color, 443 vehicle identification number (VIN), and license tag number of 444 all vehicles owned; home telephone numbers and cellular 445 telephone numbers; electronic mail addresses; Internet 446 identifiers and each Internet identifier's corre sponding website 447 homepage or application software name; date and place of each 448 conviction; and a brief description of the crime or crimes 449 committed by the sexual offender. The sexual 451 offender shall also produce his or her passport, if he or she 452 has a passport, and, if he or she is an alien, shall produce or 453 provide information about documents establishing his or her 454 immigration status. The sexual offender shall also provide 455 information about any professional licenses he or she has. 456 1. If the sexual offender's place of residence is a motor 457 vehicle, trailer, mobile home, or manufactured home, as those 458 terms are defined in chapter 320, the sexual offender shall also 459 provide to the department through the sheriff's office written 460 notice of the vehicle identification number (VIN); the license 461 tag number; the registration number; and a description, 462 including color scheme, of the motor vehicle, trailer, mobile 463 home, or manufactured hom e. If the sexual offender's place of 464 residence is a vessel, live -aboard vessel, or houseboat, as 465 those terms are defined in chapter 327, the sexual offender 466 shall also provide to the department through the sheriff's 467 office written notice of the hull identi fication number; the 468 manufacturer's serial number; the name of the vessel, live -469 aboard vessel, or houseboat; the registration number of the 470 vessel, live-aboard vessel, or houseboat; and a description, 471 including color scheme, of the vessel, live -aboard vessel, or 472 houseboat. 473 2. If the sexual offender is enrolled or employed, whether 474 for compensation or as a volunteer, at an institution of higher 475 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 20 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S education in this state, the sexual offender shall also provide 476 to the department the name, address, and county o f each 477 institution, including each campus attended, and the sexual 478 offender's enrollment, volunteer, or employment status. The 479 sheriff, the Department of Corrections, or the Department of 480 Juvenile Justice shall promptly notify each institution of 481 higher education of the sexual offender's presence and any 482 change in the sexual offender's enrollment, volunteer, or 483 employment status. 484 3. A sexual offender shall report with the department 485 through the department's online system or in person to the 486 sheriff's office within 48 hours after any change in vehicles 487 owned to report those vehicle information changes. 488 489 When a sexual offender reports at the sheriff's office, the 490 sheriff shall take a photograph, a set of fingerprints, and palm 491 prints of the offender and forw ard the photographs, palm prints, 492 and fingerprints to the department, along with the information 493 the sexual offender is required to provide pursuant to this 494 section. The sheriff shall promptly provide to the department 495 the information received from the sex ual offender. 496 (3) Within 48 hours after the report required under 497 subsection (2), a sexual offender shall report in person at a 498 driver license office of the Department of Highway Safety and 499 Motor Vehicles, unless a driver license or identification card 500 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 21 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S that complies with the requirements of s. 322.141(3) was 501 previously secured or updated under s. 944.607. At the driver 502 license office the sexual offender shall: 503 (b) Pay the costs assessed by the Department of Highway 504 Safety and Motor Vehicles for issuing or renewing a driver 505 license or identification card as required by this section. The 506 driver license or identification card issued must comply be in 507 compliance with s. 322.141(3). 508 (4)(a)1. Each time a sexual offender's driver license or 509 identification card is subject to renewal, and, without regard 510 to the status of the offender's driver license or identification 511 card, within 48 hours after any change in the sexual offender's 512 permanent, temporary, or transient residence or change in the 513 sexual offender's name by reason of marriage or other legal 514 process, the sexual offender shall report in person to a driver 515 license office, and is subject to the requirements specified in 516 subsection (3). The Department of Highway Safety and Motor 517 Vehicles shall forward to the department all photographs and 518 information provided by sexual offenders. Notwithstanding the 519 restrictions set forth in s. 322.142, the Department of Highway 520 Safety and Motor Vehicles may release a reproduction of a color -521 photograph or digital -image license to the Department of Law 522 Enforcement for purposes of public notification of sexual 523 offenders as provided in this section and ss. 943.043 and 524 944.606. A sexual offender who is unable to secure or update a 525 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 22 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S driver license or an identification card with the Department of 526 Highway Safety and Motor Vehicles as provided in subsection (3) 527 and this subsection shall also report any change in the sexual 528 offender's permanent, temporary, or transient residence or 529 change in the offender's name by reason of marriage or o ther 530 legal process within 48 hours after the change in person to the 531 sheriff's office in the county where the offender resides or is 532 located and provide confirmation that he or she reported such 533 information to the Department of Highway Safety and Motor 534 Vehicles. The reporting requirements under this sub-subparagraph 535 paragraph do not negate the requirement for a sexual offender to 536 obtain a Florida driver license or an identification card as 537 required in this section. This sub-subparagraph does not apply 538 to an in-state travel residence. 539 2. A sexual offender shall report an in -state travel 540 residence within 48 hours after establishing the residence. The 541 report shall be made through the department's online system; in 542 person at the sheriff's office in the county in which the sexual 543 offender is located; in person at the Department of Corrections 544 if the sexual offender is in the custody or control of, or under 545 the supervision of the Department of Corrections; or in person 546 at the Department of Juvenile Justice if the sexual offender is 547 in the custody or control of, or under the supervision of the 548 Department of Juvenile Justice. 549 (e)1. A sexual offender shall register all electronic mail 550 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 23 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S addresses and Internet identifiers, and each Internet 551 identifier's corresponding website homepage or application 552 software name, with the department through the department's 553 online system or in person at the sheriff's office within 48 554 hours after using such electronic mail addresses or Internet 555 identifiers. If the sexual offender is in the custody or 556 control, or under the supervision, of the Department of 557 Corrections, he or she must report all electronic mail addresses 558 and Internet identifiers, and each Internet identifier's 559 corresponding website homepage or application software name, to 560 the Department of Corrections before using such electronic mail 561 addresses or Internet identifiers. If the sexual offender is in 562 the custody or control, or under the supervision, of the 563 Department of Juvenile Justice, he or she must report all 564 electronic mail addresses and Internet identifiers, and each 565 Internet identifier's corresponding website homepage or 566 application software name, to the Department of Juvenile Justice 567 before using such electronic mail addresses or Internet 568 identifiers. 569 2. A sexual offender shall register all changes to 570 vehicles owned, all changes to home telephone numbers and 571 cellular telephone numbers, including added and deleted numbers, 572 all changes to employment information, including the creation of 573 a new business if self -employed, and all changes in status 574 related to enrollment, volunteering, or employment at 575 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 24 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S institutions of higher education, through the department's 576 online system; in person at the sheriff's office; in person at 577 the Department of Corrections if the sexual offender is in the 578 custody or control, or under the supervision, of the Department 579 of Corrections; or in person at the Department of Juvenile 580 Justice if the sexual offender is in the custody or control, or 581 under the supervision, of the Department of Juvenile Justic e. 582 All changes required to be reported under this subparagraph must 583 be reported within 48 hours after the change. 584 3. The department shall establish an online system through 585 which sexual offenders may securely access, submit, and update 586 all changes in status to in-state travel residences; vehicles 587 owned; electronic mail addresses; Internet identifiers and each 588 Internet identifier's corresponding website homepage or 589 application software name; home telephone numbers and cellular 590 telephone numbers; employment information; and institution of 591 higher education information. 592 (6) County and local law enforcement agencies, in 593 conjunction with the department, shall verify the addresses of 594 sexual offenders who are not under the care, custody, control, 595 or supervision of the Department of Corrections at least one 596 time per calendar year , and may verify the addresses of sexual 597 offenders who are under the care, custody, control, or 598 supervision of the Department of Corrections ., in a manner that 599 is The system for verifying addresses of sexual offenders must 600 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 25 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S be consistent with the provisions of the federal Adam Walsh 601 Child Protection and Safety Act of 2006 and any other federal 602 standards applicable to such verification or required to be met 603 as a condition for the receipt of f ederal funds by the state. 604 Local law enforcement agencies shall report to the department 605 any failure by a sexual offender to comply with registration 606 requirements. 607 (9)(a) Except as otherwise specifically provided, a sexual 608 offender who fails to register; who fails, after registration, 609 to maintain, acquire, or renew a driver license or an 610 identification card; who fails to provide required location 611 information or change -of-name information; who fails to provide 612 electronic mail addresses, Internet identifier s, and each 613 Internet identifier's corresponding website homepage or 614 application software name; who fails to provide all home 615 telephone numbers and cellular telephone numbers; who fails to 616 report any changes to employment information , including the 617 addition of new employment, termination of existing employment, 618 and changes to the occupation, business name, employment 619 address, and telephone number of previously reported employment; 620 or who fails to report any changes in status at an institution 621 of higher education; who fails to report any changes to vehicles 622 owned, including the addition of new vehicles and changes to the 623 make, model, color, vehicle identification number (VIN), and 624 license tag numbers of previously reported vehicles; who fails 625 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 26 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S to make a required report in connection with vacating a 626 permanent residence; who fails to reregister as required; who 627 fails to respond to any address verification correspondence from 628 the department or from county or local law enforcement agencies 629 within 3 weeks after the d ate of the correspondence; who 630 knowingly provides false registration information by act or 631 omission; or who otherwise fails, by act or omission, to comply 632 with the requirements of this section commits a felony of the 633 third degree, punishable as provided in s. 775.082, s. 775.083, 634 or s. 775.084. Each instance of a failure to register or report 635 changes to the required information specified in this paragraph 636 constitutes a separate offense. 637 (14) 638 (c) The sheriff's office may determine the appropriate 639 times and days for reporting by the sexual offender, which must 640 be consistent with the reporting requirements of this 641 subsection. Reregistration must include any changes to the 642 following information: 643 1. Name; social security number; age; race; sex; date of 644 birth; height; weight; tattoos or other identifying marks; hair 645 and eye color; address of any permanent residence and address of 646 any current temporary residence, within this state or out of 647 state, including a rural route address and a post office box; if 648 he or she has no permanent or temporary address, any transient 649 residence within this state; address, location or description, 650 CS/HB 1351 2025 CODING: Words stricken are deletions; words underlined are additions. hb1351-01-c1 Page 27 of 28 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S and dates of any current or known future temporary residence 651 within this state or out of state; all electronic mail addresses 652 or Internet identifiers and each Internet identifier's 653 corresponding website homepage or application software name; all 654 home telephone numbers and cellular telephone numbers; 655 employment information , including occupation, business name, 656 employment address, and teleph one number; the make, model, 657 color, vehicle identification number (VIN), and license tag 658 number of all vehicles owned; fingerprints; palm prints; and 659 photograph. A post office box may not be provided in lieu of a 660 physical residential address. The sexual of fender shall also 661 produce his or her passport, if he or she has a passport, and, 662 if he or she is an alien, shall produce or provide information 663 about documents establishing his or her immigration status. The 664 sexual offender shall also provide information a bout any 665 professional licenses he or she has. 666 2. If the sexual offender is enrolled or employed, whether 667 for compensation or as a volunteer, at an institution of higher 668 education in this state, the sexual offender shall also provide 669 to the department the name, address, and county of each 670 institution, including each campus attended, and the sexual 671 offender's enrollment, volunteer, or employment status. 672 3. If the sexual offender's place of residence 679 is a vessel, live-aboard vessel, or houseboat, as those terms 680 are defined in chapter 327, the sexual offender shall also 681 provide the hull identification number; the manufacturer's 682 serial number; the name of the vessel, live -aboard vessel, or 683 houseboat; the registration number of the vessel, live -aboard 684 vessel, or houseboat; and a description, including color scheme, 685 of the vessel, live-aboard vessel, or houseboat. 686 Section 3. This act shall take effect October 1, 2025. 687
