22	22	requiring the agency to seek by a speci fied date 9
23	23	federal approval through a Medicaid waiver or state 10
24	24	plan amendment to implement the program; requiring the 11
25	25	agency to implement and administer the program upon 12
26	26	receiving federal approval; providing an effective 13

29	29	Be It Enacted by the Legi slature of the State of Florida: 16

31	31	Section 1. This act may be cited as the "Economic Self -18
32	32	Sufficiency for Working Individuals with Disabilities." 19
33	33	Section 2. Section 409.9141, Florida Statutes, is created 20
34	34	to read: 21
35	35	409.9141 Medicaid buy -in program for working individuals 22
36	36	with disabilities.— 23
37	37	(1)(a) Contingent upon federal approval through a Medicaid 24
38	38	waiver or a state plan amendment, the agency shall implement and 25

51	51	administer a Medicaid buy -in program, authorized under the 26
52	52	Ticket to Work and Work Ince ntives Improvement Act of 1999, Pub. 27
53	53	L. No. 106-170, and the Balanced Budget Act of 1997, Pub. L. No. 28
54	54	105-33, for individuals with disabilities who are between 18 and 29
55	55	64 years of age who work and whose incomes exceed the maximum 30
56	56	income eligibility level fo r initial enrollment to obtain 31
57	57	coverage for medical assistance under the Medicaid program. The 32
58	58	agency shall determine the new income eligibility level for such 33
59	59	individuals. 34
60	60	(b) The Medicaid buy -in program under paragraph (a) must 35
61	61	provide full Medicaid be nefits to eligible individuals and must 36
62	62	limit any premiums or cost sharing to a percentage, as 37
63	63	determined by the agency, of an eligible individual's income. 38
64	64	(2) By October 1, 2025, the agency shall seek federal 39
65	65	approval through a Medicaid waiver or a sta te plan amendment as 40
66	66	necessary to implement the Medicaid buy -in program under this 41
67	67	section. The agency shall implement and administer the Medicaid 42
68	68	buy-in program upon receiving federal approval. 43
69	69	Section 3. This act shall take effect upon becoming a law. 44
