A bill to be entitled 1 
An act relating to emergency powers during a declared 2 
public health emergency; amending s. 381.00315, F.S.; 3 
revising requirements for the declaration of a public 4 
health emergency; providing an effective date. 5 
 6 
Be It Enacted by the Legislature of the State of Florida: 7 
 8 
 Section 1.  Paragraph (b) of subsection (2) of section 9 
381.00315, Florida Statutes, is amended to read: 10 
 381.00315  Public health advisories; public health 11 
emergencies; isolation and quarantines. —The State Health Officer 12 
is responsible for declaring public health emergencies, issuing 13 
public health advisories, and ordering isolation or quarantines. 14 
 (2) 15 
 (b)  Before declaring a public health eme rgency, the State 16 
Health Officer shall , to the extent possible, consult with the 17 
Governor and shall notify the Chief of Domestic Security. The 18 
declaration of a public health emergency shall continue until 19 
the State Health Officer finds that the threat or d anger has 20 
been dealt with to the extent that the emergency conditions no 21 
longer exist and he or she terminates the declaration. However, 22 
a declaration of a public health emergency may not continue for 23 
longer than 30 60 days after the declaration unless the Governor 24 
concurs in the renewal of the declaration. Each renewal shall 25

extend the expiration of the declaration for 30 days. A 26 
declaration of a public health emergency automatically 27 
terminates if it is not timely renewed before its expiration in 28 
accordance with this paragraph. An expired declaration may not 29 
be renewed. At any time, the Legislature, by concurrent 30 
resolution, may terminate the public health emergency or any 31 
related emergency order. If the public health emergency is 32 
terminated by the Legislat ure, the State Health Officer may not 33 
declare a substantially similar emergency. 34 
 Section 2. This act shall take effect July 1, 2025. 35
