22-Be It Enacted by the Legislature of the State of Florida: 9

24- Section 1. Section 810.091, Florida Statutes, is created 11
25-to read: 12
26- 810.091 Trespass at a large scale ticketed event. — 13
27- (1) As used in this section, the term: 14
28- (a) "Covered event" means a ticketed event where 15
29-attendance exceeds 5,000 persons. The duration of such event 16
30-includes the period from the time when a venue is held open to 17
31-the public for such an event until the event ends and the venue 18
32-is secured. 19
33- (b) "Person authorized" means any owner or lessee, or his 20
34-or her agent, or any law enforcement officer whose department 21
35-has received written authorization from the o wner or lessee, or 22
36-his or her agent, to communicate an order to depart the covered 23
37-event in the case of a threat to public safety or welfare. 24
38- (c) "Restricted area" means any area designated for access 25
16+events; amending s. 810.08, F.S.; providing enhanced 3
17+criminal penalties for trespass that occurs in a 4
18+structure being used for a ticketed event where 5
19+attendance exceeds a specified number; amending s. 6

23+Be It Enacted by the Legislature of the State of Florida: 10

25+ Section 1. Paragraph (c) of subsection (2) of section 12
26+810.08, Florida Statutes, is redesignated as paragraph (d), a 13
27+new paragraph (c) is added to that subsection, and subsection 14
28+(1) of that section is republished, to read:: 15
29+ 810.08 Trespass in struc ture or conveyance. 16
30+ (1) Whoever, without being authorized, licensed, or 17
31+invited, willfully enters or remains in any structure or 18
32+conveyance, or, having been authorized, licensed, or invited, is 19
33+warned by the owner or lessee of the premises, or by a pers on 20
34+authorized by the owner or lessee, to depart and refuses to do 21
35+so, commits the offense of trespass in a structure or 22
36+conveyance. 23

52- (2)(a) Except as provided in p aragraph (b), whoever, 27
53-without being authorized, licensed, or invited, willfully enters 28
54-or remains in any restricted area during a covered event, or 29
55-having been authorized, licensed, or invited, is warned by the 30
56-owner or lessee of the venue hosting the cov ered event, or by a 31
57-person authorized by the owner or lessee, to depart and refuses 32
58-to do so commits a felony of the third degree, punishable as 33
59-provided in s. 775.082, s. 775.083, or s. 775.084. 34
60- (b) A person under 18 years of age who violates paragraph 35
61-(a) commits a misdemeanor of the second degree, punishable as 36
62-provided in s. 775.082 or s. 775.083. 37
63- Section 2. This act shall take effect upon becoming a law. 38
