29-Be It Enacted by the Legislatur e of the State of Florida: 16

31- Section 1. Section 408.12, Florida Statutes, is created to 18
32-read: 19
33- 408.12 Patient overpayments; refunds. — 20
34- (1) A licensee who tenders charges for reimbursement shall 21
35-refund to the patient the amount of any overpayment made by the 22
36-patient to the licensee no later than 30 days after the date 23
37-that the licensee determines that such overpayment was made. For 24
38-purposes of this section, the term "tenders charges for 25
16+patients; creating s. 456.0625, F.S.; requiring 3
17+certain health care practitioners to refund to the 4
18+patient the amount of his or her overpayment within a 5
19+specified timeframe; providing applicability; 6
20+authorizing the applicable regulatory board, or the 7
21+Department of Health if there is no board, to adopt 8
22+rules; providing an effective date. 9

26+ Section 1. Section 456.0625, Florida Statutes, is created 13
27+to read: 14
28+ 456.0625 Patient overpayments; refunds by health care 15
29+practitioners.— 16
30+ (1) A health care practitioner licensed under chapter 458, 17
31+chapter 459, chapter 460, chapter 461, chapter 462, chapter 463, 18
32+chapter 464, chapter 465, chapter 466, chapter 467, chapter 478, 19
33+chapter 483, part I of chapter 484, chapter 486, chapter 490, or 20
34+chapter 491 shall refund to the patient the amount of any 21
35+overpayment made to the health care practitioner no later than 22
36+30 days after the date that the health care practitioner 23
37+determines that the overpayment was made. 24
38+ (2) This section does not apply to an overpayment subject 25

53-health insurer or health maintenance organization for services 28

55- (2) This section does not apply to an overpayment subject 30
56-to s. 627.6131 or s. 641.3155. 31
57- (3) A licensee who violates this section is subject to an 32
58-administrative fine under s. 408.813. 33
59- Section 2. Paragraph (g) is added to subsection (3) of 34
60-section 408.813, Florida Statutes, to read: 35
61- 408.813 Administrative fines; violations. —As a penalty for 36
62-any violation of this p art, authorizing statutes, or applicable 37
63-rules, the agency may impose an administrative fine. 38
64- (3) The agency may impose an administrative fine for a 39
65-violation that is not designated as a class I, class II, class 40
66-III, or class IV violation. Unless otherwi se specified by law, 41
67-the amount of the fine may not exceed $500 for each violation. 42
68-Unclassified violations include: 43
69- (g) Failing to refund a patient overpayment pursuant to s. 44
70-408.12. 45

88-group practice that accepts payment for services rendered by the 51
89-health care practitioner, shall refund to the patient the amount 52
90-of any overpayment made by the patient no later than 30 days 53
91-after the date that it was determined that an overpayment was 54
92-made. For purposes of this section, the term "tenders charges 55
93-for reimbursement" means the he alth care practitioner, 56
94-department, company, or practice files a claim for reimbursement 57
95-with any government-sponsored program or private health insurer 58
96-or health maintenance organization for services rendered by the 59
97-health care practitioner to the patient . 60
98- (2) This section does not apply to an overpayment subject 61
99-to s. 627.6131 or s. 641.3155. 62
100- (3) A health care practitioner's violation of this section 63
101-constitutes grounds for disciplinary action under s. 456.072. 64
102- Section 4. Paragraph (tt) is added to subsection (1) of 65
103-section 456.072, Florida Statutes, to read: 66
104- 456.072 Grounds for discipline; penalties; enforcement. — 67
105- (1) The following acts shall constitute grounds for which 68
106-the disciplinary actions specified i n subsection (2) may be 69
107-taken: 70
108- (tt) Failure to comply with s. 456.0625, relating to 71
109-refunding overpayments to patients. 72
110- Section 5. This act shall take effect January 1, 2026. 73

52+ (3) The applicable b oard, or the department if there is no 27
53+board, may adopt rules to implement this section. 28
54+ Section 2. This act shall take effect upon becoming a law. 29
