20	20	ethnicity when granting contracts or awards; 7
21	21	prohibiting an awarding body from requiring or 8
22	22	encouraging a contractor or grantee to consider race 9
23	23	or ethnicity when granting contracts, subcontracts, or 10
24	24	awards; requiring an awarding body to submit a notice 11
25	25	of proposed rulemaking and adopt a final rule within 12
26	26	specified time periods under certain circumstances; 13
27	27	requiring the reduction of procurement goals b y a 14
28	28	specified proportion under certain circumstances; 15
29	29	providing an exception; providing that certain laws, 16
30	30	charter amendments, ordinances, resolutions, rules, 17
31	31	regulations, and policies adopted by this state or a 18
32	32	local government are prohibited and void; pr oviding 19

37	37	Section 1. This act may be cited as the "End Racism in 24
38	38	Contracting Act." 25

51	51	Section 2. Section 287.05703, Florida Statutes, is created 26
52	52	to read: 27
53	53	287.05703 Prohibition of considering race or ethnicity in 28
54	54	government contracting. — 29
55	55	(1) As used in this section, the term "awarding body" has 30
56	56	the same meaning as in s. 287.05701(1). 31
57	57	(2) An awarding body may not: 32
58	58	(a) Request documentation of or consider an individual's 33
59	59	race or ethnicity when granting contracts or awards. 34
60	60	(b) Require or encourage a contractor or grantee to 35
61	61	consider the race or ethnicity of an individual to whom the 36
62	62	contractor or grantee grants contracts, subcontracts, or awa rds. 37
63	63	(3) Within 60 days after this act takes effect, if an 38
64	64	awarding body has rules or regulations providing for the 39
65	65	consideration of an individual's race or ethnicity when granting 40
66	66	contracts or awards, the awarding body shall submit a notice of 41
67	67	proposed rulemaking removing all such references. Within 180 42
68	68	days after this act takes effect, the awarding body shall adopt 43
69	69	a final rule removing all such references. 44
70	70	Section 3. If any state department or agency or any local 45
71	71	government governing body has procu rement goals based on race or 46
72	72	ethnicity established by rule or regulation, respectively, for 47
73	73	disadvantaged businesses or any other businesses in 48
74	74	disadvantaged communities, such goals shall be reduced by the 49
75	75	proportion of contracts or awards granted in the last fiscal 50

88	88	year based on such preferences relative to all other contracting 51
89	89	preferences, unless the department, agency, or governing body 52
90	90	proposes an amendment to any such rule or regulation changing 53
91	91	such goals within 60 days after this act takes effect. 54
92	92	Section 4. Any law, charter amendment, ordinance, 55
93	93	resolution, rule, regulation, or policy adopted by this state or 56
94	94	a local government that violates this act is prohibited and 57
95	95	void. 58
96	96	Section 5. This act does not apply to any existing state 59
97	97	or local government contracting goals or preferences: 60
98	98	(1) Provided to small, women -owned, or veteran-owned 61
99	99	businesses. 62
100	100	(2) Provided to disadvantaged businesses if such goal or 63
101	101	preference is required for this state or a local government to 64
102	102	be awarded a federal grant or contract. 65
103	103	(3) That are not based on race or ethnicity. 66
104	104	Section 6. This act shall take effect on the 60th day 67
105	105	after adjournment sine die of the session of the Legislature in 68
106	106	which enacted. 69
