Subsection (5) of section 1 of section 2 of 16 chapter 2005-322, Laws of Florida, is amende d to read: 17 Section 1. Minimum charter requirements. —In accordance 18 with section 189.404(3), Florida Statutes, the following 19 subsections shall comprise the minimum required charter 20 provisions for Pasco County Mosquito Control District: 21 (5) In accordance with section 388.101(1), Florida 22 Statutes, the district is governed by a three -member board, and 23 section 189.0312, Florida Statutes, as may be amended, applies 24 to this subsection, except that a member of the board may not 25 CS/HB 4051 2025 CODING: Words stricken are deletions; words underlined are additions. hb4051-01-c1 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S serve for more than two 4 -year terms. Notwithstanding section 26 388.101, Florida Statutes, the following apply, beginning with 27 the November 2026 election: 28 (a) The office of each member of the board is designated 29 as being a seat on the board, distinguished from each of the 30 other seats by a numeral 1, 2, or 3, which represents designated 31 geographical subdistricts. 32 (b) The Pasco County Board of County Commissioners shall 33 be responsible for drawing the boundaries of the geographical 34 subdistricts after providing notice and public hearing as 35 provided in general law. The geographical subdistricts shall 36 consist of contiguous and compact territories, nearly equal in 37 population as is practicable, and shall use existing political 38 and geographical boundaries. The Pasco County Board of County 39 Commissioners shall draw initial geographical subdistricts by 40 January 1, 2026, and following the completion of a decennial 41 census thereafter. 42 (c) Candidates for the board must qualify as directed by 43 chapter 99, Florida Statutes. Each candidate must designate, a t 44 the time he or she qualifies, the seat on the board for which he 45 or she qualifies. Each candidate must reside in the designated 46 subdistrict, and only electors of the subdistrict are authorized 47 to vote for the member of that subdistrict. The candidate for each seat who receives the most 51 votes shall be elected to the board. 52 (d) Each member shall be elected fo r a term of 4 years and 53 serve until the member's successor assumes office. 54 (e) For the length of their terms of office, members of 55 the board must remain residents and electors of the subdistrict 56 from which they are elected to represent By resolution dated 57 March 8, 1993, the board elected to stagger the members' terms 58 of office pursuant to section 388.101(3), Florida Statutes. 59 Therefore, upon this act becoming law, one board member shall be 60 elected in the 2006 general election and two board members in 61 the 2008 general election. Thereafter, each election shall be 62 for a term of 4 years . The membership and organization of the 63 board shall be as set forth in this act and chapter 388, Florida 64 Statutes. 65 Section 2. This act shall take effect July 1, 2025. 66
