2826 Be It Enacted by the Legislature of the State of Florida: 15

3028 Section 1. (1) As used in this section, the term 17
3129 "equestrian sport facility" means a facility within Marion 18
3230 County which is at least 500 acres in size and which includes at 19
3331 least two transient public lodging establishments as defined in 20
3432 s. 509.013(4)(a)1., Florida Statutes, and at least three public 21
3533 food service establishments as defined in s. 509.013(5), Florida 22
3634 Statutes, the principal attraction of which is sport horse 23
3735 events, including, but not limited to, show jumping, dressage, 24
3836 eventing, and other equestrian competitions. 25

5147 (2) Notwithstanding s. 561.20, Florida Statutes, the 26
5248 Division of Alcoholic Beverages and Tobacco of the Department of 27
5349 Business and Professional Regulation may issue a special 28
5450 beverage license to an equestrian sport facility for the purpose 29
55-of authorizing the package sale of only wine and malt beverages 30
56-for off-premises consumption and the sale of all alcoholic 31
57-beverages for on-premises consumption. 32

5854 (3) The special beverage license issued under this act 33
5955 shall allow an equestrian sport facili ty to designate a venue 34
6056 within the licensed premises as a stand -alone bar for the 35
6157 purpose of allowing indoor smoking, consistent with the 36
6258 requirements of s. 561.695, Florida Statutes. 37
6359 (4) A special beverage license issued under this act may 38
6460 not preclude premises with separate alcoholic beverage licenses 39
6561 from operating on the property of the equestrian sport facility. 40
6662 Any violation of the alcoholic beverage laws which occurs within 41
6763 the equestrian sport facility may not impact the operation of a 42
6864 separately licensed premises unless the violation occurs 43
6965 specifically within such separately licensed premises. If a 44
7066 violation of the alcoholic beverage laws occurs within a 45
7167 separately licensed premises, the penalty for such violation 46
7268 applies only to that separately licensed premises and not to the 47
7369 remainder of the premises covered by the special beverage 48
7470 license issued under this act. 49

8882 subject to the same requirements and restrictions as other 51
8983 licenses issued pursuant to the Beverage Law, except as 52
9084 otherwise provided in this act. The Division of Alcoholic 53
9185 Beverages and Tobacco of the Department of Business and 54
9286 Professional Regulation may adopt rules necessary to implement 55
9387 and administer this act. 56
9488 Section 2. This act shall take effect upon becoming a law. 57
