2121 Be It Enacted by the Legislature of the State of Florida: 8

2323 Section 1. Section 403.7033, Florida Statutes, is amended 10
2424 to read: 11
2525 403.7033 Departmenta l analysis of particular recyclable 12
2626 materials.—The Legislature finds that prudent regulation of 13
2727 recyclable materials is crucial to the ongoing welfare of 14
2828 Florida's ecology and economy. As such, the Department of 15
2929 Environmental Protection shall review and up date its 2010 report 16
3030 on retail bags analyzing the need for new or different 17
3131 regulation of auxiliary containers, wrappings, or disposable 18
3232 plastic bags used by consumers to carry products from retail 19
3333 establishments. The updated report must include input from state 20
3434 and local government agencies, stakeholders, private businesses, 21
3535 and citizens and must evaluate the efficacy and necessity of 22
3636 both statewide and local regulation of these materials. To 23
3737 ensure consistent and effective implementation, the department 24
3838 shall submit the updated report with conclusions and 25

5151 recommendations to the Legislature no later than December 31, 26
5252 2021. Until such time that the Legislature adopts the 27
5353 recommendations of the department, a local government, local 28
5454 governmental agency, or sta te governmental agency may not enact 29
5555 any rule, regulation, or ordinance regarding use, disposition, 30
5656 sale, prohibition, restriction, or tax of such auxiliary 31
5757 containers, wrappings, or disposable plastic bags. 32
5858 Section 2. This act shall take effect July 1, 2025. 33
