An act relating to a review under the Open Government 2
Sunset Review Act; amending s. 119.071, F.S., which 3
provides an exemption from public record requirements 4
for property photographs and personal identifying 5
information provided to specified entities for the 6
purpose of disaster recovery assistance; removing the 7
scheduled repeal date of the exemption; providing an 8
effective date. 9

Be It Enacted by the Legisl ature of the State of Florida: 11
12
Section 1. Paragraph (f) of subsection (5) of section 13
119.071, Florida Statutes, is amended to read: 14
119.071 General exemptions from inspection or copying of 15
public records.— 16
(5) OTHER PERSONAL INFORMATION. — 17
(f)1. The following information held by the Department of 18
Commerce, the Florida Housing Finance Corporation, a county, a 19
municipality, or a local housing finance agency is confidential 20
and exempt from s. 119.07(1) and s. 24(a), Art. I of the State 21
Constitution: 22
a. Medical history records and information related to 23
health or property insurance provided by an applicant for or a 24
participant in a federal, state, or local housing assistance 25

program. 26
b. Property photographs and personal identifying 27
information of an applicant for or a participant in a federal, 28
state, or local housing assistance program for the purpose of 29
disaster recovery assistance for a presidentially declared 30
disaster. 31
2. Governmental entities or their agents shall have access 32
to such confidential and exempt records and information for the 33
purpose of auditing federal, state, or local housing programs or 34
housing assistance programs. 35
3. Such confidential and exempt records and information 36
may be used in any administrative or judicial proceeding, 37
provided such records are kept confidential and exempt unless 38
otherwise ordered by a court. 39
4. Sub-subparagraph 1.b. is subject to the Open Government 40
Sunset Review Act in accordance with s. 119.15 and shall stand 41
repealed on October 2, 2025, unless rev iewed and saved from 42
repeal through reenactment by the Legislature. 43
Section 2. This act shall take effect October 1, 2025. 44
