``` Florida Senate - 2025 CS for CS for SB 1252 By the Committee on Fiscal Policy; the Appropriations Committee on Criminal and Civil Justice; and Senator Yarborough 594-03830-25 20251252c2 1 A bill to be entitled 2 An act relating to a feasibility study relating to a 3 statewide pawn data database; defining terms; 4 requiring the Department of Law Enforcement to conduct 5 a feasibility study regarding the creation of a 6 statewide pawn data database; specifying requirements 7 for such database; requiring the department to report 8 the results of the study to the Legislature by a 9 specified date; providing for repeal; subject to and 10 consistent with funds appropriated from the General 11 Appropriations Act, requiring the department to 12 complete the feasibility study; providing an effective 13 date. 14 15 Be It Enacted by the Legislature of the State of Florida: 16 17 Section 1.Statewide pawn data database feasibility study. 18 (1)As used in this section, the term: 19 (a)Department means the Department of Law Enforcement. 20 (b)Pawn data means information related to the 21 transactions of secondhand dealers and secondary metals 22 recyclers, including pawn shops, which is required by chapters 23 538 and 539, Florida Statutes, to be reported electronically to 24 law enforcement officials. The term includes, but is not limited 25 to, descriptions of property, seller information, transaction 26 dates, and any other data related to the exchange of goods. 27 (2)The department shall conduct a feasibility study 28 regarding the creation of a statewide pawn data database which, 29 at a minimum, must: 30 (a)Allow law enforcement agencies in all counties in this 31 state to access, update, and share pawn data in real-time. 32 (b)Be provided free of charge to all law enforcement 33 agencies in this state. 34 (c)Be interoperable with different law enforcement 35 databases, software solutions, and jurisdictions and meet 36 established data standards to facilitate seamless communication 37 between law enforcement agencies. 38 (d)Ensure compliance with applicable privacy and security 39 laws. 40 (3)By January 1, 2026, the department shall report to the 41 President of the Senate and the Speaker of the House of 42 Representatives the results of the feasibility study. 43 (4)This section is repealed upon submission of the report 44 required under subsection (3). 45 Section 2.As authorized by and consistent with funding 46 specifically appropriated in the General Appropriations Act, the 47 Department of Law Enforcement shall complete the feasibility 48 study required by section 1 of this act. 49 Section 3.This act shall take effect July 1, 2025. ```
