A BILL TO BE ENTITLED
AN ACT
To amend an Act providing authority for members of the Board of Education of Barrow

County, approved April 19, 1971 (Ga. L. 1971, p. 3919), as amended, particularly by an Act2
approved May 12, 2015 (Ga. L. 2015, p. 3851), so as to revise a provision relating to filling3
vacancies on the board; to provide for related matters; to repeal conflicting laws; and for4
other purposes.5
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6
SECTION 1.7
An Act providing authority for members of the Board of Education of Barrow County,8
approved April 19, 1971 (Ga. L. 1971, p. 3919), as amended, particularly by an Act approved9
May 12, 2015 (Ga. L. 2015, p. 3851), is amended by revising subsection (e) of Section 2 as10
follows:11
"(e)(1)  If the vacancy occurs more than 270 days prior to the date of a general election12
preceding the general election at which a successor will be elected to a new full term of13
office, then such vacancy shall be filled for the unexpired term of office at a partisan14
special election to be held on the same date as said general election preceding the general15
election at which a successor will be elected to a new full term of office, provided that16

such partisan special election shall be preceded by a special primary to be held in
17
conjunction with the general primary preceding such general election; and in this case the18
remaining members of the board of education shall, by majority vote, select a qualified19
person to fill the vacancy until the person elected at such special election takes office.20
(2)  If the vacancy occurs less than 270 days but more than 90 days prior to the date of21
a general election preceding the general election at which a successor will be elected to22
a new full term of office, then such vacancy shall be filled for the unexpired term of23
office at a nonpartisan special election to be held on the same date as said general election24
preceding the general election at which a successor will be elected to a new full term of25
office; and in this case the remaining members of the board of education shall, by26
majority vote, select a qualified person to fill the vacancy until the person elected at such27
special election takes office.28
(3)  If the vacancy occurs less than 90 days prior to the date of a general election29
preceding the general election at which a successor will be elected to a new full term of30
office, then the remaining members of the local board of education shall, by majority31
vote, select a qualified person to serve for the remainder of the unexpired term."32
SECTION 2.33
All laws and parts of laws in conflict with this Act are repealed.34
