3737 The city and the inhabitants thereof, are reincorporated by the enactment of this charter and26
3838 are hereby constituted and declared a body politic and corporate under the name and style27
3939 City of Blakely, Georgia, and by that name shall have perpetual existence.28

4141 Corporate boundaries.30
4242 (a) The boundaries of this city shall be those existing on the effective date of the adoption31
4343 of this charter with such alterations as may be made from time to time in the manner32
4444 provided by law. The boundaries of this city at all times shall be shown on a map to be33
4545 retained permanently in the City of Blakely City Hall and to be designated: "City of Blakely,34
4646 Georgia". Photographic, typed, or other copy of such map or description certified by the City35
4747 of Blakely shall be admitted as evidence in all courts and shall have the same force and effect36
4848 as with the original map or description.37
4949 (b) The city council may provide for the redrawing of any such map by ordinance to reflect38
5050 lawful changes in the corporate boundaries. A redrawn map shall supersede for all purposes39
5151 the entire map or maps which it is designated to replace.40

5656 Powers and construction.42
5757 (a) The city shall have all powers possible for a municipality to have under the present or43
5858 future Constitution and laws of this state as fully and completely as though they were44
5959 specifically enumerated in this charter. The city shall have all the powers of self-government45
6060 not otherwise prohibited by this charter or by general law.46
6161 (b) The powers of this city shall be construed liberally in favor of the city. The specific47
6262 mention or failure to mention particular powers shall not be construed as limiting in any way48
6363 the powers of this city.49

6565 Specific powers.51
6666 (a) Animal regulations. To regulate and license or to prohibit the keeping or running at large52
6767 of animals and fowl, and to provide for the impoundment of the same if in violation of any53
6868 ordinance or lawful order; to provide for the disposition by sale, gift, or humane destruction54
6969 of animals and fowl when not redeemed as provided by ordinance; and to provide55
7070 punishment for violation of ordinances enacted hereunder.56
7171 (b) Appropriations and expenditures. To make appropriations for the support of the57
7272 government of the city; to authorize the expenditure of money for any purposes authorized58
7373 by this charter, or for municipalities by the laws of the State of Georgia; and to provide for59
7474 the payment of expenses of the city.60
7575 (c) Building regulation. To regulate and to license the erection and construction of buildings61
7676 and all other structures; to adopt building, housing, plumbing, electrical, gas, and heating and62
7777 air conditioning codes; and to regulate all housing and building trades.63

8080 (d) Business regulation and taxation. To levy and to provide for the collection of regulatory

8282 fees and taxes on privileges, occupations, trades, and professions as authorized by Title 4865
8383 of the O.C.G.A., or other such applicable laws as are or may hereafter be enacted; to permit66
8484 and regulate the same; to provide for the manner and method of payment of such regulatory67
8585 fees and taxes; and to revoke such permits after due process for failure to pay any city taxes68
8686 or fees.69
8787 (e) Condemnation. To condemn property inside or outside the corporate limits of the city70
8888 for present or future use and for any corporate purpose deemed necessary by the governing71
8989 authority, utilizing procedures provided by the O.C.G.A. as the same shall exist from time72
9090 to time.73
9191 (f) Contracts. To enter into contracts and agreements with other governmental entities and74
9292 with private persons, firms, and corporations.75
9393 (g) Emergencies. To establish procedures for determining and proclaiming that an76
9494 emergency situation exists within or without the city, and to make and carry out all77
9595 reasonable provisions deemed necessary to deal with or meet such an emergency for the78
9696 protection, safety, health, or well-being of the citizens of the city.79
9797 (h) Environmental protection. To protect and preserve the natural resources, environment,80
9898 and vital areas of the city through the preservation and improvement of air quality, the81
9999 restoration and maintenance of water resources, the control of erosion and sedimentation, the82
100100 management of solid and hazardous waste, and other necessary actions for the protection of83
101101 the environment.84
102102 (i) Fire regulations. To fix and establish fire limits and from time to time to extend, enlarge,85
103103 or restrict the same; to prescribe fire safety regulations not inconsistent with general law,86
104104 relating to fire prevention and detection and to fire fighting; and to prescribe penalties and87
105105 punishment for violations thereof.88
106106 (j) Garbage fees. To levy, fix, assess, and collect a garbage, refuse, and trash collection and89
107107 disposal, and other sanitary service charge, tax, or fee for such services as may be necessary90

110110 in the operation of the city from all individuals, firms, and corporations residing in or doing

112112 business therein benefitting from such services or to whom such services are available; to92
113113 enforce the payment of such charges, taxes, or fees; and to provide for the manner and93
114114 method of collecting such service charges.94
115115 (k) General health, safety, and welfare. To define, regulate, and prohibit any act, practice,95
116116 conduct, or use of property which is detrimental to health, sanitation, cleanliness, welfare,96
117117 and safety of the inhabitants of the city, and to provide for the enforcement of such standards.97
118118 (l) Gifts. To accept or refuse gifts, donations, bequests, or grants from any source for any98
119119 purpose related to powers and duties of the city and the general welfare of its citizens, on99
120120 such terms and conditions as the donor or grantor may impose.100
121121 (m) Health and sanitation. To prescribe standards of health and sanitation and to provide101
122122 for the enforcement of such standards.102
123123 (n) Jail sentences. To provide that persons given jail sentences in the city's court may work103
124124 out such sentences in any public works or on the streets, roads, drains, and other public104
125125 property in the city, to provide for commitment of such persons to any jail, or to provide for105
126126 commitment of such persons to any county work camp or county jail by agreement with the106
127127 appropriate county officials.107
128128 (o) Motor vehicles. To regulate the operation of motor vehicles and exercise control over108
129129 all traffic, including parking upon or across the streets, roads, alleys, and walkways of the109
130130 city.110
131131 (p) Municipal agencies and delegation of power. To create, alter, or abolish departments,111
132132 boards, offices, commissions, and agencies of the city, and to confer upon such agencies the112
133133 necessary and appropriate authority for carrying out all the powers conferred upon or113
134134 delegated to the same.114
135135 (q) Municipal debts. To appropriate and borrow money for the payment of debts of the city115
136136 and to issue bonds for the purpose of raising revenue to carry out any project, program, or116
137137 venture authorized by this charter or the laws of the State of Georgia.117

140140 (r) Municipal property ownership. To acquire, dispose of, lease, option, and hold in trust

142142 or otherwise, any real, personal, or mixed property, in fee simple or lesser interest, inside or119
143143 outside the property limits of the city.120
144144 (s) Municipal property protection. To provide for the preservation and protection of121
145145 property and equipment of the city and the administration and use of same by the public; and122
146146 to prescribe penalties and punishment for violations thereof.123
147147 (t) Municipal utilities. To acquire, lease, construct, operate, maintain, sell, and dispose of124
148148 public utilities, including, but not limited to, a system of waterworks, sewers and drains,125
149149 sewage disposal, gas works, electric light plants, cable television, and other126
150150 telecommunications, transportation facilities, public airports, and any other public utility; and127
151151 to fix the taxes, charges, rates, fares, fees, assessments, regulations, and penalties, and to128
152152 provide for the withdrawal of service for refusal or failure to pay the same.129
153153 (u) Nuisance. To define a nuisance and provide for its abatement whether on public or130
154154 private property.131
155155 (v) Penalties. To provide penalties for violation of any ordinances adopted pursuant to the132
156156 authority of this charter and the laws of the State of Georgia.133
157157 (w) Planning and zoning. To provide comprehensive city planning for development by134
158158 zoning; and to provide subdivision regulation and the like as the city council deems135
159159 necessary and reasonable to insure a safe, healthy, and aesthetically pleasing community.136
160160 (x) Police and fire protection. To exercise the power of arrest through duly appointed137
161161 policemen and to establish, operate, or contract for a police and a fire fighting agency.138
162162 (y) Public hazards: removal. To provide for the destruction and removal of any building or139
163163 other structure which is or may become dangerous or detrimental to the public.140
164164 (z) Public improvements. To provide for the acquisition, construction, building, operation,141
165165 and maintenance of public ways, parks and playgrounds, recreational facilities, cemeteries,142
166166 markets and market houses, public buildings, libraries, public housing, airports, hospitals,143
167167 terminals, docks, parking facilities, or charitable, cultural, educational, recreational,144

170170 conservation, sport, curative, corrective, detentional, penal and medical institutions, agencies,

172172 and facilities; and to provide any other public improvements, inside or outside the corporate146
173173 limits of the city; to regulate the use of public improvements; and for such purposes, property147
174174 may be acquired by condemnation under procedures provided by the O.C.G.A. as the same148
175175 shall exist from time to time.149
176176 (aa) Public peace. To provide for the prevention and punishment of drunkenness, riots, and150
177177 public disturbances.151
178178 (bb) Public transportation. To organize and operate such public transportation systems as152
179179 are deemed beneficial.153
180180 (cc) Public utilities and services. To grant franchises or make contracts for, or impose taxes154
181181 on public utilities and public service companies; and to prescribe the rates, fares, regulations155
182182 and standards, and conditions of service applicable to the service to be provided by the156
183183 franchise grantee or contractor, insofar as not in conflict with valid regulations of the public157
184184 service commission.158
185185 (dd) Regulation of roadside areas. To prohibit or regulate and control the erection, removal,159
186186 and maintenance of signs, billboards, trees, shrubs, fences, buildings, and any and all other160
187187 structures or obstructions upon or adjacent to the rights of way of streets and roads or within161
188188 view thereof, within or abutting the corporate limits of the city; and to prescribe penalties and162
189189 punishment for violation of such ordinances.163
190190 (ee) Retirement. To provide and maintain a retirement plan for officers and employees of164
191191 the city.165
192192 (ff) Roadways. To lay out, open, extend, widen, narrow, establish, or change the grade of,166
193193 abandon or close, construct, pave, curb, gutter, provide drainage for, adorn with shade trees,167
194194 or otherwise improve, maintain, repair, clean, prevent erosion of, and light the roads, alleys,168
195195 and walkways within the corporate limits of the city; and to grant franchises and rights of169
196196 way throughout the streets and roads, and over the bridges and viaducts for the use of public170

199199 utilities; and to require real estate owners to repair and maintain in a safe condition the

201201 sidewalks adjoining their lots or lands, and to impose penalties for failure to do so.172
202202 (gg) Sewer fees. To levy a fee, charge, or sewer tax as necessary to assure the acquiring,173
203203 constructing, equipping, operating, maintaining, and extending of a sanitary sewage disposal174
204204 plant and sewerage system, and to levy on those to whom sewers and sewerage systems are175
205205 made available a sewer service fee, charge, or sewer tax for the availability or use of the176
206206 sewers; to provide for the manner and method of collecting such service charges and for177
207207 enforcing payment of the same; and to charge, impose, and collect a sewer connection fee178
208208 or fees to those connected with the system.179
209209 (hh) Solid waste disposal. To provide for the collection and disposal of garbage, rubbish,180
210210 and refuse, and to regulate the collection and disposal of garbage, rubbish, and refuse by181
211211 others; and to provide for the separate collection of glass, tin, aluminum, cardboard, paper,182
212212 and other recyclable materials, and to provide for the same of such items.183
213213 (ii) Special areas of public regulation. To regulate or prohibit junk dealers, pawn shops, the184
214214 manufacture, sale, or transportation of intoxicating liquors, and the use and sale of firearms;185
215215 to regulate the transportation, storage, and use of combustible, explosive, and inflammable186
216216 materials, the use of lighting and heating equipment, and any other business or situation187
217217 which the city may deem to be dangerous to persons or property; to regulate and control the188
218218 conduct of peddlers and itinerant traders, theatrical performances, exhibitions, and shows of189
219219 any kind, by taxation or otherwise; and to license, tax, regulate, or prohibit professional190
220220 fortune-telling, palmistry, adult bookstores, and massage parlors.191
221221 (jj) Special assessments. To levy and provide for the collection of special assessments to192
222222 cover the costs for any public improvements.193
223223 (kk) Taxes: ad valorem. To levy and provide for the assessment, valuation, revaluation, and194
224224 collection of taxes on all property subject to taxation.195
225225 (ll) Taxes: other. To levy and collect such other taxes as may be allowed now or in the196
226226 future by law.197

229229 (mm) Taxicabs. To regulate and license vehicles operated for hire in the city; to limit the

231231 number of such vehicles; to require the operators thereof to be licensed; to require public199
232232 liability insurance on such vehicles in the amounts to be prescribed by ordinance; and to200
233233 regulate the parking of such vehicles.201
234234 (nn) Urban redevelopment. To organize and operate an urban redevelopment program.202
235235 (oo) Other powers. To exercise and enjoy all other powers, functions, rights, privileges, and203
236236 immunities necessary or desirable to promote or protect the safety, health, peace, security,204
237237 good order, comfort, convenience, or general welfare of the city and its inhabitants; and to205
238238 exercise all implied powers necessary or desirable to carry into execution all powers granted206
239239 in this charter as fully and completely as if such powers were fully stated herein; and to207
240240 exercise all powers now or in the future authorized to be exercised by other municipal208
241241 governments under other laws of the State of Georgia; and no listing of particular powers in209
242242 this charter shall be held to be exclusive of others, nor restrictive of general words and210
243243 phrases granting powers, but shall be held to be in addition to such powers unless expressly211
244244 prohibited to municipalities under the Constitution or applicable laws of the State of Georgia.212

246246 Exercise of powers.214
247247 All powers, functions, rights, privileges, and immunities of the city, its officers, agencies, or215
248248 employees shall be carried into execution as provided by this charter. If this charter makes216
249249 no provisions, such shall be carried into execution as provided by ordinance or as provided217
250250 by pertinent laws of the State of Georgia.218

257257 City council creation; number; election.222
258258 The legislative authority of the government of this city, except as otherwise specifically223
259259 provided in this charter, shall be vested in a city council to be composed of a mayor and four224
260260 councilmembers. The city council established shall in all respects be a successor to and225
261261 continuation of the governing authority under prior law. The mayor and councilmembers226
262262 shall be elected in the manner provided by general law and this charter.227
263263 Section 2.11.228
264264 City council terms and qualifications for office.229
265265 (a) The mayor and members of the city council shall serve for terms of four years and until230
266266 their respective successors are elected and qualified. No person shall be eligible to serve as231
267267 mayor or councilmember unless that person shall have been a resident of the city for one year232
268268 prior to the date of election of the mayor or councilmember.233
269269 (b) The mayor may reside anywhere within the city and must receive a majority of the votes234
270270 cast for such office in the entire city. The mayor must continue to reside within the city235
271271 during his or her term of office, or the office shall thereupon become vacant.236
272272 (c) In order to be elected as a member of the board from a council district, a person must237
273273 reside in that council district at the time such person is elected and must receive a majority238
274274 of the votes cast for that office in that district only, and not at large. Only electors who are239
275275 residents of a council district may vote for a councilmember from that district. At the time240
276276 of qualifying for election as a councilmember from a council district, each candidate for such241

279279 office shall specify the council district for which that person is a candidate. A person elected

281281 as a councilmember from a council district must continue to reside in that district during that243

284284 Vacancy; filling of vacancies.246
285285 (a) The office of mayor or councilmember shall become vacant upon the occurrence of any247
286286 event specified by the Constitution of the State of Georgia, Title 45 of the O.C.G.A., or such248
287287 other applicable laws as are or may hereafter be enacted. Provided, however, the office of249
288288 mayor or councilmember shall become vacant upon the unexcused absence of the holder of250
289289 the office from four consecutive regularly scheduled meetings of the city council. Excused251
290290 absences shall be granted by a majority vote of the remaining city councilmembers and the252
291291 mayor as provided in Section 2.21 and shall be entered upon the minutes of the council253
292292 meeting.254
293293 (b) A vacancy in the office of mayor or councilmember shall be filled for the remainder of255
294294 the unexpired terms, if any, by appointment by the remaining councilmembers if less than256
295295 six months remain in the unexpired term, otherwise by an election, as provided for in257
296296 Section 5.14 of this charter and in accordance with Titles 21 and 45 of the O.C.G.A., or other258
297297 such laws as are or may hereafter be enacted.259

307307 (a) Elected and appointed officers of the city are trustees and servants of the residents of the266
308308 city and shall act in a fiduciary capacity for the benefit of such residents.267
309309 (b) Neither the mayor nor any member of the city council shall vote upon, sign, or veto any268
310310 ordinance, resolution, contract, or other matter in which that person is financially interested.269

312312 Inquiries and investigations.271
313313 Following the adoption of an authorizing resolution, the city council may make inquiries and272
314314 investigations into the affairs of the city and the conduct of any department, office, or agency273
315315 thereof, and for this purpose may subpoena witnesses, administer oaths, take testimony, and274
316316 require the production of evidence. Any person who fails or refuses to obey a lawful order275
317317 issued in the exercise of these powers by the city council shall be punished as provided by276
318318 ordinance.277

328328 The city council is hereby empowered to acquire, construct, operate, and maintain public284
329329 ways, parks, public grounds, cemeteries, markets, market houses, public buildings, libraries,285
330330 sewers, drains, sewage treatment, waterworks, electrical systems, gas systems, airports,286
331331 hospitals, and charitable, educational, recreational, sport, curative, corrective, detentional,287
332332 penal and medical institutions, agencies and facilities, and any other public improvements288
333333 inside or outside the city, and to regulate the use thereof, and for such purposes, property289
334334 may be condemned under procedures established under general law applicable now or as290
335335 provided in the future.291

337337 Organizational meetings.293
338338 The city council shall hold an organizational meeting on the first meeting in January294
339339 following the regular election, as provided in Section 5.11. The meeting shall be called to295
340340 order by the city clerk, and the oath of office shall be administered to the newly elected296
341341 members as follows:297
342342 "I __________ do solemnly swear or affirm that I will properly perform the duties of the298
343343 office of ____________ in and for the City of Blakely, to the best of my knowledge, skill,299
344344 and ability; that I am not the holder of any unaccounted for public money due to the State300
345345 of Georgia or any political subdivision or authority thereto; that I am not the holder of any301
346346 office of trust under the government of the United States, any other state, or any foreign302
347347 state, which I am by the laws of the State of Georgia prohibited from holding; that I am303
348348 qualified to hold the office which I am about to enter according to the Constitution and304
349349 laws of Georgia; that I will support the Constitution of the United States and the State of305

352352 Georgia; that I have been a resident of the City of Blakely from which elected and the City

354354 of Blakely for the time required by the Constitution and laws of the State of Georgia and307

357357 Regular and special meetings.310
358358 (a) The city council shall hold regular meetings at such times and places as shall be311
359359 prescribed by ordinance.312
360360 (b) Special meetings of the city council may be held on call of the mayor or two members313
361361 of the city council. Notice of such special meetings shall be served on all other members314
362362 personally, or by telephone personally, at least 24 hours in advance of the meeting. Such315
363363 notice to councilmembers shall not be required if the mayor and all councilmembers are316
364364 present when the special meeting is called. Such notice of any special meeting may be317
365365 waived by a councilmember in writing before or after such a meeting, and attendance at the318
366366 meeting shall also constitute a waiver of notice on any business transacted in such319
367367 councilmember's presence. Only the business stated in the call may be transacted at the320
368368 special meeting. Upon the unanimous consent of all members present, any business which321
369369 may be transacted at a regular meeting may be conducted at the special meeting.322
370370 (c) All meetings of the city council shall be public to the extent required by law, and notice323
371371 to the public of special meetings shall be made fully as is reasonably possible as provided by324
372372 Code Section 50-14-1 of the O.C.G.A. or other such applicable laws as are or may hereafter325
373373 be enacted.326

378378 Rules of procedure.328
379379 (a) The city council shall adopt its rules of procedure and order of business consistent with329
380380 the provisions of this charter and shall provide for keeping a journal of its proceedings, which330
381381 shall be a public record.331
382382 (b) All committees and committee chairs and officers of the city council shall be appointed332
383383 by the mayor and shall serve at the pleasure of the mayor. The mayor shall have the power333
384384 to appoint new members to any committee at any time.334

439439 public of emergency meetings shall be made as fully as is reasonably possible in accordance383
440440 with Code Section 50-14-1 of the O.C.G.A., or such other applicable laws as are or may384

472472 council. Following publication of the first code under this charter and at all times thereafter,413
473473 the ordinances and charter amendments shall be printed in substantially the same style as the414
474474 code currently in effect and shall be suitable in form for incorporation therein. The city415
475475 council shall make such further arrangements as deemed desirable with reproduction and416
476476 distribution of any current changes in or additions to codes of technical regulations and other417

704704 charged with violations. Whenever any person shall give bail for that person's appearance618
705705 and shall fail to appear at the time fixed for trial, the bond shall be forfeited by the judge619
